How not to abuse the market

This contribution deals with market abuse as one of the most important regulation of the capital market. Market abuse has been and still is one of the biggest threats of the capital market, because activities like insider trading makes capital market not fair investing area. It’s basically information asymmetry all around and moral hazard for insiders, considering using inside information in their own benefit. The main aim of the contribution is to challenge the importance of market abuse regulation and supervision to maintain correct function of the capital market. The question how not to abuse the market could be answered only with good set of regulation and well maintained supervisionTento příspěvek pojednává o zneužívání trhu jako o jedné z nejdůležitějších regulací kapitálového trhu. Zneužívání trhu bylo a stále je jednou z největších hrozeb kapitálového trhu, protože aktivity jako obchodování zasvěcených osob způsobují, že kapitálový trh není spravedlivou investiční oblastí. Jde v podstatě o informační asymetrii všude kolem a morální nebezpečí pro zasvěcené osoby, zvažující použití důvěrných informací ve svůj vlastní prospěch. Hlavním cílem příspěvku je zpochybnit význam regulace zneužívání trhu a dohledu pro zachování správné funkce kapitálového trhu. Income tax based on real estate lease

This article deals with income tax, mainly in the Czech Republic related to lease income. The author tries to compare two kinds of contracts dealing with housing regarding personal income tax. There are some tax possibilities for taxpayers in relation to choosing which contract to use. One of the most important criteria in deciding which contract could be used are tax implications in the event that both kinds of contracts are in compliance with the law. Integration of financial Market supervision

This book analyses the integration of financial market supervision at the international level, particularly focusing on EU law and the actual processes taking place in this area (system). Currently legislative action at the EU level has a significant impact on legislation in the Czech Republic, with which this work is also of concerned together with where the integration of supervision takes place. This book seeks among other things to find the causes increasingly ongoing process of integration of financial market supervision and determine whether the direction in which the international integration is going, is the right way. The main objective of this book is to determine, whether the process of integration increases itself the efficiency of financial market supervision, while simultaneously reducing systemic risk to financial market stability. The research in this book also seeks to determine whether the functional of regulation of the financial market has been significantly integrated into the financial market supervision and has become to a certain extent preventive - primary supervision.Tato kniha zkoumá integraci dohledu nad finančním trhem v mezinárodním měřítku, zejména se zaměřením na právo EU a aktuální procesy odehrávající se v této oblasti. Právě legislativní dění na EU úrovni má zásadní vliv i na právní úpravu v České republice, o níž je v této práci také pojednáno a kde integrace dohledu probíhá taktéž. Tato kniha se snaží mimo jiné nalézt příčiny stále probíhajícího procesu integrace dohledu nad finančním trhem se snahou o zjištění, zda je směr, kterým se mezinárodní integrace ubírá, tím směrem správným. Hlavním cílem této knihy je zjištění, zda již samotným procesem integrace dochází ke zvýšení efektivity dohledu nad finančním trhem a současně snížení systémového rizika ohrožení stability finančního trhu. Airbnb as an Accommodation Platform and Tax Aspects

Airbnb has long been one of the leaders in providing accommodation worldwide, but there are still a few tax issues related to Airbnb without clear interpretation. The article aims to research, from the taxation point of view, the activity of providing temporary accommodation using the internet platform Airbnb. To evaluate such a taxation area, it is necessary to analyze the current legal regulation in the field of tax law with some possible legal recommendations de lege ferenda. For this article, the prime source of law is the Czech Republic tax law, but some of the research is also valid internationally, based on commonly used tax principles. The central point of the article, still relatively unclear in everyday practice, is the tax obligations (income tax and value-added tax) of accommodation providers using this platform. The article also includes some comparisons with foreign legislation. The author wants to point out possible facts that need to be considered when regulating Airbnb in the field of tax law

The EU Bank Resolution Framework: Institutional Changes of the Financial Safety Net in Poland and the Czech Republic

In response to the global financial crisis, fundamental changes have been made at the European level to the legal framework of single financial market regulation and supervision. One of the significant legal steps was the establishment of a common system of recovery and resolution of failing banks. Within the framework of a systemic approach to the EU financial market, the article illustrates the steps taken towards the implementation of the resolution framework into domestic financial markets of Poland and the Czech Republic.V reakci na globální finanční krizi došlo na evropské úrovni k zásadním změnám právního rámce regulace a dohledu nad jednotným finančním trhem. Jedním z významných právních kroků bylo vytvoření společného systému vymáhání a řešení bankrotujících bank. Lifetime Assessment of a Steam Pipeline

The aim of this paper is to design a method for assessing the life of steam pipes for Czech power plants. The most widely-used material in Czech power plants is steel 15 128. Our findings may also be applied for international equivalents of this steel. The paper shows the classification of cavitation damage and microstructure classification status, based on the German VGB Act, with references to EPRI law in the USA. Calculations of remaining life on the basis of Russian experience are also shown. The possibility of applying this method to increase the operating parameters for power plants is discussed

Development and characteristics of thermal metallic sprays to extend the life of the components of combustion plants, heating plants and energy units

V příštích deseti letech musí Česká republika provést zásadní změny v oblasti nakládání s odpady, dodávek tepla a výroby elektřiny. Emisní povolenky i očekávaná uhlíková daň, vyplývající z členství České republiky v EU nutí tlumení skládek a spalování hnědého uhlí. Značná část zařízení, která splňují zákonné limity nebo výjimky z nich, je na konci své technické životnosti. Prodloužení životnosti termálními nástřiky je ekonomicky výhodnou variantou. Příspěvek se zabývá vývojem optimálního složení nástřikového materiálu při použití osvědčené technologie vysokorychlostních nástřiků MetalSpray (HVTS), která zajišťuje ochranu spalovacích komor a povrchů pro výměnu tepla spaloven komunálního odpadu a tepláren. Cílem je snaha snížit náklady nástřikování, to vede k modifikaci chemického složení nástřikových povlaků snižováním obsahu drahých legur.TAČR TH04020487 „Vývoj a ověření sonického termálního metalického nástřiku k prodloužení životnosti komponent spaloven, tepláren a energetických celků za jejich plánovanou životnost“In the next ten years, the Czech Republic must make major changes in waste management, heat supply and electricity generation. Emission allowances as well as the expected carbon tax resulting from the Czech Republic's membership in the EU force the control of landfills and the burning of brown coal. Much of the equipment that meets the legal limits or exceptions is at the end of its technical life. Extending the lifetime of thermal spraying is an economically advan- tageous option. The paper deals with the development of optimal composition of the spraying material using the proven high-speed spraying technology MetalSpray (HVTS), which provides protection of combustion chambers and surfaces for heat exchange of municipal waste incineration plants and heating plants. The aim is to reduce the cost of spraying, which leads to modification of the chemical composition of the spray coatings by reducing the content of expensive alloys

Influence of short-term ageing and precipitation of laves phase on mechanical properties of P92 steel

Příspěvek se zabývá hodnocením vlivu krátkodobého laboratorního žíhání (650 °C, 100 až 20 000 hodin) martenzitické oceli P92 z hlediska probíhajících mikrostrukturních změn. V průběhu teplotní expozice dochází k postupnému procesu hrubnutí karbidických částic a precipitaci Lavesovy fáze, což má zásadní vliv na změnu mechanických vlastností dané oceli. Sledováním těchto změn probíhajících v mikrostruktuře oceli byly vytvořeny stereologické závislosti precipitujících částic, které lze korelovat s výslednými mechanickými vlastnostmi. V závěru je diskutována aplikovatelnost těchto korelací na usuzování stavu provozovaných komponent na blocích elektráren.The paper deals with the evaluation of the influence of short-term laboratory ageing (650 °C, 100 to 20 000 hours) of martensitic steel P92 in view of ongoing microstructural changes. During thermal exposure process, a coarsening of the carbide particles and precipitation of Laves phase has a significant effect on mechanical properties of the P92 steel. Based on these microstructural changes, stereological dependencies of Laves phase were created. These results are compared with the mechanical and creep properties

Enhancing the life of components of coal-fired power plants and waste incinerators using thermal metallic nicr sprays

Experimentální hodnocení kvality NiCr a NiCrMoW termálních metalických povlaků IGS 5-450 a 5-470 bylo provedeno na nově vytvořených povlacích bez provozního zatížení. Kvalitu byla hodnocena dle homogenity, tvrdosti a tloušťky vrstvy, třecí odolnosti a odolnosti při vnikací (indentační) a vrypové zkoušce. Dále dle mikrostrukturální a mikrochemické homogenity povlaku, schopnosti vytvoření kompaktních pasivačních bariér, zabránění propustnosti povlaku a tím zabránění koroznímu rozpouštění povlaku a sulfataci podkladové oceli. Výsledky byly porovnány se studií EPRI, hodnotící žárové nástřiky na kotelních membránových stěnách po 38.000 hodinách provozu v uhelné elektrárně Duke Energy. Naše výsledky ukázaly, že aplikace nástřiku MetalSpray (Smartarc) při použití nástřiku IGS 5-450 vede k prodloužení životnosti kotelních komponent, pracujících v teplotním intervalu 315 až 480 °C i aplikačním možnostem nástřiku 5-570 v prostředí spaloven.Tento příspěvek vznikl za podpory MPO ČR v rámci řešení projektu č. LO1207 programu NPU1.Experimental quality assessment of NiCr and NiCrMoW thermal metal coatings IGS 5-450 and 5-470 was performed on newly created coatings without operating load. The quality was evaluated according to the homogeneity, hardness and thickness of the layer, frictional resistance and resistance in the indentation and scratch test. Furthermore, according to the microstructural and microchemical homogeneity of the coating, the ability to create compact passivation barriers, to prevent the permeability of the coating and thus to prevent the corrosive dissolution of the coating and the sulphation of the underlying steel. The results were compared with an EPRI study evaluating thermal mattalic sprays on boiler membrane walls after 38,000 hours of operation at the Duke Energy coal power plant. Our results have shown that MetalSpray (Smartarc) application with IGS 5-450 spraying leads to extended lifetime of boiler components operating in the temperature range of 315 to 480 °C and application rates of 5 - 570 spraying in incinerator environments
