    TELAAH SIYASAH SYARā€™IYYAH ATAS SENGKETA TANAH

    Penelitian ini bertujuan untuk mengkaji mekanisme penyelesaian sengketa tanah dalam perspektif Siyasah Syarā€™iyyah. Penelitian ini merupakan penelitian kualitatif, dengan pendekatan yuridis dan sosiologis. Data dikumpulkan melalui observasi, wawancara, dan dokumentasi, data yang terkumpul kemudian dianalisis secara kualitatif kemudian ditarik kesimpulan. Hasil pembahasan dalam kajian ini menyimpulkan bahwa konsep Siyasah Syarā€™iyyah dalam penyelesaian sengketa, dilakukan dengan dua cara yaitu al-Qadha (peradilan) dan Tahkim, di mana para pihak yang bersengketa akan menunjuk langsung seorang hakam yang menjadi penegah atau perwasitan dalam proses penyelesaian sengketa oleh para pihak, dalam hal penyelesaian sengketa dilakukan dengan mengutamakan proses perdamaian. Sementara jika terjadi pelanggaran terhadap larangan, maka akan menjadi kewenangan al-Qadha.Kata Kunci: Sengketa; Siyasah Syarā€™iyyah; Tana

    AbstrakPokok permasalahan yang dibahas adalah mengenai Tradisi Gantarangkeke dalam Perspektif Sadd Al-Dzariā€™ah yang ada di Kecamatan gantarangkeke Kabupaten Bantaeng. Penelitian ini merupakan penelitian kualitatif atau penelitian lapangan dengan menggunakan jenis pendekatan fenomenologi, teologis, sosiologis, dan pendekatan syarā€™i. Kemudian metode pengumpulan data yang digunakan adalah observasi, wawancara, serta dokumentasi. Adapun sumber data dari penelitian ini merupakan tokoh masyarakat, tokoh adat, tokoh agama, dan beberapa instansi terkait. Hasil penelitian ini menunjukan bahwa adanya suatu tradisi tahunan yang diyakini oleh masyarakat mampu memberikan keberkahan dan manfaat serta berpengaruh dalam kehidupan mereka, kemudian juga menggambarkan bagaimana pandangan hukum islam utamanya Sadd al-Dzariā€™ah terhadap keyakinan tersebut. Sebagai umat muslim yang sangat yakin adanya Allah, mereka juga yakin terhadap adanya berkah yang dapat diperoleh dari berbagai bentuk pemujaan yang dilakukan. Tradisi Gantarangkeke dikenal mengandung unsur islami oleh para penggiatnya, apalagi pelaksanaannya menjelang bulan romadhan tepatnya pada pertengahan bulan syaā€™ban. Inilah salah satu hal yang mempengaruhi aqidah dan akhlak seorang muslim.Kata Kunci: Tradisi, Gantarangkeke, Sadd al Dzariā€™ahAbstractThe main issue discussed is the Gantarangkeke Tradition in the Sadd Al-Dzari'ah Perspective in Gantarangkeke District, Bantaeng Regency.Ā This research is a qualitative research or field research using phenomenological, theological, sociological, and syar'i approaches. Then the data collection methods used were observation, interviews, and documentation. The sources of data from this research are community leaders, traditional leaders, religious leaders, and several related institutions.Ā The results of this study indicate that there is an annual tradition that is believed by the community to be able to provide blessings and benefits and influence their lives, then also describes how the views of Islamic law, especially Sadd al-Dzari'ah, towards this belief.Ā As Muslims who strongly believe in the existence of Allah, they also believe in the blessings that can be obtained from various forms of worship. The Gantarangkeke tradition is known to contain Islamic elements by its activists, moreover its implementation before the month of Ramadan, precisely in the middle of the month of Sha'ban.     SISTEM PEMERINTAHAN KERAJAAN WAJO DI DESA TOSORA ABAD XV-XVII PERSPEKTIF SIYASAH SYAR'IYYAH

    Penelitian ini diarahkan untuk mengkaji bentuk dan sistem pemerintahan kerajaan Wajo khususnya pada Abad XV-XVII. Penelitian ini keseluruhannya menggunakan penelitian kualitatif. Sistem pemerintahan Kerajaan Wajo pada masa pemerintahan raja Cinnotabi sampai pada masa pemerintahan Batara Wajo menerapkan sistem pemerintahan monarki absolut, namun karena masyarakat merasakan ketidakadilan, sikap otoriter raja dan ketidakcakapnya dalam menjalankan pemerintahan, maka gelar Batara Wajo disepakati diubah menjadi Arung Matoa, dengan sistem pemerintahan monarki konstitusional, di mana kekuasaan raja dibatasi oleh aturan adat dan hukum yang berlaku. Namun jika diperhatikan, pada saat kekuasaan dibawah kendali Latadangpare Puangrimaggalatung Arung Matoa ke-IV, sistem pemerintahan menerapkan prinsip-prinsip demokrasi, seperti membentuk dewan pemerintahan yang memiliki tugas yang berbeda-beda, hal tersebut masih diterapkan setelah pemilihan Arung Matoa baru, dewan pemerintahan diberi tugas masing-masing untuk mengawal jalannya pemilihan Arung Matoa. Sementara dari perspektif siyasah syarā€™iyyah, sistem pemerintahan Kerajaan Wajo sedikit banyaknya memiliki kesamaan dengan syariat Islam, meskipun hukum Islam tidak dijadikan sebagai landasan hukum dalam kehidupan kerajaan, namun secara substansi telah tercermin adanya praktik hukum Islam yang sudah dilaksanakan, seperti dalam acara sunnatan, perkawinan, kewarisan, dan adanya lembaga yang secara khusus mengatur masalah agama yang disebut parewa sarak.Kata Kunci: Kerajaan Wajo Abad XV-XVII; Sistem Pemerintahan; Siyasah Syarā€™iyya

    PELAKSANAAN WALIMATUL ā€˜URSY DI TENGAH PANDEMI COVID-19 DALAM PERSPEKTIF HUKUM ISLAM

    AbstrakPokok permasalahan penelitian ini adalah pelaksanaan walimatul ā€˜ursy di tengah pandemi covid-19 dalam perspektif hukum islam di kecamatan Ujung Bulu Kabupaten Bulukumba. Pokok masalah terdiri dari dua sub masalah yaitu: 1) Bagaimana Pelaksanaan Walimatul ā€˜Ursy di Tengah Pandemi Covid-19 di Kecamatan Ujung Bulu Kabupaten Bulukumba? 2) Bagaimana Perspektif Hukum Islam terkait Pelaksanaan Walimatul ā€˜Ursy di Kecamatan Ujung Bulu Kabupaten Bulukumba? Adapun hasil penelitian ini menunjukkan bahwa pelaksanaan walimatul ā€˜ursy tetap dilaksanakan. Namun, tetap mengikuti protokol Kesehatan sesuai dengan anjuran pemerintah. Berdasarkan Surat Edaran Kementrian Agama RI Nomor: P002/DJ.III/Hk.00.7/03/2020 tentang imbauan pelaksanaan protokol Kesehatan Covid-19 pada area publik di lingkungan Direktorat Jenderal Bimbingan masyarakat Islam. Dalam pandangan Hukum Islam tentang pelaksanaan walimatul ā€˜ursy di tengah pandemi adalah sunnah, apabila walimah dianggap penting dan mendesak di masa pandemi dan terlebih dahulu di ukur kedaruratannya seperti apa. Bagi pihak yang di undang untuk menghadiri walimah di masa pandemi, apabila terdapat suatu hal yang buruk, para ulama sepakat bahwa tidak wajib hukumnya bagi orang yang di undang untuk menghadiri undangan tersebut. Implikasi Penelitian ini adalah 1) Seharusnya Pemerintah lebih menegaskan terkait surat edaran yang diterbitkan oleh Kementrian Agama agar dapat lebih memperhatikan ketentuan-ketentuan yang lebih spesifik dan bukan hanya di tujukan pada nasional saja melainkan ditujukan juga pada regional (wilayah) di karenakan perkembangan virus masing-masing di wilayah itu berbeda. 2) bagi masyarakat yang ingin melaksanakan pernikahan atau walimah hendaknya bersabar untuk menunda pelaksanaannya sementara waktu hingga batas waktu yang belum ditentukan.Kata Kunci: Hukum Islam, Pelaksanaan, Walimatul ā€˜ursy.AbstractThe main problem of this research is the implementation of walimatul 'ursy in the midst of the covid-19 pandemic in the perspective of Islamic law in the Ujung Bulu sub-district, Bulukumba Regency. The main problem consists of two sub-problems, namely: 1) How is the implementation of Walimatul 'Ursy in the midst of the Covid-19 Pandemic in Ujung Bulu District, Bulukumba Regency? 2)What is the Islamic Law Perspective regarding the Implementation of Walimatul 'Ursy in Ujung Bulu District, Bulukumba Regency? The results of this study indicate that the implementation of walimatul 'ursy is still carried out. However, continue to follow the health protocol in accordance with government recommendations. Based on the circular letter of the Ministry of Religion of the Republic of Indonesia Number: P002/DJ.III/Hk.00.7/03/2020 regarding the appeal for the implementation of the Covid-19 Health protocol in public areas within the Directorate General of Islamic Community Guidance. In the view of Islamic law, the implementation of walimatul 'ursy in the midst of a pandemic is sunnah, if walimah is considered important and urgent during a pandemic and first, what kind of emergency is measured. For those who are invited to attend the walimah during the pandemic, if there is something bad, the scholars agree that it is not obligatory for the person invited to attend the invitation. The implications of this research are 1) The government should emphasize more regarding the circular issued by the Ministry of Religion so that it can pay more attention to the provisions that are more specific and not only aimed at the national but also at the regional (regional) due to the development of the virus in each country. each in the region is different. 2) for people who want to carry out marriages or walimah, they should be patient to delay the implementation temporarily until an undetermined time limit.Keywords: Implementation, Islamic Law, Walimatul ā€˜Ursy

    The Effectiveness of Mask Required Regulations for Congregants at Jami Mosque In Gowa District Perspective Saddu Zari'ah

    This study raises the issue of how effective the Regional Regulations are Obligatory to Wear Markers for the Jami Mosque Congregation in Gowa Regency Saddu Zari'ah's Perspective. From this main problem, it is limited to sub-problems, namely how the effectiveness of the local regulation on the obligation to wear masks for jami mosque congregations in Gowa Regency, as well as how saddu zari'ah's perspective on the mandatory wearing of masks. This study aims to find out the effectiveness of the local regulation on the mandatory wearing of masks for jami mosque congregations in Gowa Regency, and to find out the saddu zari'ah perspective on the mandatory wearing of masks. This descriptive-qualitative field research uses a juridical-syar'iy approach, by collecting data through questionnaires and in-depth interviews for religious leaders, administrators and jami mosque congregations, the data is processed, analyzed to produce conclusions. The results of this study indicate that the local regulations that require wearing masks are effective for jami mosque congregations in Gowa Regency. As many as 74.4% of jami mosque congregations in Gowa Regency always wear masks outside the home, including at the mosque.     This study examines the practice of the Pilkada (Regional election) that took place in East Kalimantan in 2005. The aim is to obtain an overview of the extent to which the democratic process meets the quality standards desired by law and society at large. Based on the findings of the research, the quality standard is not met optimally due to the emergence of several fraudulent practices, one of which is in the form of transactional politics. Transactional politics or what in an Islamic perspective is called risywah (bribery) are strongly prohibited in legislation and haram in Islamic law.      Islamic constitution context recognizes three agencies of state power, namely: the executive power (sulthah tanfiziyah), the legislative power (sulthah tasyri `iyah), and the judicial power (sulthah qadha` iyah). During the Rasulullah periods, all three agencies concetrated on one region of power; but during the Khalifah Umar Bin Khattab, the judicial power begin separate caused the Islamic region extends out Arabiah peninsula. Furthermore during the Umar bin Abdul Aziz regime, judicial power especially al-hisbah and al-mazalim can really be enforced in accordance with good public sense of justice. It happened because the law enforcement wer implemented without any selective with each other. Therefore, if the two kind of agencies can also be applied in Indonesia, besides the existing judicial institutions under the Supreme Court that the General Court, the Religious Courts, Military Justice, and State Administrative Court, then the problem of law enforcement and justice can be resolved according to expectations of society.Konteks ketatanegaraan Islam mengenal tiga badan kekuasaan negara, yaitu kekuasaan eksekutif (sulthah tanfiziyah), kekuasaan legislatif (sulthah tasyri`iyah), dan kekuasaan kehakiman (sulthah qadha`iyah). Pada masa Rasullah ketiganya menyatu pada satu wilayah kekuasaan, namun pada masa Khalifah Umar bin Khattab, kekuasaan kehakiman mulai terpisah disebabkan wilayah Islam telah meluas keluar semenanjung Arabiah. Selanjutnya pada masa Umar bin Abdul Azis, kekuasaan kehakimanĆ¢ā‚¬ā€terutama wilayah al-hisbah dan al-mazalim betul-betul dapat ditegakkan dengan baik sesuai rasa keadilan masyarakat. Hal itu terjadi karena penegakan hukum dilakukan tanpa ada tebang pilih antara satu dengan lainnya. Jika dua wilayah dapat pula diterapkan di Indonesia, selain lembaga peradilan yang telah ada di bawah Mahkamah Agung, yaitu Peradilan Umum, Peradilan Agama, Peradilan Militer, dan Peradilan Tata Usaha Negara, maka carut marut penegakan hukum dan keadilan dapat teratasi sesuai harapan masyarakat

    Overview Divorce cases at the Barru Religious Court have increased significantly from year to year, increasing by around 20% each year, the majority being filed by the wife. the factor that causes the majority is the existence of continuous disputes and quarrels followed by reasons to leave one of the parties, while the other reasons are only a small part. Efforts to prevent divorce by judges at the Barru Religious Court in the form of mediation have been in line with the provisions of Perma No. 1 of 2016 concerning Mediation, at each stage of mediation various efforts have been carried out, including: at the Pre-Mediation stage, Advisory was carried out by the Panel of Judges Examining the Case, at the Mediation stage, efforts were made in the form of: a. Creating a comfortable and conducive atmosphere, sometimes accompanied by jokes, b. Actively listen to the problems expressed by each party, c. Responding and clarifying the intentions of the parties and bridging the differences between the two, d. Conducting Caucus, e. Show appreciation, and at the Final stage of Mediation, the Panel of Judges gives advice again at each trial. Efforts to prevent divorce by judges at the Barru Religious Court in the form of implementing mediation in the perspective of Islamic law have also been in line with the concepts of Islah and Hakam, and are also in accordance with the Maqasid Syariah principle, namely hifdz al-nasl (keeping offspring)
