    U.S. Senator and former Democratic presidential contender Elizabeth Warren recently proposed the Corporate Executive Accountability Act, a bill that lowers the level of mental state required to prosecute executives for any corporate crime. A nationwide debate has been raging over this Act, but most arguments have focused on the appropriateness of the relaxed requirement, and the whole picture of executive accountability is vague. This Essay reveals what the facts and fictions of corporate executive accountability are, focusing on the degree of punishment of criminal executives. The author presents the estimates of expected direct and indirect punishments of executives and considers other options to deter corporate crimes, options that could be used with or without the proposed Act

    Numerical Simulation of Multicrack Propagation Behaviour in Steel Structure

    This paper describes the numerical simulation method of the multi-crack propagation behaviour which appear in a part of civil engineering structures with complex geometrical configuration like steel bridges. Proposed method can treat the interaction of several cracks which locate in a short distance each other, and the process of their growth can be grasped. The method is based on the finite element method, and the linear fracture mechanics is assumed. Proposed method includes following tools for the simulation of the crack propagation behaviour: Automatic Mesh Generators for 3-D, 2-D structural analysis, and 2-D crack propagation analysis, Multi-level Structural Analysis Technique, Estimation Method of the crack growth and the angle of cracks and the modelling method of traffic loadings. The validity of the method is investigated by comparing the result to the experimental one

    Social Preferences and Well-Being: Theory and Evidence

    The education systems of many countries emphasize the development of prosocial preferences. Clarifying how these preferences are related to well-being is therefore essential. Although many studies have shown that particular prosocial behaviors increase subjective well-being, it is unclear whether prosocial preferences rather than prosocial behaviors are associated with greater well-being. This study presents a model in which differences in social preferences explain differences in subjective well-being. Then, using survey data from the United States, it finds an association between social preferences and well-being. We measured social preferences using the Slider Measure of social value orientation to evaluate prosociality as a continuous variable. Using the Pemberton Happiness Index, we also measured subjective well-being in terms of the multiple dimensions of general well-being, hedonic well-being, eudaimonic well-being, social well-being, and experienced well-being. Regression analysis revealed that the effect sizes of social value orientation on hedonic well-being and eudaimonic well-being were 0.19 and 0.15, respectively, which are comparable to the effect sizes of parenthood, income, and education

    Initial recruitment and establishment of vascular plants in relation to topographical variation in microsite conditions on a recently-deglaciated moraine on Ellesmere Island, high arctic Canada

    We investigated the effects of topographical positions (moraine ridge, upper side slope and lower side slope) within a recently-deglaciated young moraine on initial recruitment and establishment of vascular plants. Compared with the moraine ridge, the upper slope had similar/higher abundance of vascular plants in terms of percent cover, frequency occurrence, species number, and density/biomass of a dominating species, Salix arctica. Establishment and growth of vascular plants are generally inhibited on unstable habitats; nevertheless, on this newly-formed moraine, every attribute measured for vascular plants implied a higher probability of vascular plant recruitment on the upper slope, where substrate is less stable than on the ridge. Further, the microsite with greater vascular plant abundance, S. arctica density and S. arctica aboveground/leaf biomass accumulated more organic materials regardless of topographical positions, and such an organic accumulation was deepest on the upper slope, suggesting that relatively-successful plant establishment occurs on this site. This is further supported by the S. arctica population structure, which implies a relatively-constant juvenile supply on the upper slope. Along a slope, unstable gravels easily slide down hill. This topographical process may cause large rock size and high surface cover by rocks on the lower slope. On the upper slope, the percent cover by rocks had therefore become smaller, leading to high cover by fine-grained sediments, which retain moisture favorable for germination and growth of vascular plants. This would enhance the emergence of pioneer vascular plant species, probably resulting in higher vascular plant abundance, density and biomass of S. arctica on the upper slope. This study suggests that during primary succession following deglaciation in the high arctic the upper slope of a newly-formed glacier moraine may be an important location for the initial recruitment and establishment of pioneer vascular plant species, such as S. arctica

    Successful Treatment of Primary Sclerosing Cholangitis with a Steroid and a Probiotic

    Primary sclerosing cholangitis (PSC) is a serious disease that not only affects quality of life but can also have a significant effect on patient survival. The treatment for PSC is primarily supportive with the aim of controlling cholestatic symptoms and preventing complications. Ursodeoxycholic acid may induce biochemical improvements in affected patients; however, long-term pediatric studies to determine its possible benefits in young patients are lacking. Thus, the treatment of pediatric PSC remains a significant clinical challenge. We describe a patient with PSC and undetermined colitis who was treated with a combination of a steroid, salazosulfapyridine, and a probiotic. This treatment provided benefits both for PSC and the undetermined colitis. These findings suggest that bacterial flora and gut inflammation are closely associated with the pathogenesis of inflammatory bowel disease-related PSC. Suppression of bowel inflammation and maintenance of bacterial homeostasis may be important for treating PSC

    Mechanism of robust circadian oscillation of KaiC phosphorylation in vitro

    By incubating the mixture of three cyanobacterial proteins, KaiA, KaiB, and KaiC, with ATP in vitro, Kondo and his colleagues reconstituted the robust circadian rhythm of the phosphorylation level of KaiC (Science, 308; 414-415 (2005)). This finding indicates that protein-protein interactions and the associated hydrolysis of ATP suffice to generate the circadian rhythm. Several theoretical models have been proposed to explain the rhythm generated in this "protein-only" system, but the clear criterion to discern different possible mechanisms was not known. In this paper, we discuss a model based on the two basic assumptions: The assumption of the allosteric transition of a KaiC hexamer and the assumption of the monomer exchange between KaiC hexamers. The model shows a stable rhythmic oscillation of the phosphorylation level of KaiC, which is robust against changes in concentration of Kai proteins. We show that this robustness gives a clue to distinguish different possible mechanisms. We also discuss the robustness of oscillation against the change in the system size. Behaviors of the system with the cellular or subcellular size should shed light on the role of the protein-protein interactions in in vivo circadian oscillation

    Increased number of T cells and exacerbated inflammatory pathophysiology in a human IgG4 knock-in MRL/lpr mouse model

    Immunoglobulin (Ig) G4 is an IgG subclass that can exhibit inhibitory functions under certain conditions because of its capacity to carry out Fab-arm exchange, inability to form immune complexes, and lack of antibody-dependent and complement-dependent cytotoxicity. Although several diseases have been associated with IgG4, its role in the disease pathogeneses remains unclear. Since mice do not express an IgG subclass that is identical to the human IgG4 (hIgG4), we generated hIGHG4 knock-in (KI) mice and analyzed their phenotypes. To preserve the rearrangement of the variable, diversity, and joining regions in the IGH gene, we transfected a constant region of the hIGHG4 gene into C57BL/6NCrSlc mice by using a gene targeting method. Although the mRNA expression of hIGHG4 was detected in the murine spleen, the serum level of the hIgG4 protein was low in C57BL/6-IgG4KI mice. To enhance the production of IgG4, we established an MRL/lpr-IgG4KI mice model by backcrossing. These mice showed a high IgG4 concentration in the sera and increased populations of IgG4-positive plasma cells and CD3+B220+CD138+ T cells in the spleen. Moreover, these mice showed aggravated inflammation in organs, such as the salivary glands and stomach. The MRL/lpr-IgG4KI mouse model established in the present study might be useful for studying IgG4-related disease, IgG4-type antibody-related diseases, and allergic diseases

    Parental satisfaction and seizure outcome after corpus callosotomy in patients with infantile or early childhood onset epilepsy

    AbstractPurposeTo elucidate the benefit of corpus callosotmy in terms of parental satisfaction and seizure outcome.MethodThis study included 16 consecutive patients with infantile or early childhood onset epilepsy who underwent total corpus callosotomy for alleviation of seizures. Questionnaires were sent anonymously to the parents asking about relative changes in seizures and about parental satisfaction for the post-operative outcome.ResultsThe improvements in frequency, intensity, and duration of seizures were correlated with the level of satisfaction (Spearman's rank-order correlation coefficient, ρ=0.87, 0.93, and 0.75, respectively). The highest level of satisfaction was only seen in patients who achieved freedom from all seizures or drop attacks.ConclusionComplete seizure freedom and freedom from drop attacks are important goals of corpus callosotomy for parental satisfaction. These factors should be considered in assessing post-operative outcome after corpus callosotomy

    A New Electrophysiological Method for the Diagnosis of Extraforaminal Stenosis at L5-S1

    Study DesignA retrospective study.PurposeTo examine the effectiveness of using an electrodiagnostic technique as a new approach in the clinical diagnosis of extraforaminal stenosis at L5-S1.Overview of LiteratureWe introduced a new effective approach to the diagnosis of extraforaminal stenosis at the lumbosacral junction using the existing electrophysiological evaluation technique.MethodsA consecutive series of 124 patients with fifth lumbar radiculopathy were enrolled, comprising a group of 74 patients with spinal canal stenosis and a second group of 50 patients with extraforaminal stenosis at L5-S1. The technique involved inserting a pair of needle electrodes into the foraminal exit zone of the fifth lumbar spinal nerves, which were used to provide electrical stimulation. The compound muscle action potentials from each of the tibialis anterior muscles were recorded.ResultsThe distal motor latency (DML) of the potentials ranged from 11.2 to 24.6 milliseconds in patients with extraforaminal stenosis. In contrast, the DML in patients with spinal canal stenosis ranged from 10.0 to 17.2 milliseconds. After comparing the DML of each of the 2 groups and at the same time comparing the differences in DML between the affected and unaffected side of each patient, we concluded there were statistically significant differences (p<0.01) between the 2 groups. Using receiver operating characteristic curve analysis, the cutoff values were calculated to be 15.2 milliseconds and 1.1 milliseconds, respectively.ConclusionsThis approach using a means of DML measurement enables us to identify and localize lesions, which offers an advantage in diagnosing extraforaminal stenosis at L5-S1
