In perfect future. The End of Time in Augustine, the apocalyptic and Gnostic
Augustine's reflection on time, from the level of individual salvation and the transcendence of the heavenly city located from the beginning on Earth, able to characterize or shape of medieval culture, but it is also clear that the expectations generated apocalyptic positions – better known as millenarian sects – and the Gnostics did not fail to weigh heavily in the collective imagination that went through the end of the Roman Empire and the so-called Middle Ages. So the contrast between conceived notions about the future in these three directions, it allows you to understand the full extent the meaning and significance of the choice of linear and finite time, hidden under mythical notions as Revelation, Last Judgment, Kingdom of God, eternal salvation, is at the bottom of the beliefs that have been – and somehow still blowing – life to Western culture
A Formalist Theory of Contract Law Adjudication
Formalism has a bad name. It is often seen as a naïve and unsophisticated approach to the adjudication of legal disputes. This negative view of formalism is widespread in American legal culture and has been particularly influential in contract law. This Article challenges this prevailing view and argues that a formalist theory of adjudication is the best approach to resolve contractual disputes.
The argument of this Article starts from the assumption that contract law is not morally justified because of its enforcement of promissory rights or some other dimension of interpersonal morality. Instead, like contemporary law and economics, this Article assumes as its starting point that the law of contracts is an instrumentally justified legal institution (i.e., an institution justified because of its valuable social consequences). Starting from this assumption, this Article asks what approach to the adjudication of contractual disputes facilitates the achievement of contract law’s instrumental goals. Against the common assumption, the answer is that a formalist approach—the specific contours of which are set out below—would be instrumentally best. This is because formalism, with its commitment to an ex-post, rule-bound, doctrinalist, and modest approach to legal adjudication, has important instrumental benefits. Formalism contributes to simple, generalizable, and cost-effective decision-making; it is consistent with the institutional competence of courts; reduces the risks and overall costs of legal mistakes; and increases predictability, protecting contractual parties’ legitimate expectations. Moreover, formalism is an adequate means to deal with value pluralism and is consistent with the main values served by the law of contracts, such as autonomy and efficiency.
Thus, encouraging judges to make socially optimal decisions in contractual disputes might not be the optimal strategy. The overall socially optimal outcome might, instead, be achieved through a decision procedure that directs judges to decide by applying pre-existing doctrine and expanding it incrementally. If that is the case, then, despite their disagreement about contract law’s foundations, instrumentalist and formalist theorists might agree about the narrower question of how judges should decide contractual disputes
New World, are two literary works that far from being confined to the old liberalism Apologies in crisis at the beginning of the twentieth century, form a kind of “social warning” directed to point out the danger facing the western society under threat from two types of totalitarianism that actually were the protagonists of the political and social world of the last century, namely: that expressly authoritarian, based on terror, the war abroad and Fear inscribed on the interiority of the individual and the other, hidden under the guise of technological progress, hygiene and planning of extreme life. Ways to implement control mechanisms that appear to defend opposing ways of life, but now have evolved as a single strategy to dominate individual consciences and bend the wills of men of this to the point of threatening the very survival of the species
This paper presents the organization of group therapy for patients with psychotic
disorders in a Mental Health Team. Previous experience with group therapy had shown us
that groups are an appropriate context for the understanding, containment and treatment
of psychotic disorders. Strategies based on group therapy can thus be considered an integral
and permanent element of service provision for persons with psychoses and other
disorders of the schizophrenia spectrum. The group therapy proposed in the paper is based
on psychoanalysis, Operative Group theory and Pichon Riviere’s social psychology
