Judicial Review of State Legislation: An Ironic Return to Lochnerian Ideology When Public Sector Labor Contracts Are Impaired

(Excerpt) This Note argues that, despite its notorious reputation as the case that permitted and encouraged judicial usurpation of the states’ inherent police powers, a return to a Lochnerian level of review of economic legislation is appropriate when state or local legislatures pass laws that substantially impair public sector labor contracts. Part I briefly recaps the Lochner era, beginning with an overview of Lochner itself and culminating in a brief discussion of the criticisms of Lochner. Part II introduces the Contract Clause and demonstrates that the contemporary test for determining whether there has been a Contract Clause violation is similar to the Lochner Court’s analysis for whether the Fourteenth Amendment’s substantive due process guarantee of liberty of contract had been violated. Part III reveals that Lochner’s legacy may positively live on by protecting public sector employees from substantial contractual impairments, despite the nefarious connotation of the “Lochner” name. First, through an in-depth review of two cases, Fraternal Order of Police v. Prince George’s County and Buffalo Teachers Federation v. Tobe, Part III shows that courts struggle and vary with the amount of deference owed and given to state legislatures. Additionally, Part III illustrates that, without strict scrutiny, courts may be reluctant to find contract-impairing laws in violation of the Contract Clause, leaving public sector employees unprotected from unconstitutional state legislation. In light of the tumultuous economy and the states’ increasing resort to furloughs and wage freezes to close budget gaps, Part III concludes with a call to the courts to responsibly use the power that they wield and place a limit on the states’ “unbounded power . . . where legislation of this character is concerned, and where the protection of the Federal Constitution is sought.

Pengaruh Praktik Kerja Industri Dan Penguasaan Mata Diklat Terhadap Kesiapan Kerja Siswa Smk Di Kabupaten Kendal

The objective of the study was to investigate the influence of industrial work practices and accounting productive mastery toward students\u27 work readiness in 12the Grade students of accounting program vocational schools in Kendal district both simultaneously and partially. The population of the study was accounting students in state and private vocational school in Kendal, they were 368 students. The samples were 192 students chosen by proportional random sampling technique. Data were collected by documentation and questionnaires, then analyzed by descriptive analysis. Furthermore, hypothesis was tested by multiple linear regression analysis. The result showed that industrial work practices and accounting productive mastery influenced simultaneously toward students\u27 work readiness by 56.6%, and partially, the influence of industrial work practices was 45.02% and the influence of accounting productive mastery was only 18.15%

RANCANGAN DATABASE UNTUK MANAJEMEN MATERIAL PADA PROYEK PERUMAHAN (Studi Kasus : Pembangunan Perumahan Taman Insan Kapuas II)

ABSTRAKMaterial menjadi sumber daya terpenting karena mempunyai nilai persentase biaya yang cukup besar dari total biaya proyek pada sebuah proyek konstruksi. Pekerjaan proyek konstruksi semakin rumit seiring perkembangan zaman, oleh karena itu diperlukan fungsi manajemen yang baik dan benar pada proyek konstruksi khususnya pada manajemen material. Penelitian ini bertujuan ntuk membuat sistem  informasi manajemen material yang berfungsi mengatasi masalah pada proyek pembangunan Perumahan Taman Insan Kapuas II secara optimal terkait proses manajemen material dan persediaan material di Gudang menggunakan bantuan software Microsoft Excel. Pengumpulan data primer berupa jenis-jenis form yang diperlukan selama aktivitas pengelolaan material pada proyek serta data sekunder berupa volume pekerjaan, gambar ABD dan Rancangan Anggaran Biaya (RAB). Pengolahan data dilakukan dengan cara memasukkan data primer yang dilengkapi data sekunder ke dalam rancangan sistem yang telah dibuat menggunakan Microsoft Excel sebagai database. Dari hasil penelitian yang sudah dilakukan, didapatkan kesimpulan berupa sebuah konsep rancangan berbasis database yang mendukung kemudahan dalam pencarian, pengolahan, penyimpanan data-data pelaksanaan manajemen material secara rinci sehingga pengendalian material dapat lebih efektif dan efisien.Kata Kunci : manajemen material, material, sistem databas

Penanda Kohesi Pada Tajuk Rencana Harian Surat Kabar Kompas Edisi Januari 2015

Penelitian ini mengandung tujuan untuk (1) mendeskripsikan penggunaan kohesi gramatikal pada tajuk rencana harian surat kabar Kompas edisi Januari 2015 dan (2) mendeskripsikan penggunaan kohesi leksikal pada tajuk rencana harian surat kabar Kompas edisi Januari 2015. Penelitian ini termasuk dalam penelitian kualitatif deskriptif. Data dalam penelitian ini berupa kalimat atau wacana yang mengandung kohesi gramatikal dan kohesi leksikal dari tajuk rencana harian surat kabar Kompas edisi bulan Januari 2015. Hasil analisis dalam penelitian ini merumuskan kesimpulan bahwa tiga belas tajuk rencana harian surat kabar Kompas edisi Januari 2015 mengandung 80 wacana yang berhubungan dengan penanda kohesi baik kohesi gramatikal maupun kohesi leksikal. Penanda kohesi gramatikal yang digunakan berupa 4 jenis penanda yaitu referensi, substitusi, elipsis, dan konjungsi. Referensi yang digunakan terdiri atas (1) pengacuan persona yang ditandai dengan persona saya, kita, kami, ia, -nya, dan mereka sebanyak 10 data, (2) pengacuan demonstratif ditandai dengan nomina penunjuk waktu dan nomina penunjuk tempat sebanyak 9 data, serta (3) pengacuan komparatif yang ditandai dengan kata seperti sebanyak 1 data. Adapun substitusi yang digunakan yaitu substitusi nomina sebanyak 2 data, substitusi verba sebanyak 1 data, dan substitusi klausa juga sebanyak 1 data. Penanda elipsis ditemukan dalam dua jenis yaitu elipsis nomina sebanyak 2 data dan elipsis klausa sebanyak 1 data. Sedangkan konjungsi yang digunakan terdiri atas konjungsi kausal (sebab, karena); konjungsi adversatif (tetapi, namun); konjungsi korelatif (apalagi, demikian juga); konjungsi subordinatif (meskipun, walaupun); konjungsi temporal (kemudian); konjungsi (apabila, jika, kalau); konjugsi agar; konjungsi (dan, juga, serta); konjungsi atau; konjungsi setelah; konjungsi sedangkan; konjungsi ketika; dan konjungsi sehingga. Adapun penanda kohesi leksikal yang digunakan pada tajuk rencana harian surat kabar Kompas juga berupa 4 jenis yaitu repetisi, sinonimi, antonimi, dan hiponimi. Repetisi yang terjadi antara lain berupa repetisi penuh/utuh sebanyak 2 data, repetisi dengan perubahan bentuk sebanyak 3 data, dan repetisi sebagian sebanyak 1 data. Adapun sinonimi yang digunakan berupa sinonimi dengan morfem terikat sebanyak 3 data. Demikian pula penanda antonimi yang digunakan berupa antonimi dengan morfem terikat sebanyak 1 data dan antonimi dengan kata sebanyak 2 data. Sedangkan hiponimi yang digunakan berwujud hiponimi nomina sebanyak 3 data

KEPUTUSAN KONSUMEN TERHADAP PEMBELIAN MINUMAN DAUN TEA BAR (Studi Kasus di Daun Tea Bar Kota Malang)

AbstrakIndustri minuman teh terus menunjukkan tren positif setiap tahunnya. Selain karena perubahan gaya hidup, teh menjadi produk minuman yang paling dekat dengan kultur masyarakat Indonesia. Penelitian ini bertujuan untuk menganalisis faktor-faktor yang mempengaruhi keputusan konsumen terhadap pembelian minuman Daun Tea Bar yang berlokasi di Jalan Soekarno Hatta No. 7, Jatimulyo, Lowokwaru, Kota Malang. Penelitian ini dilaksanakan pada bulan Juli 2022. Pengambilan sampel dilakukan dengan menggunakan secara accidental sampling dengan sampel sebanyak 56 customer Daun Tea Bar. Analisis data menggunakan resgresi model logit. Hasil penelitian menunjukkan bahwa variabel gaya hidup, harga minuman Daun Tea bar, harga minumanl lain, tempat, dan proses berpengaruh signifikan terhadap keputusan pembelian minuman Daun Tea Bar, dan variabel pendapatan, pekerjaan, selera, kualitas produk, promosi, orang, dan tampilan fisik tidak berpengaruh signifikan terhadap keputusan pembelian minuman Daun Tea Bar.Kata Kunci: Industri minuman teh, keputusan pembelia

This study aims to describe the influence of the principal’s leadership toward the quality of service at SMA Subrayon 01 Palembang. This research used quantitative descriptive approach with 62 respondents and got data by using questionnaire, observation, and documentation, the data gotten were tested by using prerequisite test and analyzed by using linear regression analysis. Reconstruction of Marriage and Divorce Law for Civil Servants

This article analyzes Government Regulation Number 45 of 1990, this regulation contains gaps in polygamy arrangements between men and women who are civil servants.  The focus of this article is to describe the construction of polygamy regulations for the State Civil Apparatus (ASN) which seems gender biased, then how efforts to reconstruct polygamy rules for the State Civil Apparatus (ASN) and then analyze its contribution to the reform of Islamic family law in Indonesia. This library research article is descriptive analytical. The primary data sources in writing this article are the Qur'an, Hadith, and positive laws in Indonesia that regulate marriage and divorce for Civil Servants. The analysis uses the theory of Mashlahah Mursalah, Gender and Feminist Amina Wadud and Gustav Redbruch's theory of legal objectives. The result of the analysis is Government Regulation Number 45 of 1990 concerning Marriage and Divorce Permits for Civil Servants which regulates polygamy for Civil Servants, must be rejected because it contains legal content that is not fair to women as legal subjects. Pengaruh Rasio Inflasi Dan Suku Bunga Indonesia Relatif Terhadap Amerika Serikat Pada Nilai Tukar Rupiah (Implementasi Purchasing Power Parity Internasional Fisher Effect)

The purpose of this study was to examine the influence of the ratio of Indonesia's inflation and interest rates relative to United States on the exchange rate of Rupiah by implementing PPP and IFE. The PPP theory explains change of exchange rate differences related to inflation applicable from one country to another. The IFE theory movement of exchange rate of currency of a country with other countries caused by nominal interest rate differentials that exist in the two countries. The currency used to compare in this research is United States Dollar. Implementasi O-score Model untuk Memprediksi Financial Distress Perusahaan (Studi pada Perusahaan Manufaktur Sub Sektor Tekstil dan Garmen yang Terdaftar di Bursa Efek Indonesia Periode 2011-2015)

This study aims to predict the level of financial distress of textile and garment manufacturing companies listed in Indonesia Stock Exchange period 2011-2015 using O-Score Model. This research is a descriptive research. Sources of data in the study are secondary data in the form of financial statements of sample companies and gnp data. Sample selection technique is using purposive sampling method and obtained 13 companies used as sample research. There are 9 independent variables used in the O-Score formula. The O-Score Model illustrates the possibility of financial distress using logistical transformations or P (O-Score). The company will be in a safe zone, if P (O-Score) <0.50. Conversely, the company will experience financial distress when P (O-Score)> 0.50. The results show that nine out of 13 companies are always in the safe zone for five consecutive years. One company is predicted to be in the financial distress zone for five consecutive years, while three companies are in an unstable condition for five years
