    This Article reviews recent Supreme Court decisions to identify instances in which justices have directly targeted and criticized opposing opinions of other justices by name. Smith notes there was a dramatic increase in average persona referenced to other justices per opinion during the Rehnquist and Roberts Courts, with many justices referring to fellow justices by name when they are ideological opposites and rarely if when the target justice is a swing vote in a decision. Smith concludes that frayed relationships on the bench may continue if justices feel free to personally reference other justices of opposing ideological beliefs and the Court continues its ideological polarization

    An apparatus, system, and method for non-destructible evaluation (NDE) of a material use thermography to rapidly detect and/or generally locate a feature such as, for example, damage or a defect in the material. The apparatus, system, and method also use ultrasound to specifically locate the feature in the material for quantification and/or evaluation either by an operator or by an external device suited for such purpose. Accordingly, the apparatus, system and method are particularly useful for NDE in applications such as the analysis of the structure of an aircraft, for example, in which the scale of the material to be analyzed is large, thus requiring the rapid NDE afforded by thermography, and in which quantification and/or evaluation of a feature must be performed with precision, thus requiring the relatively high-resolution NDE afforded by ultrasound

    This report summarizes (I) annual purse seine landings of Atlantic menhaden, Brevoortia tyrannus, for 1972-84, (2) estimated numbers of fish caught by fishing area. (3) estimates of nominal fishing effort and catch-per-unit-effort, (4) mean fish length and weight, and (5) major changes in the fishery. During the 1970s stock size and recruitment increased and the age composition broadened. reversing trends witnessed during the fishery's decline in the 1960s. Landings steadily improved and by 1980 the total coast wide landings exceeded 400,000 metric tons. Nevertheless, the character of the fishery changed considerably. Eleven reduction plants processed fish at seven ports in 1972, but in 1984 only eight plants operated at live ports. Beginning in the mid-1960s the center of fishing aclivity shifted from the Middle Atlantic area to the Chesapeake Bay area, which has continued to dominate the fishery in landings and effort through the 1970s and 1980s. During this period the average size and age of fish in the catches declined. (PDF file contains 30 pages.

    The beef industry’s share of domestic meat demand continues to decline, as increasing vertical coordination in pork and poultry contribute to these industries’ ability to offer convenient, consistent, and less expensive products. For such vertical coordination to be effective, incentives must be properly aligned so that those responsible for making the most important investments for system profitability are appropriately compensated.     Aircraft System Analysis of Technology Benefits to Civil Transport Rotorcraft

    An aircraft systems analysis was conducted to evaluate the net benefits of advanced technologies on two conceptual civil transport rotorcraft, to quantify the potential of future civil rotorcraft to become operationally viable and economically competitive, with the ultimate goal of alleviating congestion in our airways, runways and terminals. These questions are three of many that must be resolved for the successful introduction of civil transport rotorcraft: 1) Can civil transport rotorcraft actually relieve current airport congestion and improve overall air traffic and passenger throughput at busy hub airports? What is that operational scenario? 2) Can advanced technology make future civil rotorcraft economically competitive in scheduled passenger transport? What are those enabling technologies? 3) What level of investment is necessary to mature the key enabling technologies? This study addresses the first two questions, and several others, by applying a systems analysis approach to a broad spectrum of potential advanced technologies at a conceptual level of design. The method was to identify those advanced technologies that showed the most promise and to quantify their benefits to the design, development, production, and operation of future civil rotorcraft. Adjustments are made to sizing data by subject matter experts to reflect the introduction of new technologies that offer improved performance, reduced weight, reduced maintenance, or reduced cost. This study used projected benefits from new, advanced technologies, generally based on research results, analysis, or small-scale test data. The technologies are identified, categorized and quantified in the report. The net benefit of selected advanced technologies is quantified for two civil transport rotorcraft concepts, a Single Main Rotor Compound (SMRC) helicopter designed for 250 ktas cruise airspeed and a Civil Tilt Rotor (CTR) designed for 350 ktas cruise airspeed. A baseline design of each concept was sized for a representative civil passenger transport mission, using current technology. Individual advanced technologies are quantified and applied to resize the aircraft, thereby quantifying the net benefit of that technology to the rotorcraft. Estimates of development cost, production cost and operating and support costs are made with a commercial cost estimating program, calibrated to Boeing products with adjustments for future civil production processes. A cost metric of cash direct operating cost per available seat-mile (DOC ASM) is used to compare the cost benefit of the technologies. The same metric is used to compare results with turboprop operating costs. Reduced engine SFC was the most advantageous advanced technology for both rotorcraft concepts. Structural weight reduction was the second most beneficial technology, followed by advanced drive systems and then by technology for rotorcraft performance. Most of the technologies evaluated in this report should apply similarly to conventional helicopters. The implicit assumption is that resources will become available to mature the technologies for fullscale production aircraft. That assumption is certainly the weak link in any forecast of future possibilities. The analysis serves the purpose of identifying which technologies offer the most potential benefit, and thus the ones that should receive the highest priority for continued development.     Competing for Refugees: A Market-Based Solution to a Humanitarian Crisis

    The current refugee crisis demands novel legal solutions, and new ways of summoning the political will to implement them. As a matter of national incentives, the goal must be to design mechanisms that discourage countries of origin from creating refugees, and encourage host countries to welcome them. One way to achieve this would be to recognize that persecuted refugee groups have a financial claim against their countries of origin, and that this claim can be traded to host nations in exchange for acceptance. Modifications to the international apparatus would be necessary, but the basic legal elements of this proposal already exist. In short, international law can and should give refugees a legal asset, give host nations incentives to accept them, and give oppressive countries of origin the bill

    Kinematic Foot Types in Youth with Equinovarus Secondary to Hemiplegia

    Background Elevated kinematic variability of the foot and ankle segments exists during gait among individuals with equinovarus secondary to hemiplegic cerebral palsy (CP). Clinicians have previously addressed such variability by developing classification schemes to identify subgroups of individuals based on their kinematics. Objective To identify kinematic subgroups among youth with equinovarus secondary to CP using 3-dimensional multi-segment foot and ankle kinematics during locomotion as inputs for principal component analysis (PCA), and K-means cluster analysis. Methods In a single assessment session, multi-segment foot and ankle kinematics using the Milwaukee Foot Model (MFM) were collected in 24 children/adolescents with equinovarus and 20 typically developing children/adolescents. Results PCA was used as a data reduction technique on 40 variables. K-means cluster analysis was performed on the first six principal components (PCs) which accounted for 92% of the variance of the dataset. The PCs described the location and plane of involvement in the foot and ankle. Five distinct kinematic subgroups were identified using K-means clustering. Participants with equinovarus presented with variable involvement ranging from primary hindfoot or forefoot deviations to deformtiy that included both segments in multiple planes. Conclusion This study provides further evidence of the variability in foot characteristics associated with equinovarus secondary to hemiplegic CP. These findings would not have been detected using a single segment foot model. The identification of multiple kinematic subgroups with unique foot and ankle characteristics has the potential to improve treatment since similar patients within a subgroup are likely to benefit from the same intervention(s)
