    La incorporación de la figura del tercero no conviviente como denunciante en la Ley Nº 6.672 de violencia familiar

    La violencia intrafamiliar es un problema social grave y real, es el drama oculto de muchos hogares; violencia contra las mujeres, contra el hombre, maltrato infantil, violencia filio-parental y abuso de ancianos. La provincia de Mendoza se adhiere a la Ley Nacional 26.485, sancionando el 16/11/10, la Ley 8226 – Protección Integral, Prevención, Sanción y erradicación de la violencia contra las mujeres, adhesión a la Ley Nacional 26.485. En cuanto a quiénes pueden realizar la denuncia, sigue rigiendo la Ley Provincial Nº 6.672 Ley de violencia familiar del 20/04/1999, que contempla que cuando se trata de adultos víctimas de violencia, solamente se encuentra legitimado/a para entablar la denuncia el propio damnificado/a o un tercero/a que conviva con los mismos. Cuando se hace público el hecho de violencia por lesiones o muerte de la/s víctima/s, generalmente existe el testimonio de el o los terceros que no conviven con los mismos, que conocían esta situación y que no son denunciantes legales. El objetivo general es Proponer la apertura de la legitimación activa en la Ley Nº 6.672 de Violencia Familiar – (Provincia de Mendoza) respecto de cualquier persona que -aún ajena a la situación de violencia- pudiera denunciar en lugar de la víctima, cuando esta sufriera imposibilidad física o psíquica para realizarla. En esta Investigación mixta, una encuesta realizada a 65 participantes del departamento de San Rafael, Mendoza, de ambos sexos, muestra que las víctimas se sienten desamparadas por parte de la ley, instituciones, vecinos y familiares, testigos que suelen presentar cierta resistencia a tomar partido en los conflictos de la familia problemática, vivida como un espacio de privacidad en el cual no se debe intervenir. Un 22% sabe quiénes pueden formular denuncia legal en situaciones de violencia de género. La casi inexistencia de denuncias de victimas u otro conviviente, el análisis cualitativo de la entrevista a una abogada especialista y del testimonio de una víctima indican que es urgente buscar una modificación en la Ley que logre una mayor participación social, a la vez que elaborar e implementar las políticas públicas necesarias de prevención, protección a las víctimas y sanción a los victimarios.Domestic violence is a serious and real social problem, it is the hidden drama of many homes; violence against women, against men, child abuse, filio-parental violence and abuse of the elderly. Mendoza province adheres to National Law 26,485, sanctioning 16/11/10, Law 8226 - Comprehensive Protection, Prevention, Punishment and Eradication of violence against women, adherence to National Law 26485. As to who can perform the complaint, continues to govern Provincial Law No. 6,672 Family Violence Law of 04/20/1999, which provides that when it comes to adult victims of violence, only the victim himself / herself is legitimated to file a complaint. third / a who lives with them. When the fact of violence due to injury or death of the victim / s is made public, there is usually the testimony of the third party (s) that not lives with them, who knew about this situation and who are not "legal complainants". The general objective is propose the opening of active legitimation in the Law No. 6,672 of Family Violence - (Province of Mendoza) with respect to any person who, despite the situation of violence, could denounce instead of the victim when he suffered physical or mental impossibility to perform it. In this Mixed Research, a survey of 65 participants of San Rafael, Mendoza of both sexes shows that the victims feel helpless by the law, institutions, neighbors and family members, witnesses who usually show some resistance to take sides in the conflicts of the problematic family, lived as a space of privacy in which one should not intervene. 22% know who can make a legal complaint in situations of gender violence. The almost nonexistence of complaints from victims or another partner, the qualitative analysis of the interview with a specialist lawyer and the testimony of a victim indicate that it is urgent to seek a change in the law that achieves greater social participation, while elaborating implement the necessary public policies of prevention, protection of victims and punishment of perpetrators.Fil: Fuentes, María Noeli

    Effortful control is associated with children's school functioning via learning-related behaviors

    The goal of the current study was to identify factors that contribute to individual differences in school functioning. We proposed a model including direct effects of Effortful Control (EC) on Spanish 6- to 12-year olds' (N = 142) academic achievement and social adaptation at school, with these relations partially mediated by learning-related behaviors (LRBs). Parents rated children's EC; teachers reported children's LRBs and children' social adaptation in school; children' social preference was assessed through classmates' nominations. Children's academic achievement was measured through standard tests and grades. Analyses were run using structural equation models, controlling by gender, intelligence, age, socioeconomic status, and school. EC was positively and directly related to social adaptation in school. EC was also indirectly related to academic achievement and social adaptation through LRBs. The findings highlight the potential relevance of children's EC and LRBs for adjustment in elementary school

    Arousal and Executive Alterations in Attention Deficit Hyperactivity Disorder (ADHD)

    Attention deficit hyperactivity disorder (ADHD) is the most common neurobehavioral disorder in childhood and can significantly affect a child’s personal and social development and academic achievement. Taking into account the model of attentional networks proposed by Posner et al., the aim of the present study was to review the literature regarding two main explicative models of ADHD, i.e., the inhibition model and the cognitive-energetic model, by discussing behavioral and neurological evidence of both models and the limitations of each model. The review highlights evidence that favors the energetic model and points to an unstable arousal as a potential pathogenetic factor in ADHD

    Assessing children’s empathy through a Spanish adaptation of the Basic Empathy Scale: parent’s and child’s report forms

    The aim of the current research was to study cognitive and affective empathy in children aged 6–12 years old, and their associations with children’s family environment and social adjustment. For this purpose, we developed the Spanish version of the Basic Empathy Scale (BES), self- and parent-report forms. Factorial analyses confirmed a two-component model of empathy in both self- and parent-report forms. Concordance between parent–child measures of empathy was low for cognitive and affective factors. Analyses of variance on the cognitive and affective components brought a significant effect of age for self-reported cognitive empathy, with older children scoring higher than younger ones. Gender brought out a significant principal effect for self-reported affective empathy, with girls scoring higher than boys. No other main effects were found for age and gender for the rest of the factors analyzed. Children’s empathy was associated with socioeconomic status and other family socialization processes, as well as children’ social behaviors. Overall the new measures provided a coherent view of empathy in middle childhood and early adolescence when measured through self and parent reports, and illustrate the similarity of the validity of the BES in a European-Spanish culture

    Is Qualitative Research in Education Being Lost in Spain? Analysis and Reflections on the Problems Arising from Generating Knowledge Hegemonically

    In this paper we reflect on how qualitative research in education in Spain has become invisible, by asking a series of questions. What are the effects of this? What are the keys to understand this marginalisation of qualitative research? What are the implications for researchers and students? What challenges does qualitative research face in order to overcome this lack of visibility? To discuss these issues, we present a series of structured reflections in the form of an essay based on the preliminary impressions that have emerged in the course of a broader investigation that we are conducting and that focuses on the state of qualitative research in education in Spain. Our intention is, on the one hand, to offer a vision of the Spanish panorama to the international community, and on the other hand, to transfer the ideas that have emerged during the course of the research that we are developing to serve as a reflection and resource to other qualitative researchers

    Effect of cultivation method and processing on total polyphenols content and antioxidant capacity of tomatoes (Solanum lycopersicum)

    Tomato is an important dietary source of polyphenols. Factors such as cultivation method and heat can affect its composition. The objective of this study was to determine changes of polyphenol content and antioxidant capacity in tomatoes obtained from different production method (organic vs. conventional), before and after being cooked. Methods: Total polyphenols and antioxidant capacity were measured in fresh and processed tomatoes from two cultivation methods, using spectrophotometric techniques. Results: Antioxidant capacity was higher (p conventional 15,39 mg Fe+2/g). No significant difference in polyphenol content according to method of cultivation was found (organic 3,8 μg GAE/g > conventional 3,2 μg GAE/g). Measured parameters were not significantly affected by physical and mechanical processing in tomatoes from both cultivation methods. Discussion: A tendency towards better phytochemical properties in organic tomatoes were found in our study, which is consistent with existing literature. Antioxidant compounds in organic samples appear to be more resistant to processing. Conclusion: It is necessary to deepen the study of organic and conventional tomatoes, in order to get more evidence on its nutritional quality.Fil: Peralta, Mariana Isabel.
