ОКРЕМІ АСПЕКТИ ВИКОРИСТАННЯ ІМІДЖЕВОГО ПРАВА В ГОЛОГРАМАХ: СВІТОВИЙ ДОСВІД ТА ПРОБЛЕМИ ЗАКОНОДАВЧОГО РЕГУЛЮВАННЯ УКРАЇНИ
The goals of the study are due to the need to analyze the shortcomings of the Ukrainian legislation on image rights and to consolidate this not only at the national doctrinal level, but also in the normative acts as a basis for celebrities to conclude contracts and protect their rights in commercial relations.
Today, there is a tendency to form relationships about the use of celebrity image, but there is no legal mechanism in place to settle disputes to protect their image rights, or to profit from their legitimate use. Analyzing the experience of lawmaking in the countries of the Anglo-American legal family, it should be noted that the success of protecting their image rights is to create a stable contractual mechanism and the ability to challenge the use of another's image. An important aspect is the use of celebrity image in holograms.
Given the needs of technocratic society and the development of information technology, it is appropriate to develop scientific provisions and study the concept of image rights, as a basis for the formation of a new legislation that can regulate the relationship of use of the image of the individual.
Methods used in this work: historical, comparative, classification, generalization and abstraction. Each of these logical and philosophical methods has been used in the study to understand and qualitatively explain to the general public the concept of "image rights".
This article reveals the concept of "image rights" and its components. The study revealed the most popular area of use of image rights - the hologram. Possibilities for elaboration of legislative regulation of legal deficiencies on protection and restoration of image rights have been opened and analyzed. Responses are given to the specifics of the possibility of inheriting and transferring image rights to third parties.Los objetivos del estudio se deben a la necesidad de analizar las deficiencias de la legislación ucraniana sobre derechos de imagen y consolidar esto no solo a nivel doctrinal nacional, sino también en los actos normativos como base para que las celebridades celebren contratos y protejan sus derechos en las relaciones comerciales. Hoy en día, existe una tendencia a establecer relaciones sobre el uso de la imagen de celebridades, pero no existe un mecanismo legal para resolver disputas para proteger sus derechos de imagen o para beneficiarse de su uso legítimo. Dadas las necesidades de la sociedad tecnocrática y el desarrollo de la tecnología de la información, es apropiado desarrollar disposiciones científicas y estudiar el concepto de derechos de imagen, como base para la formación de una nueva legislación que pueda regular la relación de uso de la imagen de la imagen. individual. Se dan respuestas a los detalles de la posibilidad de heredar y transferir derechos de imagen a terceros.Цілі дослідження обумовлені нагальною потребою у аналізі прогалин українського законодавства щодо регулювання іміджевого права та закріплення цього поняття не лише на національному доктринальному рівні, а й у нормативних актах, як базису для знаменитостей щодо укладення договорів та захисту своїх прав у комерційних правовідносинах.
На сьогоднішній день, існує тенденція до утворення відносин щодо використання образу знаменитостей, однак немає діючого правового механізму щодо врегулювання різноманітних спорів для захисту своїх іміджевих прав, або можливості отримання прибутку внаслідок їх правомірного використання. Враховуючи досвід законотворчості у країнах англо-американської правової сім’ї, необхідно зауважити, що успішність захисту своїх іміджевих прав полягає в утворенні стійкого договірного механізму та можливості оспорювання використання чужого образу. Важливим є аспект використання образу знаменитостей у голограмах.
З урахуванням потреб технократичного суспільства та розвитку інформаційних технологій, вбачається доречним розробка наукових положень та дослідження поняття іміджевого права, як фундаменту для утворення якісно нового законодавства, яке може врегулювати відносини використання образу особи.
Методи, що використовувалися у даній роботі: історичний, порівняльно-правовий, класифікації, узагальнення та абстрагування. Кожен з цих логіко-філософських методів застосовувався у дослідженні для усвідомлення та якісного пояснення широкій аудиторії поняття «іміджеве право».
Дана стаття розкриває поняття «іміджеве право» і його складові. Дослідженням розкрито найбільш популярну сферу використання іміджевих прав – голограму. Розкрито та проаналізовано можливості розробки законодавчого врегулювання юридичних прогалин щодо захисту та відновлення іміджевого права. Дано відповіді щодо специфіки можливості успадкування та передачі іміджевих прав третім особам
Metallophenolomics: A Novel Integrated Approach to Study Complexation of Plant Phenolics with Metal/Metalloid Ions
Plant adaptive strategies have been shaped during evolutionary development in the constant interaction with a plethora of environmental factors, including the presence of metals/metalloids in the environment. Among adaptive reactions against either the excess of trace elements or toxic doses of non-essential elements, their complexation with molecular endogenous ligands, including phenolics, has received increasing attention. Currently, the complexation of phenolics with metal(loid)s is a topic of intensive studies in different scientific fields. In spite of the numerous studies on their chelating capacity, the systemic analysis of phenolics as plant ligands has not been performed yet. Such a systematizing can be performed based on the modern approach of metallomics as an integral biometal science, which in turn has been differentiated into subgroups according to the nature of the bioligands. In this regard, the present review summarizes phenolics-metal(loid)s' interactions using the metallomic approach. Experimental results on the chelating activity of representative compounds from different phenolic subgroups in vitro and in vivo are systematized. General properties of phenolic ligands and specific properties of anthocyanins are revealed. The novel concept of metallophenolomics is proposed, as a ligand-oriented subgroup of metallomics, which is an integrated approach to study phenolics-metal(loid)s' complexations. The research subjects of metallophenolomics are outlined according to the methodology of metallomic studies, including mission-oriented biometal sciences (environmental sciences, food sciences and nutrition, medicine, cosmetology, coloration technologies, chemical sciences, material sciences, solar cell sciences). Metallophenolomics opens new prospects to unite multidisciplinary investigations of phenolic-metal(loid) interactions

Soil Development and Organic Carbon Stocks Across a Lithosequence in the Perhumid Coastal Temperate Rainforests of Southeast Alaska
The perhumid coastal temperate rainforests of southeast Alaska contain an abundance of soil organic carbon (SOC) that has accumulated in a wet, cool climate where forest fire disturbance is minimal and organic matter decomposition rates are low. Coastal temperate rainforests are supported by carbon-rich soils that provide ecosystem services including nutrient cycling, climate regulation, habitat and food for wildlife, salmon habitat, and recreation. The objective of our research was to examine how lithology and bioclimatic factors influence total SOC abundance, soil development, and carbon distribution with depth in upland soils formed in a coastal temperate rainforest environment. A lithosequence was established across 18 sites that encompassed three contrasting lithologies: slate, metavolcanics, and phyllite. Soils from the lithosequence were collected from mid-backslope positions on north and south facing hillslopes in the Tongass National Forest near Juneau, Alaska. Our approach combined field-based soil morphological descriptions with laboratory analyses to determine total carbon and nitrogen percent, soil pH, bulk density, and particle size distribution. SOC stocks, profile development indices (PDI), and the POD index were calculated for each soil profile sample analyzed in the study. Our study presents evidence for the formation of deep, fine to coarse-textured Spodosols on steep (31 to 80%) backslopes in frequently dissected, deeply and shallowly incised, smooth mountain slopes, broken mountain slopes, and hills. The soils contained a high percentage of coarse rock fragments (51.8% ± 20.4) with thin, broken E horizons and thick subsurface, spodic horizons. The soils are well-developed with PDIs ranging from 14.50 ± 6.62 to 26 ± 5.27 and POD index values spanning 8.25 ± 0.35 to 14.10 ± 18.80 across all sites. The PDI and POD indices did not significantly differ among the lithologies although we did observe that metavolcanics contained significantly more very fine sand compared to slate and phyllite. Slate contained significantly more very coarse sand compared to metavolcanics and phyllite. The accumulation of SOC was consistent across the three lithologies with averages of 182 ± 15.70 Mg ha-1 for slate, 181 ± 49 Mg ha-1 for metavolcanic, and 218 ± 124 Mg ha-1 for phyllite. However, we did find soils formed in slate has less variation in SOC (coefficient of variation (CV) of 9) compared to phyllite or metavolcanic (CV of 57 and 27, respectively). We found that the maximum clay and carbon values co-occurred in the uppermost Bh or Bhs horizons in 67% of the soil profiles studied. We also found that over 60% of SOC accumulated in the B horizons. We predict that well-developed soils and SOC accumulation resulted from coupled bioclimatic properties including the cool climate, abundant precipitation, and the organic inputs from acidic vegetation (i.e., forest floor debris, roots). We speculate that soil depth and physical disturbance events such as tree throw and colluvium deposition influences SOC stocks covariance suggesting total pedon depth and disturbance events influence SOC stock totals as well as variance. We emphasize the importance of including measures of deep soil C found in the spodic horizons when assessing SOC across landscapes to account for total SOC in temperate rainforest environments. Our work addressed a need to advance knowledge of how soils develop in steep, hilly, upland soils while also improving understanding of SOC distribution in understudied yet ecologically valued coastal rainforest systems
Peculiarities of mental and behavioral disorders due to use of designer drugs among young population and problems of early diagnostics (literature review).
The analysis of the data of the domestic and foreign literature regarding the dynamics of narcotization among children and adolescents is carried out. It has been established that at present the growth rates of the use of psychoactive substances by minors far outstrip those of the adult population. It is also determined that in most cases "adult" drug addiction is formed in a teenage environment and therefore adolescents are a group of high-risk narcotization. Besides, new types of additions are constantly added: non-opioid analgetics, antidepressants, pharmacy products based on medicinal plants with stimulating or sedative properties, new means of perfumery and household chemicals, volatile organic compounds, etc. In this regard, in the clinical picture of drug intoxication, new variations of affective, psycho-organic and psychosomatic effects and complications are noted. In recent years, synthetic cannabinoids has rapidly gained "popularity" among young people that are successfully promoted by marketers. They are the part of the so-called designer drugs, appearing in the markets in the form of bath salts, flavors, fertilizers for indoor plants and "smoking mixtures" - spices. The publications of domestic and foreign authors give a lot of evidence of the ability of these substances not only to cause a state of intoxication, alienation, relaxation, but also leads to dependence on them with severe consequences for the psyche and all organism as a whole. Thus, the powerful anthropogenic damaging effect of designer drugs demonstrates concrete signals of a threat to health, demography and the economy of the society as a result of their use by the population
