La Participación Pública Activa y Real en la Política del Agua: Necesidad y Deber

La sostenibilidad es uno de los principales objetivos de la Unión Europea. Ésta sólo puede alcanzarse si modifican los hábitos de consumo y, por tanto, los valores, las percepciones y las opiniones de la sociedad. Para ello es imprescindible que se cambien también las formas de gobernar. La participación pública, elemento central de la gobernanza, pretende que quien ostenta el poder mantenga un diálogo real y efectivo con la sociedad en la toma de decisiones. La política de aguas es un ámbito pionero de la Unión Europea en la participación pública a través de la Directiva Marco del Agua, encuadrada en un conjunto de normas sobre información, participación pública y acceso a la justicia en materia de medio ambiente. El presente texto elabora una aproximación a estos instrumentos enlazando su explicación con reflexiones sobre los procesos de planificación hidrológica en curso.Sustainability is one of the main objectives of the European Union. It can only be achieved if consumption habits are modified and, therefore, certain values, perceptions and opinions that characterize our society. It is also indispensable a change in the forms of governance. Public participation, as a central element of governance, seeks that those who hold power maintain a real and effective dialogue with the society in any decisiontaking process. Within the European Union, the Water Policy is a pioneering field as regards public participation through The Water Framework Directive, framed in a set of regulations concerning information, to public participation and access to justice on environmental matters. The text elaborates an approach to these instruments connecting its content with reflection on the current hydrological planning process

Deployment of Solar Energy at the Expense of Conservation Sensitive Areas Precludes Its Classification as an Environmentally Sustainable Activity

Solar energy (SE) is essential for the decarbonization of our economy and for energetic transition. Solar energy can be a sustainable economic activity, as long as a balance is struck between the benefits it brings to climate change mitigation and the damage it can cause to biodiversity and ecosystems. Here, we study this balance in an area with high biodiversity under pressure for installation of numerous photovoltaic plants (PPs). Our results show that developers give priority to the cheapest land close to connection points, while other values (e.g., environmental, landscape) are secondary. The regulatory process carried out by the Administration does not ensure the preservation of natural values, as several PPs with a high impact on important conservation areas have been approved. Experts’ allegations provide quality information to the Administration to evaluate and demand changes to the projects presented. Such demands show that companies are willing to relocate plants to land occupied by olive groves. In this way, greater efficiency is achieved in land occupation, as well as shorter evacuation lines, water savings and a smaller environmental impact. Prior strategic territorial planning could have avoided the impact of PPs already built, made the deployment of new PPs compatible with biodiversity conservation, and contributed to improving the management of key resources, such as subway aquifers. The proposed regulatory changes to the environmental assessment procedure (exclusion of renewables and public participation from the procedure) are detrimental, as they will make SE unable to meet the requirements of the Taxonomy Regulation

La participació social en la Directiva Marc d'Aigües

La participació pública en matèria de medi ambient està protagonitzant una important evolució en la Unió Europea amb motiu del Conveni d’Aarhus de 1998. El primer pas significatiu és l’adaptació de la Directiva 2000/60/CE que comprèn l’obligació per als Estats membres de promoure una participació activa en la política d’aigües, a més d’exigir-ne concretes garanties en el procés de planificació hidrològica.Public involvement in environmental issues has experienced a significant evolution in the European Union since the Aarhus Convention 1998. The first major step is the adaptation of the Directive 2000/60/EC, which implies the dutyfor Member States to promote an active involvement in water policies, as well as the establishment to do so of precise measures to guarantee the water planning process.La participación pública en materia de medio ambiente está protagonizando una importante evolución en la Unión Europea con motivo del Convenio de Aarhus de 1998. El primer paso significativo es la adaptación de la Directiva 2000/60/CE que comprende la obligación para los Estados miembros de promover una participación activa en la política de aguas, además de exigir concretas garantías para ello en el proceso de planificación hidrológica
