A középkori kánonjogi gyüjtemények és az európai ius commune = The Medieval Canon Law Collections and the European ius commune
A közĂ©pkori kánonjogi kĂłdexek magyarországi használata terĂ©n vĂ©gzett kĂłdextöredĂ©k vizsgálatunknak köszönhetĹ‘en növekedett a Decretum Gratiani elĹ‘tti kánonjogi könyvhasználat tárgyi emlĂ©keinek ismert száma. Ugyanez a vizsgálat világosabb kĂ©pet rajzolt a 12-13. század fordulĂłjának hazai kánonjogi tudományosságárĂłl, mely alapján a kor magas tudományos szintű kánonjogi műveinek az eddig feltĂ©telezettnĂ©l valamivel erĹ‘teljesebb haza használata valĂłszĂnűsĂthetĹ‘. A pre-Gratianus gyűjtemĂ©nyek Ă©s szövegtanĂşik elemzĂ©se: pontosĂtotta a Dictatus Papae összeállĂtásához használt forrásokat; feltárta a Decretales Pseuodo-Isidorianae-ban megjelenĹ‘ prĂmási kompetencia feltehetĹ‘ forrását; feltárta Ă©s osztályozta a 8-12. századi kánonjogi gyűjtemĂ©nyek összeállĂtásának Ă©s a szövegfejlĹ‘dĂ©sĂ©nek indokait, kĂĽlönösen a Collectio Anselmi Lucensis-re Ă©s Chartres-i Ivo-i szövegcsaládokra vonatkozĂłan SikerĂĽlt megerĹ‘sĂteni az Sg. Ms. 673 kĂ©ziratot, mint jelenleg ismert legrĂ©gibb Decretum Gratiani verziĂłt, ami nem jelenti azt, hogy autográf forma lenne. Az esztergomi szĂ©kesegyházi kanonokok 14-15. sz-i műveltsĂ©gĂ©nek vizsgálata rávilágĂtott arra, hogy az teljese eurĂłpai szinten állt. A kánonjogi gyökerekre visszamenĹ‘ jogi szemĂ©ly jellegzetessĂ©geinek feltárása nemzetközi szinten járul hozzá az EurĂłpai UniĂł Ăşj egysĂ©ges jogi koncepciĂłjának kialakĂtásához. EgyedĂĽlállĂł alapkutatást Ă©rt el a közĂ©pkori konkordatárius jogi források hatásának vizsgálata az Ăşjabb Ă©s legĂşjabb kor nemzetközi jogára. | The identified pre-Gratian fragmented canon law exemplars of the Medieval Hungary have become more numerous based on our research. We were able to describe more clear overview on the level of the Hungarian canonical knowledge of the 12th-13th centuries, which has testified higher standard than was estimated before. Our analysis has given more detailed to the formal sources of the Dictatus Papae. We were able to reveal the very probable source of the primate?s competence which appears in the Decretales Pseuodo-Isidorianae. We could reconstruct and classify the motive and goal of the composition and textual development of the 8th-12th centuries canonical collections, especially regarding to the Collectio Anselmi Lucensis and the textual-families of Ivo of Chartres. Our research supported that the presently known earliest textual version of the Decretum Gratiani is found in Sg. Ms. 673, but even this version is not Gratian's autograph. The analysis of the book-learned studies of the Cathedral Chapter of Esztergom (14th-15th centuries) has testified a high European standard. We revealed the jurisprudential peculiarities of the juridical person which has canonical roots. This result is a great contribution to a new and general concept by the European Union. We have done an international recognized unique fundamental research on the medieval sources of the concordatary law and their effect on the international law of the Modern Age
