Nonparametric models of financial leverage decisions
This paper investigates the properties of nonparametric decision tree models in the analysis of financial leverage decisions. This approach presents two appealing features: the relationship between leverage ratios and the explanatory variables is not predetermined but is derived according to information provided by the data, and the models respect the bounded and fractional nature of leverage ratios. The analysis shows that tree models suggest relationships between explanatory variables and the relative amount of issued debt that parametric models fail to capture. Furthermore, the significant relationships found by tree models are in most cases in accordance with the effects predicted by the pecking-order theory. The results also show that two-part tree models can accommodate better the distinct effects of explanatory variables on the decision to issue debt and on the amount of debt issued by firms that do resort to debt.Capital structure, Fractional regression, Decision trees, Two-part models

Neste artigo, propomo-nos acompanhar a trajetória social e política do mercador Fernão Gonçalves Façanha que desenvolveu a sua atividade profissional em Évora, uma das mais relevantes cidades do Portugal medieval, na segunda metade de Trezentos. Trata-se de um poderoso homem de negócios que passou por diversos cargos na administração municipal e em outras instituições urbanas, assumindo um forte protagonismo na vida pública da cidade. Apesar da crise e das conturbações que marcaram uma boa parte do tempo em que viveu, Fernão Gonçalves irá conhecer um processo de enriquecimento e de afirmação social, que progressivamente o aproximará do grupo dirigente. O seu percurso reveste-se de bastante interesse historiográfico, constituindo um bom exemplo de alguém que soube aproveitar as oportunidades de um contexto amplamente favorável à mobilidade, para iniciar um processo ascensional assente na riqueza material, mas onde o quadro relacional e as opções políticas se revelam igualmente essenciais.In this paper, we intend to follow the social and political trajectory of the merchant Fernão Gonçalves Façanha who conducted his professional activity in Évora, one of the most important cities of medieval Portugal, in the second half of the 14th century. This is a powerful businessman who held various positions in the municipal administration and in other urban institutions and played a relevant role in the public life of the city. Despite the crisis and the troubles that have marked much of the time in which he lived, Fernão Gonçalves will experience a process of enrichment and social empowerment, which will progressively bring him closer to the leading group. His route is of great historiographical interest, as it constitutes a good example of someone who knew how to take advantage of the opportunities of a context which was largely favorable to mobility and, to start a process of social ascent based on material wealth, but where the relational framework and political options are equally essential

Governar a cidade e servir o rei: a oligarquia concelhia de Évora em tempos medievais (1367-1433)
A dissertação centra-se no estudo dos indivíduos, e dos respetivos grupos de parentesco, que controlaram o poder municipal da cidade de Évora no período correspondente aos reinados de D. Fernando e de D. João I, nele se incluindo a crise dinástica. Um período vivido intensamente numa cidade que teve um papel revelante em todo esse processo. No estudo procuram-se avaliar os reflexos desta conjuntura ao nível da administração municipal, tentando identificar continuidades e ruturas. Sobretudo as continuidades, já que a crise não só não interrompeu, como acentuou as linhas de ação que se vinham a desenhar anteriormente, assistindo-se também à manutenção do mesmo grupo à frente dos destinos municipais. Grupo que, de uma forma clara e efetiva, apoiou a causa do Mestre, tendo visto reforçado o seu papel governativo e as suas posições sociais.
Num quadro marcado pelo reforço da intervenção régia na administração municipal da cidade de Évora, quer sob o ponto de vista do seu funcionamento, quer mesmo na ordenação interna do quadro social governativo, de que o Regimento e a nomeação dos Regedores são paradigmáticos, estes homens, aproveitando um contexto excecional, e a forte proximidade com a coroa, encetaram, a partir de mecanismos que se procuram identificar, processos ascensionais que os aproximarão dos grupos privilegiados. Assistiu-se, assim, a um claro processo nobilitação do ambiente concelhio eborense; GOVERNING THE CITY AND SERVING THE KING.
THE MUNICIPAL OLIGARCHY OF ÉVORA IN MEDIEVAL TIMES

Abstract:
This dissertation focuses on the study of a group of individuals and their respective families who controlled the municipal government of the city of Évora in the period corresponding to the reigns of Ferdinand and John I, specifically from 1367 to 1433, and which comprises the dynastic crisis. In this context, the men who were leading the municipality assumed a relevant role in supporting the cause of the Master and, therefore, enhanced their governance role and their social status.
By leveraging an exceptional context, and the strong proximity to the crown, these men embarked, through mechanisms that we seek to identify, in ascending processes that have drawn them near to the privileged groups, which is a clear process of aristocratization of the Évora municipal setting
Multi-temporal SAR Interferometry for Monitoring of Man-Made Sfructures.
Multi-temporal InSAR (MTI) methods are effective tools for monitoring and investigating surface displacement on Earth based on conventional radar interferometry. These techniques allow us to measure deformation with uncertainties up to one millimeter per year, interpreting time series of interferometric phases at coherent/stable point scatterers. Considering the regular revisit time and wide-area coverage of satellite radar sensors, and that stable points usually correspond to buildings and other man-made structures, these techniques are particularly suitable for application in urban environments. In this paper we present some examples of the application of MTI techniques to study the stability of port structures and one example of dam monitoring. These promising results make it possible to think in the development of an interferometric methodology using the new high-resolution synthetic aperture radar satellites scenes for structural health monitoring
Os efeitos das decisões judiciais no processo penal
Dissertação de mestrado em Direito JudiciárioPretendeu-se no início deste estudo saber se e quais os efeitos que as decisões
judiciais podiam produzir no processo penal. No decurso da investigação entendemos
que não se podia deixar de lado, nesta investigação, uma outra vertente que tinha de ser
analisada e que se traduzia na suscetibilidade das decisões proferidas no processo penal
produzirem efeitos no processo penal (noutro processo que não o onde foi proferida a
decisão). Como esta variante inicialmente não estava pensada mas se encaixa
precisamente no objeto do tema e escopo deste estudo, que é o de saber quais os efeitos
que as decisões produzem no processo penal, também esta vertente foi devidamente tida
em conta, estudada e devidamente considerada no que aos efeitos das decisões judiciais
produzem no processo penal.
A ordem jurídica é composta por todos os ramos do direito que têm de existir
como um todo que se liga devidamente imbrincado, em unidade. Assim sendo, as
decisões judiciais proferidas em qualquer ramo de direito têm de se harmonizar entre si
para que não haja qualquer espécie de conflito entre elas, em obediência ao princípio da
unidade da ordem jurídica. As decisões judiciais proferidas no foro administrativo,
fiscal, falencial, contraordenacional para que possam produzir efeitos no processo penal,
pois não poderão ser meios de prova, têm de transitar em julgado. No foro penal, a
decisão judicial para não poder ser suscetível de recurso, pelo menos, em primeira
instância tem de ser notificada obrigatoriamente ao arguido e ao seu mandatário ou
defensor oficioso.
Os efeitos das decisões judiciais proferidas noutros ramos do direito no processo
penal, por força dos princípios próprios do processo penal dos quais se destacam aqui o
princípio da presunção da inocência, o princípio in dúbio pro reo e do princípio da
unidade da ordem jurídica, são o de poderem funcionar, em determinados casos, para o
direito penal como uma verdadeira causa de exclusão de ilicitude, por força do disposto
no artigo 31.º n.º 1 do Código Penal. As decisões proferidas em processo penal poderão
ter o efeito, em determinadas circunstâncias, de possibilitar a revisão extraordinária de
decisão penal transitada em julgado.The initial purpose of this study was to determine which effects judicial
decision-making could produce on criminal procedure. During the
research it was understood that we could not set aside, in this research, another aspect
that had to be analysed regarding the susceptibility of judicial decisions in a criminal
process having an effect on criminal procedure (in other cases in which such decision
was not pronounced). As this variant was not initially considered but fitting the
objective and scope of this study, which is to know the effects decision making
produces in criminal procedure, this aspect was also properly taken into account,
studied and suitably considered concerning the effects that judicial decision making
produces on criminal procedure.
The legal order consists of all the fields of law that need to stand as a whole,
fittingly interwoven as one unit. Thus, any legal judgments in any field of law have to
harmonize with each other so that no conflict whatsoever should exist among them in
accordance with the principle of unity of the legal
system. Judgements pronounced in matters of administrative and fiscal disputes,
bankruptcy courts, and misdemeanours, to have an effect on the criminal process, as
they may not be means of evidence, have to be no longer subject to appeal (Res
Judicata). In criminal law, the judicial decision, not to be subject to appeal, at least in
the first instance, must necessarily be notified to the accused as well as his
representative or defence attorney.
The effects of judgements handed down in other fields of law on the criminal
process, by virtue of the very principles of criminal procedure of which the principle of
presumption of innocence, the principle in dubio pro reo, and the principle of unity of
the legal system, are able to work, in certain cases, to criminal law as a real cause for
the exclusion of unlawfulness, by virtue of what is stated under article 31, No 1 of the
Criminal Code. Judgements pronounced in the criminal process may have the effect, in
some circumstances, of allowing the extraordinary revision of a penal decision that has
become final
