Produkcja energii termicznej z biomasy we Francji – wybrane aspekty prawne
The paper discusses French support mechanisms for the production of thermal energy
from biomass in view of legal regulations and plans contained the national plan for action,
presented to the European Commission by the Ministry of Ecology, Energy, Sustainable
Development and Sea. In particular, analyses were presented concerning the Acts adopted
in 2009 and 2010 as a result of a strategic agreement on sustainable development and
environmental protection, i.e. Grenelle Environnement.
In France, producers of thermal energy from biomass may use e.g. the Thermal energy
Funds, i.e. financial mechanisms promoting the most efficient installations in this
branch of power engineering industry. Changes in law executed in recent years also facilitate
the monitoring of the amount of energy generated from renewable energy sources,
thanks to the new requirement to install measuring and clearing devices at every service
line connected to the heat distribution network. Recently installations for heat production
from biomass may also be granted the status of installations qualified for environmental
protection.
Support mechanisms for the production of thermal energy from biomass, presented in
the paper, were evaluated positively and seem to be an effective instrument, aiming at an
increase in the proportion of thermal energy from sustainable energy sources in the final
gross energy consumption in France in the following years.L’articolo tratta dei meccanismi francesi per il sostegno all’energia termica da biomasse
alla luce delle regolazioni giuridiche e dei piani contenuti nel programma operativo
nazionale presentato alla Commissione Europea dal Ministero dell’ecologia, energia,
sviluppo sostenibile e del mare. In particolare sono sottoposte ad analisi le leggi adottate
durante il 2009 e il 2010, a seguito dell’accordo strategico nell’ambito dello sviluppo
sostenibile e della tutela dell’ambiente – Grenelle Environnement.
In Francia i produttori di energia termica da biomasse possono usufruire, tra l’altro, dei
c.d. Fondi Termici, ovvero di meccanismi per il finanziamento di maggiori impianti a biogas.
Le modifiche legislative realizzatesi negli ultimi anni facilitano anche il controllo della
quantità dell’energia derivante dalle fonti energetiche rinnovabili grazie al nuovo obbligo
di inserire strumenti di misura e calcolo per ogni connessione alle reti di riscaldamento. Gli
impianti di riscaldamento a biomassa possono di recente conseguire lo status di „impianti
per la tutela dell’ambiente”.
I meccanismi presentati per il sostegno alla produzione di energia termica da biomasse
sono stati valutati positivamente e sembrano essere strumenti efficaci per l’aumento
della quota di energia termica che, nel consumo energetico finale lordo della Francia,
si potrà ottenere, nei prossimi anni, da fonti energetiche rinnovabili

The aim of this discussion is to determine whether and to what degree the legal regulations
concerning the production and utilization of agricultural biogas affect the development
of this branch of renewable sources of energy.
In conclusion the author states among other things that regulations on agricultural
biogas production and utilisation, binding to date, are insufficient to strengthen this branch
of economy, there are no regulations referring directly to the construction conditions and
principles of operation for agricultural biogas plants. Inconclusiveness of law does not
promote future investments and reduces profitability of already existing installations. The
situation is going to improve after the Act on the amendment to the Act on Energy Law,
enacted on 8 January 2010, enters into force, realising the main proposals formulated in
the strategic document “Innovative Economy – Energy agriculture”. However, it seems
unlikely to have a biogas plant in every commune by the year 2020, as it is planned. This
ambitious plan requires legislative measures being an effect of a comprehensive approach
to regulations concerning agriculture, the environment and the energy sector.L’autrice si propone l’obiettivo di rispondere alla domanda se, e in quale misura, la
regolazione giuridica della produzione e dell’utilizzo del biogas agricolo incida sullo
sviluppo di tale settore delle fonti energetiche rinnovabili.
Nelle conclusioni si constata che le previsioni finora esistenti sono insufficienti per
rinforzare l’economia del settore in questione. Manca una diretta disciplina delle
condizioni di costruzione e dei principi del funzionamento degli impianti di biogas
agricolo. Inoltre, l’equivocità della legge non favorisce gli investimenti futuri e abbassa la
rendita degli impianti già esistenti.
La situazione migliorerà dopo l’entrata in vigore della legge approvata l’8 gennaio
2010 di modifica della legge “Diritto energetico”, volta a realizzare i principali auspici
formulati nel documento strategico „L’economia Innovativa – L’agricoltura energetica”.
È tuttavia incerto se si riuscirà di costruire, come si intende, un impianto di biogas in ogni
comune entro il 2020, poiché questo piano ambizioso richiede soluzioni legislative che
siano il risultato di un approccio integrato delle normative agricole, ambientali ed
energetiche
Klimatyczne wyzwania Wspólnej Polityki Rolnej po 2013 r.
Climate change constitutes one of the most important challenges to CAP, thus we need to consider in what manner and scope climate change will be included in legal regulations concerning particularly agricultural markets and rural development. The author considers relationships between the agricultural sector and climate change and next characterises in more detail two directions for action, i.e. in terms of climate protection and actions in the adaptation of agriculture to climate change. Realisation of climatic challenges to CAP after 2013 is presented in view of factors determining the future form of this policy.
In conclusion the author states among other things that CAP, being one of the most sensitive sector policies of the European Union, obtains additional legitimisation thanks to the incorporation of climatic challenge, which is common not only for the EU member countries, but all countries worldwide.I cambiamenti climatici sono una delle sfide principali della PAC, per cui vale la pena di soffermarsi su come e in quale misura essi saranno presi in considerazione nelle regolazioni giuridiche riguardanti soprattutto i mercati agricoli e lo sviluppo rurale. L’Autrice considera i rapporti che intercorrono tra il settore agricolo e i cambiamenti climatici, quindi caratterizza più da vicino due linee di misure, ossia le misure per la protezione del clima e quelle per l’adattamento dell’agricoltura ai cambiamenti climatici. La realizzazione delle sfide climatiche della PAC dopo il 2013 viene presentata sullo sfondo dei fattori determinanti il futuro assetto di questa politica.
In conclusione, l’Autrice afferma, tra l’altro, che la PAC, essendo una delle politiche settoriali più sensibili dell’Unione Europea, riceverà una legittimazione supplementare in virtù delle sfide climatiche comuni non solo agli Stati membri, ma a tutti i Paesi del mondo

Legal status of selected types of agricultural biomass – some remarks in light of the new legislation
S u m m a r y
The purpose of this paper is to clarify certain issues related to the legal status of individual types of agricultural biomass. The analysis of the subject in question allows to conclude that exclusion of safe agricultural biomass from the rigid regime that governs wastemanagement simplifies the procedures regarding handling substances suitable for bioenergy production. A certain drawback of the current regulation is the lack of an unambiguously definition of the type of installations in which so exempted agricultural biomass may be used. Although the new law on waste management clarifies certain issues connected with the methods of agricultural biomass recovery, there remain concerns that postfermentation pulp has been given a ‘waste’ status. Instead of determining the ways in which the pulp may be processed to be subsequently utilized as a fertiliser, the Polish legislator chose to regulate this issue by placing it under regulations adopted for waste management. This means that an agricultural biogas producer may not, in principle, release post-fermentation pulp to entities which are not holders of waste recovery licenses.Lo status giuridico dei tipi di biomasse agricole scelti – alcune osservazioni alla luce della nuova legislazione

Lo scopo delle considerazioni è quello di chiarire alcune questioni legate alla determinazione dello status giuridico dei vari tipi di biomasse agricole. L’analisi svolta permette di far notare che l’esclusione di biomassa agricola, le cui risorse sono considerate sicure, dal rigido regime di gestione dei rifiuti, costituisce una semplificazione delle procedure di gestione di sostanze adatte alla produzione di bioenergia. Una certa manchevolezza è costituita dall’ambiguità nel determinare i tipi di impianti nei quali può essere utilizzata la biomassa agricola beneficiante della suddetta esclusione. Grazie alla nuova legge sui rifiuti sono state chiarite anche alcune questioni legate ai metodi di recupero della biomasa agricola. Numerosi dubbi vengono tuttavia sollevati dall’assegnazione dello status di rifiuto alla polpa post-fermentazione. Invece di stabilire le regole di trattamento Della polpa post-fermentazione al fine di “recuperarla” per il suo utilizzo come fertilizzante, il legislatore polacco si è limitato alla regolazione di queste questioni ricorrendo alle norme dell’ambito della gestione dei rifiuti. Ciò significa che il produttore di biogas agricolo, secondo la regola, non può passare la polpa post-fermentazione ai soggetti non autorizzati al recupero dei rifiuti

Pozyskiwanie i energetyczne zagospodarowanie biomasy rolniczej a zrównoważony rozwój w świetle prawa Unii Europejskiej
The growing demand for biomass for energy purposes within the EU member states
may cause multiple effects of different nature (social, environmental, economic) and scope
(local, regional and global). In the paper, an attempt is made to answer the question on how the EU legislation ensures sustainable production and use of agricultural biomass for
energy purposes. The first part of the paper provides an outline of the sustainability criteria
for biofuels and bioliquids. The second part describes the EU environmental and rural
legislation. The Common Agricultural Policy is considered a relatively efficient tool
securing sustainable production of biomass within the EU territory. The third part is
dedicated to the sustainability criteria certification schemes, with a special focus on the
German certification mechanisms. It has been pointed out that there is still a pending need
to include solid and gaseous biomass into the binding sustainability schemes, and to widen
their scope, especially by integrating the important social and economic issues with regard
to biomass originating from the third countries. The paper ends with a conclusion that the
current EU legislation is not sufficient to ensure a sustainable production of energy
production from agricultural biomass.L’aumento della domanda di biomassa utilizzata per la produzione di energia negli
Stati membri dell’Unione europea potrebbe portare a conseguenze negative di carattere
sociale, ambientale ed economico su scala globale. L’autrice cerca di rispondere alla
domanda in che misura le regolazioni giuridiche dell’Unione europea in vigore garantisce
lo sfruttamento energetico della biomassa agricola in linea con lo sviluppo sostenibile.
Nella prima parte dell’articolo viene sollevata la questione dei criteri di sviluppo
sostenibile per i biocarburanti e i bioliquidi. La seconda parte delle considerazioni si
riferisce alle norme agro-ambientali in vigore nel quadro della politica agricola comune. In
seguito si discutono i sistemi di attestazione della conformità con i criteri di sviluppo
sostenibile sull’esempio dell’Unione europea e della Germania. L’autrice fa notare che le
prescrizioni vincolanti per la biomassa solida e gassosa continuano a mancare, e che anche
i criteri di sviluppo sostenibile in vigore per i biocarburanti e i bioliquidi non tengono
conto degli importanti problemi socioeconomici presenti nei paesi terzi in relazione ad una
domanda crescente di biomassa nell’Ue. Perciò, le regolazioni europee in vigore sulla
qualità di biomassa in vigore, specie in riferimento alla sua origine, non possono essere
ritenute soddisfacenti
IL SOSTEGNO ALLA PRODUZIONE DI BIOENERGIA NELLE ZONE RURALI DELL’UE ALLA LUCE DELLE PROPOSTE LEGISLATIVE RELATIVE ALLA POLITICA AGRICOLA COMUNE DOPO IL 2013
In October 2011 the European Commission presented a set of legal proposals for the
CAP after 2013. The purpose of this paper is to evaluate the influence of the proposed
legislation on the support mechanisms for the production and use of energy from agricultural
and forestry biomass. However, these practices will not increase the volume of biomass
supply for energy purposes within the EU. The bioenergy sector is to be supported to a greater extent by means of the rural development policy measures, especially with regard
to the supply and use of biomass in the form of byproducts, wastes, residues and other
non-food raw material. The preliminary analysis of the legislative proposals on CAP after
2013 shows that they are not able to provide for any precise support mechanisms for sustainable
supply and use of agricultural and forestry biomass for energy production purposes.Nel mese di ottobre del 2011 la Commissione europea ha pubblicato i progetti delle
regolazioni giuridiche sulle quali si fonderà la PAC dopo il 2013. Lo scopo delle considerazioni
è di dare la risposta alla domanda se e in quale misura le proposte della Commissione
prendono in considerazione le esigenze del settore dell’energia prodotta da biomasse
di origine agricola e forestale.
La produzione e l’uso di bioenergia saranno senza dubbio una componente importante
dello sviluppo rurale, ma si tratterà soprattutto dell’energia proveniente dai residui e dai
sottoprodotti dell’agricoltura e della selvicoltura. La Commissione europea condiziona la
realizzazione di molti degli obiettivi fissati per la PAC all’implemetazione delle direttive
UE nei sistemi giuridici nazionali già in vigore. L’analisi preliminare dei progetti legislativi
permette di far notare che esse non prevedono l’istituzione di precisi strumenti per il
supporto alla produzione e all’utilizzo della biomassa di origine agricola o forestale ottenuta
in maniera sostenibile a scopi energetici
