Employee Covenants Not to Compete: Where Does Virginia Stand?
Courts for some time now have been forced to deal with the validity of covenants not to compete as contained in employment contracts. Considered to be a restraint against trade, these covenants under common law were viewed with disfavor, if not hostility, both nationally and in the Commonwealth of Virginia, as being contrary to the American ideals of individual freedom, competition, and the free flow of commerce. As such they were seldom upheld. It was only after the courts recognized that employers had legitimate concerns and interests worthy of protections that reasonable covenants not to compete began to be enforced by injunction following a breach

The global distribution of Bacillus anthracis and associated anthrax risk to humans, livestock and wildlife.
Bacillus anthracis is a spore-forming, Gram-positive bacterium responsible for anthrax, an acute infection that most significantly affects grazing livestock and wild ungulates, but also poses a threat to human health. The geographic extent of B. anthracis is poorly understood, despite multi-decade research on anthrax epizootic and epidemic dynamics; many countries have limited or inadequate surveillance systems, even within known endemic regions. Here, we compile a global occurrence dataset of human, livestock and wildlife anthrax outbreaks. With these records, we use boosted regression trees to produce a map of the global distribution of B. anthracis as a proxy for anthrax risk. We estimate that 1.83 billion people (95% credible interval (CI): 0.59-4.16 billion) live within regions of anthrax risk, but most of that population faces little occupational exposure. More informatively, a global total of 63.8 million poor livestock keepers (95% CI: 17.5-168.6 million) and 1.1 billion livestock (95% CI: 0.4-2.3 billion) live within vulnerable regions. Human and livestock vulnerability are both concentrated in rural rainfed systems throughout arid and temperate land across Eurasia, Africa and North America. We conclude by mapping where anthrax risk could disrupt sensitive conservation efforts for wild ungulates that coincide with anthrax-prone landscapes
Cm-Wavelength Total Flux and Linear Polarization Properties of Radio-Loud BL Lacertae Objects
Results from a long-term program to quantify the range of behavior of the
cm-wavelength total flux and linear polarization variability properties of a
sample of 41 radio-loud BL Lac objects using weekly to tri-monthly observations
with the University of Michigan 26-m telescope operating at 14.5, 8.0, and 4.8
GHz are presented; these observations are used to identify class-dependent
differences between these BL Lacs and QSOs in the Pearson-Readhead sample. The
BL Lacs are found to be more highly variable in total flux density than the
QSOs, exhibiting changes that are often nearly-simultaneous and of comparable
amplitude at 14.5 and 4.8 GHz in contrast to the behavior in the QSOs and
supporting the existence of class-dependent differences in opacity within the
parsec-scale jet flows. Structure function analyses of the flux observations
quantify that a characteristic timescale is identifiable in only 1/3 of the BL
Lacs. The time-averaged fractional linear polarizations are only on the order
of a few percent and are consistent with the presence of tangled magnetic
fields within the emitting regions. In many sources a preferred long-term
orientation of the EVPA is present; when compared with the VLBI structural
axis, no preferred position angle difference is identified. The polarized flux
typically exhibits variability with timescales of months to a few years and
shows the signature of a propagating shock during several resolved outbursts.
The observations indicate that the source emission is predominately due to
evolving source components and support the occurrence of more frequent shock
formation in BL Lac parsec-scale flows than in QSO jets. The differences in
variability behavior and polarization between BL Lacs and QSOs can be explained

Development of methods for predicting large crack growth in elastic-plastic work-hardening materials in fully plastic conditions
The objects of the first, exploratory, stage of the project were listed as: (1) to make a detailed and critical review of the Boundary Element method as already published and with regard to elastic-plastic fracture mechanics, to assess its potential for handling present concepts in two-dimensional and three-dimensional cases. To this was subsequently added the Finite Volume method and certain aspects of the Finite Element method for comparative purposes; (2) to assess the further steps needed to apply the methods so far developed to the general field, covering a practical range of geometries, work hardening materials, and composites: to consider their application under higher temperature conditions; (3) to re-assess the present stage of development of the energy dissipation rate, crack tip opening angle and J-integral models in relation to the possibilities of producing a unified technology with the previous two items; and (4) to report on the feasibility and promise of this combined approach and, if appropriate, make recommendations for the second stage aimed at developing a generalized crack growth technology for its application to real-life problems
Water hyacinth (Eichhornia crassipes) and water lettuce (Pistia stratiotes) in the Great Lakes: Playing with fire?
The Laurentian Great Lakes have been successfully invaded by at least 182 nonindigenous species. Here we report on two new species, water hyacinth Eichhornia crassipes and water lettuce Pistia stratiotes, that were found at a number of locations in Lake St. Clair and Detroit River during autumn 2010. Both species are commonly sold in the water garden and aquarium trade in southern Ontario and elsewhere. While it is not clear whether these species are established or can establish in the Great Lakes, the historic assumption that neither of these subtropical to tropical plants pose an invasion risk must be questioned in the light of changing environmental conditions associated with climate warming that may render Great Lakes\u27 habitats more suitable for these species and increase the likelihood of their successful establishment. © 2011 The Author(s)
Errors in self-reports of health services use: impact on alzheimer disease clinical trial designs
BACKGROUND: Most Alzheimer disease clinical trials that compare the use of health services rely on reports of caregivers. The goal of this study was to assess the accuracy of self-reports among older adults with Alzheimer disease and their caregiver proxy respondents. This issue is particularly relevant to Alzheimer disease clinical trials because inaccuracy can lead both to loss of power and increased bias in study outcomes.
METHODS: We compared respondent accuracy in reporting any use and in reporting the frequency of use with actual utilization data as documented in a comprehensive database. We next simulated the impact of underreporting and overreporting on sample size estimates and treatment effect bias for clinical trials comparing utilization between experimental groups.
RESULTS: Respondents self-reports have a poor level of accuracy with κ-values often below 0.5. Respondents tend to underreport use even for rare events such as hospitalizations and nursing home stays. In analyses simulating underreporting and overreporting of varying magnitude, we found that errors in self-reports can increase the required sample size by 15% to 30%. In addition, bias in the reported treatment effect ranged from 3% to 18% due to both underreporting and overreporting errors.
CONCLUSIONS: Use of self-report data in clinical trials of Alzheimer disease treatments may inflate sample size needs. Even when adequate power is achieved by increasing sample size, reporting errors can result in a biased estimate of the true effect size of the intervention
Fallout nuclides in Atlantic and Pacific water columns : GEOSECS data
This report contains results of measurements of the fallout radionuclides
90Sr, 137Cs , 239,240Pu , and 241Am in large volume seawater samples collected
between 1972 and 1974 in the Atlantic and Pacific as part of Geochemical Ocean
Sections (GEOSECS) program. The stations for which data are reported include
both the North and South Atlantic oceans and latitudes north of 20° S in the
Pacific Ocean. The 90Sr and 137Cs data set has been corrected by a procedure
which estimates independently the analytical blank for the laboratory
which made the analysis. When the data quality and spacing permit, water column
inventory estimates were made for each nuclide over depth intervals appropriate
to the nuclide's distribution.Funding was provided by the United States Department of Energy

An LC-MS/MS based survey of contaminants of emerging concern in drinking water in South Africa
Advances in many analytical techniques allow the detection of compounds in water at very low concentrations (ng/L), which has facilitated the identification of many compounds in drinking water that went previously undetected. Some of these compounds are contaminants of emerging concern (CECs), which is broadly defined as any chemical or microorganism that is not currently being routinely monitored but has recently been identified as being present in the environment, and that may pose health or ecological risks. CECs can include pharmaceuticals, personal health care products and pesticides. Some CECs can act as endocrine disruptors, interfering with the normal functioning of the human endocrine system, potentially influencing foetal and child development. Although the level of many of these compounds are orders of magnitude below known acute toxicity levels, the health impact of long term exposure at low levels is mostly unknown. In this study, we present the results of a national survey over four seasons of potential CECs in the drinking water of major South African cities. The contaminants most often detected were the related herbicides atrazine and terbuthylazine, and the anticonvulsant and mood-stabilising drug, carbamazepine. The levels of these CECs were well below maximum levels proposed by the World Health Organization and the US Environmental Protection Agency. However, the range of CECs detected in drinking water, and seasonal and geographic variability in CECs levels, warrant a more frequent screening programme
Description and Status of the North Alabama Lightning Mapping Array
The North Alabama Lightning Mapping Array (LMA) is a network LMA detectors that detects and maps lightning using VHF radiation (TV Channel 5) in a region centered about Huntsville, Alabama that includes North Alabama, Central Tennessee and parts of Georgia and Mississippi. The North Alabama LMA has been in operation since late 2001, and has been providing real time data to regional National Weather Service (NSF) Weather Forecast Offices (WFOs) since mid 2003 through the NASA Short-term Prediction Research and Transition (SPoRT) center. Data from this network (as well as other from other LMA systems) are now being used to create proxy Geostationary Lightning Mapper (GLM) data sets for GOES-R risk reduction and algorithm development activities. In addition, since spring 2009 data are provided to the Storm Prediction Center in support of Hazardous Weather Testbed and GOES-R Proving Ground activities during the Spring Program.
