    El Derecho al Juez imparcial y el principio de imparcialidad judicial son aspectos omitidos en la Constitución de 1978, sin embargo, nadie pone en duda su aplicación efectiva y la importancia en el funcionamiento y legitimación del poder judicial. Se trata del derecho que tiene toda persona a ser juzgada por un juez imparcial, pudiendo ser apartado del caso si se demuestra que la presunción de imparcialidad es destruida. En el presente trabajo, se realiza un estudio sobre la configuración del Derecho al Juez imparcial en nuestro ordenamiento jurídico a través de un breve análisis de los casos de la jurisprudencia del TEDH y del TC, así como los principales problemas que se presentan, como la ausencia de un desarrollo legislativo, las complicaciones a la hora de probar el verdadero interés del juez así como las intromisiones de otros poderes, principalmente del ejecutivo, lo que ha suscitado diversos conflictos en torno a la imparcialidad de los jueces.The right to an impartial judge and the principal of judicial impartiality are aspects missing from the 1978 Constitution. However, its de facto application is not in doubt, nor is its importance in the function and legitamisation of judicial power. It is the right of every person to be judged by an impartial judge. If the presumption of impartiality is shown to be prejudiced, then the judge must be recused from the case. In this work, a study is done about the configuration of the Right to an Impartial Judge in our legal system through a brief analysis of European Court of Human Rights and Constitutional Tribunal jurisprudence cases. Also examined are the main problems presented, for example, in the absence of legislation, the complications when trying to prove the true interests of a judge, as well as the interference of other powers, mainly executive power, which have caused several conflicts in relation to the impartiality of judges.Departamento de Derecho Constitucional, Procesal y Eclesiástico del EstadoGrado en Derech

    Prognostic and Clinicopathological Significance of CCND1/Cyclin D1 Upregulation in Melanomas: A Systematic Review and Comprehensive Meta-Analysis

    We would like to thank the research group CTS-392 (Plan Andaluz de Investigación, Junta de Andalucía, Spain).Simple Summary The incidence of cutaneous melanoma is increasing worldwide, currently responsible for 287,723 new cases and 60,712 deaths per year (GLOBOCAN, IARC, WHO). It should be also highlighted that some less frequent subtypes of melanomas-i.e., acral, uveal, and mucous melanoma-are responsible for significant morbidity associated with metastasis, responding typically worse to newer therapies. Therefore, new biomarkers are needed to improve the prognosis in individual patients. In this sense, the present study showed that CCND1/cyclin D1 upregulation is a common molecular oncogenic alteration in melanomas that probably favors the growth and expansion on cutaneous primary melanomas. Furthermore, immunohistochemical cyclin D1 overexpression strongly predicted a higher Breslow thickness, currently considered the most relevant prognostic factor in individual patients with melanomas. Finally, special attention should be paid to the CCND1/cyclin D1 complex in mucosal melanomas, whose upregulation was strikingly altered. Our objective was to evaluate the prognostic and clinicopathological significance of cyclin D1 (CD1) overexpression/CCND1 amplification in melanomas. We searched studies published before September 2019 (PubMed, Embase, Web of Science, Scopus). We evaluated the quality of the studies included (QUIPS tool). The impact of CD1 overexpression/CCND1 amplification on overall survival and relevant clinicopathological characteristic were meta-analyzed. We performed heterogeneity, sensitivity, small-study effects, and subgroup analyses. Forty-one studies and 3451 patients met inclusion criteria. Qualitative evaluation demonstrated that not all studies were performed with the same rigor, finding the greatest risk of bias in the study confounding domain. Quantitative evaluation showed that immunohistochemical CD1 overexpression had a statistical association with Breslow thickness (p = 0.007; OR = 2.09,95% CI = 1.23-3.57), significantly higher frequency of CCND1/cyclin D1 abnormalities has been observed in the primary tumor compared to distant metastases (p = 0.004), revealed also by immunohistochemical overexpression of the protein (p < 0.001; OR = 0.53,95% CI = 0.40-0.71), while the CCND1 gene amplification does not show association (p = 0.43); while gene amplification, on the contrary, appeared more frequently in distant metastases (p = 0.04; OR = 1.70,95% CI = 1.01-2.85) and not in the primary tumor. In conclusion, CCND1/cyclin D1 upregulation is a common molecular oncogenic alteration in melanomas that probably favors the growth and expansion of the primary tumor. This upregulation is mainly consequence to the overexpression of the cyclin D1 protein, and not to gene amplification

    Effects of therapeutic exercises in patients with lung cancer. A scoping review

Smoking is one of the main risk factors associated with this cancer. Treatment will depend on the form of cancer and its stage, existing many therapeutic possibilities. In this regard, therapeutic exercise plays an important role in lung cancer care, as well as the pulmonary rehabilitation and respiratory physical therapy. Purpose: To review the current scientific literature about the effects of therapeutic exercise in lung cancer. Method: A search was carried out in CINAHL, MEDLINE, PubMed, Scopus y Web of Science using de terms “Exercise Therapy” and “Lung Neoplasms”. 141 studies were obtained, but only 19 were selected by adjusting to the inclusion and exclusion criteria. 10 of them were randomized controlled trials with a Jadad score between 2 and 3. Results: These works performed a large variety of interventions based on therapeutic exercise, classified in preoperative, postoperative, during treatment, post treatment and combination. Most focused on aerobic exercise, muscle strength and respiratory exercises. Conclusion: therapeutic exercise seems to be positive and obtain significant improvements in patients with lung cancer, regardless the moment of intervention and the type of exercise performed

    Association of the serological status of rheumatoid arthritis patients with two circulating protein biomarkers: a useful tool for precision medicine strategies

    [Abstract] Rheumatoid arthritis (RA) is an autoimmune disease characterized by chronic inflammation of the joints and presence of systemic autoantibodies, with a great clinical and molecular heterogeneity. Rheumatoid Factor (RF) and anti-citrullinated protein antibodies (ACPA) are routinely used for the diagnosis of RA. However, additional serological markers are needed to improve the clinical management of this disease, allowing for better patient stratification and the desirable application of precision medicine strategies. In the present study, we investigated those systemic molecular changes that are associated with the RF and ACPA status of RA patients. To achieve this objective, we followed a proteomic biomarker pipeline from the discovery phase to validation. First, we performed an iTRAQ-based quantitative proteomic experiment on serum samples from the RA cohort of the Hospital of Santiago de Compostela (CHUS). In this discovery phase, serum samples from the CHUS cohort were pooled according to their RF/ACPA status. Shotgun analysis revealed that, in comparison with the double negative group (RF-/ACPA-), the abundance of 12 proteins was altered in the RF+/ACPA+ pool, 16 in the RF+/ACPA- pool and 10 in the RF-/ACPA+ pool. Vitamin D binding protein and haptoglobin were the unique proteins increased in all the comparisons. For the verification phase, 80 samples from the same cohort were analyzed individually. To this end, we developed a Multiple Reaction Monitoring (MRM) method that was employed in a comprehensive targeted analysis with the aim of verifying the results obtained in the discovery phase. Thirty-one peptides belonging to 12 proteins associated with RF and/or ACPA status were quantified by MRM. In a final validation phase, the serum levels of alpha-1-acid glycoprotein 1 (A1AG1), haptoglobin (HPT) and retinol-binding protein 4 (RET4) were measured by immunoassays in the RA cohort of the Hospital of A Coruña (HUAC). The increase of two of these putative biomarkers in the double seropositive group was validated in 260 patients from this cohort (p = 0.009 A1AG1; p = 0.003 HPT). The increased level of A1AG1 showed association with RF rather than ACPA (p = 0.023), whereas HPT showed association with ACPA rather than RF (p = 0.013). Altogether, this study has allowed a further classification of the RA seropositive patients into two novel clusters: RF+A1AG+ and ACPA+HPT+.     Is contact with birth parents beneficial to children in non-kinship foster care? A scoping review of the evidence

    Many children in non-kinship foster care maintain contact with their birth parents, although debate continues about whether or not, or under what circumstances, it is beneficial to the child. In this scoping review we analyze the findings of studies conducted over the past two decades that have specifically examined face-to-face contact with birth parents for children in non-kinship foster care, our aim being to determine more clearly when it may contribute positively to the child’s well-being. The review was conducted in accordance with PRISMA-ScR guidelines and involved a search of nine electronic databases. A total of 21 studies met the criteria for inclu- sion in the review, namely primary studies analyzing one or more aspects of these contact visits, written in English or Spanish, and published during the period 1997–2022. In analyzing these studies we grouped their findings according to four broad areas of interest: characteristics of contact visits, appraisal of visits by families and professionals, relationship between contact and fostering outcomes, and impact of contact on children. The four main conclusions we draw from the review are: a) surprisingly few studies have specifically examined the effects of face-to-face contact with birth parents in non-kinship foster care; b) the findings to date are neither conclusive nor generalizable, although they are not generally encouraging; c) under the right circumstances (e.g., adequate supervision, conducted in a context of emotional security for the child), contact can contribute to the child’s well-being and increase the likelihood of family reunification; and d) more robust research is needed to guide the development of interventions that can improve parent–child relationships and the quality of contact visitsAndalusian Plan for Research, Development and Innovation (PAIDI) Research Group SEJ-466.     The Key Role of Emotional Repair and Emotional Clarity on Depression among Breast Cancer Survivors

    Breast cancer is the malignancy with the highest incidence in women worldwide. The empirical evidence is inconsistent with the prevalence of depression among breast cancer survivors (BCS), pointing to emotional competencies as protective factors against affective disorders. However, the mechanisms through which these competencies favor a more adaptive emotional state are unknown. Therefore, this study aims to explore the relationship between the experience of having survived the disease and depression levels in a group of BCS, and the mediating role of Perceived Emotional Intelligence (PEI) in this relation. This was a cross-sectional study with 237 women divided into two groups: 56 BCS and 181 healthy controls who completed the Trait Meta-Mood Scale 24 (TMMS-24) and the Hospital Anxiety and Depression Scale (HADS). Results showed that Survivorship and PEI explained and predicted 37.8% of the variance of depression, corresponding the 11.7% to the direct and/or the indirect effect of the PEI dimensions (Emotional Attention, Emotional Clarity, and Emotional Repair). In conclusion, interventions aimed at promoting an adequate PEI in this population-and in the Psycho-oncology field, in general-with a particular focus on the development of Emotional Clarity and Repair need to be implemented. Limitations and future research lines are discussed

    Enhancing Self-Esteem and Body Image of Breast Cancer Women through Interventions: A Systematic Review

    Breast Cancer (BC) is the most common neoplasm in women worldwide, considered a global public health problem. Among BC women, some of the most common psychological symptoms in the adaptation to the disease are reduction in self-esteem and distorted body image (BI). Although there are numerous studies with the goal of promoting different psychological variables, BI and self-esteem are often separately observed despite their relationship and their importance in the process of the illness. Moreover, there have been no reviews that have synthesized the findings related to interventions aimed at enhancing both self-esteem and BI in BC women. Therefore, the objective of this review was to identify and examine the implemented interventions aimed at boosting both variables in this population. For this purpose, a systematic review was implemented following the PRISMA statement. A thorough search was performed on the following databases: Web of Science, PubMed, PsychInfo, PsychArticles, and Scopus. Among 287 records, only eight articles met the eligibility criteria. Interventions were grouped into three types according to their characteristics: Group therapies, Physical activity therapies, and Cosmetic and beauty treatments. The levels of effectiveness of the different interventions varied between them, and within each, in their impact on self-esteem and BI. More interventions focused on developing BI and self-esteem in this population are needed due to their ability to predict psychological functioning and quality of life of women with breast cancer.This research was funded by the Ministry of Health of the Junta de Andalucia by the financed Project PIN-0109-2018-INIBICA, by the Research Group HUM-843 Emotional Intelligence from the University of Cadiz (Spain), and the University Institute for Sustainable Social Development (INDESS).
