    An Application and Defense of Ronald Dworkin\u27s Theory of Adjudication

    Laws are intended to put individuals on notice as to how they should act in society and what behavior they may expect from others. But what happens when the text of a law is vague and open to multiple interpretations? How can individuals be expected to conform to laws when the laws are unclear as to what they demand? If the law is to retain legitimacy, there must be a principled way of determining what the law requires in these so-called “hard cases.” Ronald Dworkin argues that if interpretation is not constrained, adjudicators are creating the law rather than simply interpreting it. He believes that such a constraint lies in considerations of coherence that will limit the range of plausible interpretations available for any given law. According to Dworkin, a good interpretation is one that both explains the settled legal materials and coheres with the political morality embedded in those materials. He believes that those constraints will result in one correct interpretation that best fulfills these requirements. Dworkin’s critics, however, argue that because the settled law has been composed by various individuals with differing goals and ideological convictions, any notion of constraint is illusory. They contend that those interpreting the law may choose among competing interpretations while relying on personal, extra-legal considerations in doing so. According to J.M. Balkin, this undermines Dworkin’s distinction between genuine and unconstrained interpretation. In this thesis, I apply Dworkin’s theory of legal interpretation to a “hard case,” and use this application to defend Dworkin and demonstrate the soundness of his characterization of legitimately constrained interpretation

Available from the publisher via the DOI in this record.The pivotal role of KCC2 and NKCC1 in development and maintenance of fast inhibitory neurotransmission and their implication in severe human diseases arouse interest in posttranscriptional regulatory mechanisms such as (de)phosphorylation. Staurosporine (broad kinase inhibitor) and N-ethylmalemide (NEM) that modulate kinase and phosphatase activities enhance KCC2 and decrease NKCC1 activity. Here, we investigated the regulatory mechanism for this reciprocal regulation by mass spectrometry and immunoblot analyses using phospho-specific antibodies. Our analyses revealed that application of staurosporine or NEM dephosphorylates Thr1007 of KCC2, and Thr203, Thr207 and Thr212 of NKCC1. Dephosphorylation of Thr1007 of KCC2, and Thr207 and Thr212 of NKCC1 were previously demonstrated to activate KCC2 and to inactivate NKCC1. In addition, application of the two agents resulted in dephosphorylation of the T-loop and S-loop phosphorylation sites Thr233 and Ser373 of SPAK, a critical kinase in the WNK-SPAK/OSR1 signaling module mediating phosphorylation of KCC2 and NKCC1. Taken together, these results suggest that reciprocal regulation of KCC2 and NKCC1 via staurosporine and NEM is based on WNK-SPAK/OSR1 signaling. The key regulatory phospho-site Ser940 of KCC2 is not critically involved in the enhanced activation of KCC2 upon staurosporine and NEM treatment, as both agents have opposite effects on its phosphorylation status. Finally, NEM acts in a tissue-specific manner on Ser940, as shown by comparative analysis in HEK293 cells and immature cultured hippocampal neurons. In summary, our analyses identified phospho-sites that are responsive to staurosporine or NEM application.     Thermal Conversion of Sugarcane Bagasse Coupled with Vapor Phase Hydrotreatment over Nickel-Based Catalysts: A Comprehensive Characterization of Upgraded Products

    In the present work, we compared the chemical profile of the organic compounds produced in non-catalytic pyrolysis of sugarcane bagasse at 500 °C with those obtained by the in-line catalytic upgrading of the vapor phase at 350 °C. The influence over the chemical profile was evaluated by testing two Ni-based catalysts employing an inert atmosphere (N2) and a reactive atmosphere (H2) under atmospheric pressure with yields of the liquid phase varying from 55 to 62%. Major changes in the chemical profile were evidenced in the process under the H2 atmosphere, wherein a higher degree of deoxygenation was identified due to the effect of synergistic action between the catalyst and H2. The organic fraction of the liquid phase, called bio-oil, showed an increase in the relative content of alcohols and phenolic compounds in the GC/MS fingerprint after the upgrading process, corroborating with the action of the catalytic process upon the compounds derived from sugar and carboxylic acids. Thus, the thermal conversion of sugarcane bagasse, in a process under an H2 atmosphere and the presence of Ni-based catalysts, promoted higher deoxygenation performance of the pyrolytic vapors, acting mainly through sugar dehydration reactions. Therefore, the adoption of this process can potentialize the use of this waste biomass to produce a bio-oil with higher content of phenolic species, which have a wide range of applications in the energy and industrial sectors

    Gene knockouts reveal separate functions for two cytoplasmic dyneins in Tetrahymena thermophila

    In many organisms, there are multiple isoforms of cytoplasmic dynein heavy chains, and division of labor among the isoforms would provide a mechanism to regulate dynein function. The targeted disruption of somatic genes in Tetrahymena thermophila presents the opportunity to determine the contributions of individual dynein isoforms in a single cell that expresses multiple dynein heavy chain genes. Substantial portions of two Tetrahymena cytoplasmic dynein heavy chain genes were cloned, and their motor domains were sequenced. Tetrahymena DYH1 encodes the ubiquitous cytoplasmic dynein Dyh1, and DYH2 encodes a second cytoplasmic dynein isoform, Dyh2. The disruption of DYH1, but not DYH2, resulted in cells with two detectable defects: 1) phagocytic activity was inhibited, and 2) the cells failed to distribute their chromosomes correctly during micronuclear mitosis. In contrast, the disruption of DYH2 resulted in a loss of regulation of cell size and cell shape and in the apparent inability of the cells to repair their cortical cytoskeletons.
