    SOBRE A COMPARATIVE LEGAL HISTORY E ARREDORES*  ABOUT COMPARATIVE LEGAL HISTORY AND ITS SURROUNDINGS  Luigi Lacchè** RESUMO: O presente artigo tem por objetivo propor que a história do direito comparada seja uma frente de trabalho inerente ao historiador do direito em um contexto de “globalização jurídica”. O autor demonstra que, há tempos, a historiografia jurídica tem a comparação na sua essência. Esta é, junto com o direito comparado, um campo de estudos muito apto a propor chaves de leitura em um contexto como o atual. Para tanto, o historiador do direito deverá “atualizar” o seu aparato, de modo a empregar de maneira problemática o conceito de cultura jurídica, repensar categorias como transplants e similares e superar o eurocentrismo. PALAVRAS-CHAVE: História do Direito. Historiografia. ABSTRACT: The article aims to propose comparative legal history as a workshop inherent to the legal historian in a context of "legal globalization". The author shows that legal historiography has been essentially comparative. Legal history is, along with comparative law, a field of study very capable to propose reading keys in the contemporary context. In order to do so, the legal historian must "update" his apparatus, employing in a problematic way the concept of legal culture, rethinking categories such as transplants and analogous ones and overcoming Eurocentrism. KEYWORDS: Legal History.     L’Europe et la révolution du droit : brèves réflexions

    La Révolution – en tant que révolution du droit – doit être envisagée à l’échelle européenne. Cela permet de lire les deux phénomènes, révolutionnaire et juridique, entre universalisme et uniformité, entre le paradigme religieux et la « patrie intellectuelle commune » envisagés par Tocqueville, entre l’« esprit de conquête  » et le principe d’uniformité regardés par Constant. La conquête française et la diffusion des institutions de la Révolution et du droit révolutionnaire – notion bien controversée – montrent les tensions inévitables entre la construction, en phases, modes et moments différents, d’un grand dessein impérialiste que l’on ne peut séparer de la « patrie commune » et la dimension unitaire et uniformatrice qui est pourtant une partie fondamentale de la révolution du droit. L’étude du droit révolutionnaire en Europe ne peut donc pas consister dans la simple recherche du « droit français en Europe ». Le regard européen, au contraire, aide à relativiser – en passant par les mythologies, les paradoxes et les traditions – la tendance à construire les concepts seulement en fonction des dynamiques qui peuvent se rapporter de manière plus immédiate à l’hexagone français.Europe and the Legal Revolution: Brief Reflections. The Revolution – intended as law Revolution – must be considered within its European scale. That allows us to consider these two phenomena, the revolutionary and the juridical ones, between universalism and uniformity, between the religious paradigm and the «patrie intellectuelle commune» which Tocqueville talks about, between the «esprit de conquête» and the principle of uniformity highlighted by Constant. The French conquest and the spreading of the revolutionnary institutions and of revolutionary law – a concept in its turn debated – show the unavoidable tensions between the construction, in different phases, ways and times, of a great imperialist plan which cannot be separated from the «patrie commune» and that unitary and conforming dimension which is also fundamental part of law Revolution. The study of revolutionary law in Europe cannot therefore consist in the mere search for «French law in Europe». The European viewpoint, on the contrary, helps us to consider – by way of consolidated mythologies, paradoxes and traditions – the tendency to build concepts solely dependent upon the dynamics that are more immediately ascribable to the French hexagon in a relative way

    Treacher Collins syndrome (TCS) is a rare genetic disor- der characterized by distinctive abnormalities of the head and face, affecting about one child in every 50000. Ab- normalities such micrognathia, cleft palate and cervical spine alterations are common and may represent an addi- tional risk in airway management for general anesthesia. As a matter of fact, difficult OTI prevalence in paediatric surgery rises from 1-2% to 50% when considering the subpopulation of paediatric patients with cervical spine diseases, as TCS ones. This article describes a case report of our anesthesiological management in bone-anchored hearing aid (BAHA) implant surgery in a 7-year-old fe- male Treacher Collins Syndrome patient born without the long process of the incus, the stapes and with hypoplasia of the oval window bilaterally. A careful preoperative evaluation and anesthesiological plan based on the use of videolaryngoscopy, routine practice in our centre, granted a successful outcome and no complications

    This chapter deals with the difficult process of constitutionalisation which characterised Italian Unification. Constitutionalisation is a long-term phenomenon which had the purpose of giving constitutional forms to the Nation. The promulgation of the Albertine Statute is more the start than the arrival of this phenomenon. The focus of this investigation is, therefore, to study the Constitution through its evolution paying particular attention to the process of legal integration within the structures of the Albertine Statute and to the amendment mechanisms of the constitutional text. The preamble of the Albertine Statute speaks of «perpetual and irrevocable fundamental law». The word «perpetual» meant the prohibition of revoking constitutional concession, while the word «irrevocable» was intended as a pact between the Sovereign and the Nation. Over the years, very few were the changes to the letter of the Albertine Statute. The interpretation and the practice represented the most important mechanisms of constitutional change (implicit constitutional changes). A primary role was acknowledged to non-written norms. In this perspective, it may well be said that the Italian Constitution consisted in something more than the written text and dwelt in the spirit and not in the letter of the Albertine Statute
