Case C-852/19, Gavanozov II: European Investigation Order and the Right to an Effective Remedy in the CFREU
The European Investigation Order (EIO) was established by Directive 2014/41/EU. In 2019, the Court of Justice of the European Union (CJEU) made its first ruling on this new mechanism for judicial cooperation in criminal matters in Case C-324/17, Gavanozov. However, legal experts criticized the decision because it didn't address Article 47 of the Charter of Fundamental Rights of the European Union (CFREU). The ruling left unanswered questions for the Bulgarian Court, which prompted a new preliminary reference on the lack of legal remedies to challenge investigative measures in the EIO under Bulgarian criminal procedure law. This led to Case C-852/19, Gavanozov II, where the CJEU was more attentive to fundamental rights and determined that an EIO cannot be issued without the ability to contest the grounds and necessity of the investigation. This article aims to analyze the legal dispute in the Gavanozov II Case, including the impact of the ruling on November 11, 2021, relevant doctrine, and the applicability of Article 47 of the CFREU

Flexibilização em sistemas distribuídos: uma perspectiva holística
Doutoramento em Engenharia InformáticaEm sistemas distribuídos o paradigma utilizado para interacção entre tarefas é
a troca de mensagens. Foram propostas várias abordagens que permitem a
especificação do fluxo de dados entre tarefas, mas para sistemas de temporeal
é necessário uma definição mais rigorosa destes fluxos de dados.
Nomeadamente, tem de ser possível a especificação dos parâmetros das
tarefas e das mensagens, e a derivação dos parâmetros não especificados.
Uma tal abordagem poderia permitir o escalonamento e despacho automático
de tarefas e de mensagens, ou pelo menos, poderia reduzir o número de
iterações durante o desenho do sistema. Os fluxos de dados constituem uma
abordagem possível ao escalonamento e despacho holístico em sistemas
distribuídos de tempo-real, onde são realizadas diferentes tipos de análises
que correlacionam os vários parâmetros. Os resultados podem ser utilizados
para definir o nível de memória de suporte que é necessário em cada nodo do
sistema distribuído.
Em sistemas distribuídos baseados em FTT, é possível implementar um
escalonamento holístico centralizado, no qual se consideram as
interdependências entre tarefas produtoras/consumidoras e mensagens. O
conjunto de restrições que garante a realização do sistema pode ser derivado
dos parâmetros das tarefas e das mensagens, tais como os períodos e os
tempos de execução/transmissão. Nesta tese, são estudadas duas
perspectivas, uma perspectiva centrada na rede, i.e. em que o escalonamento
de mensagens é feito antes do escalonamento de tarefas, e outra perspectiva
centrada no nodo.
Um mecanismo simples de despacho de tarefas e de mensagens para
sistemas distribuídos baseados em CAN é também proposto neste trabalho.
Este mecanismo estende o já existente em FTT para despacho de mensagens.
O estudo da implementação deste mecanismo nos nodos deu origem à
especificação de um núcleo de sistema operativo. Procurou-se que este
introduzisse uma sobrecarga mínima de modo a poder ser incluído em nodos
de baixo poder computacional.
Neste trabalho, é apresentado um simulador, SimHol, para prever o
cumprimento temporal da transmissão de mensagens e da execução das
tarefas num sistema distribuído. As entradas para o simulador são os
chamados fluxos de dados, que incluem as tarefas produtoras, as mensagens
correspondentes e as tarefas que utilizam os dados transmitidos. Utilizando o
tempo de execução no pior caso e o tempo de transmissão, o simulador é
capaz de verificar se os limites temporais são cumpridos em cada nodo do
sistema e na rede.In distributed systems the communication paradigm used for intertask
interaction is the message exchange. Several approaches have been proposed
that allow the specification of the data flow between tasks, but in real-time
systems a more accurate definition of these data flows is mandatory. Namely,
the specification of the required tasks’ and messages’ parameters and the
derivation of the unspecified parameters have to be possible. Such an
approach could allow an automatic scheduling and dispatching of tasks and
messages or, at least, could reduce the number of iterations during the
system’s design. The data streams present a possible approach to the holistic
scheduling and dispatching in real-time distributed systems where different
types of analysis that correlate the various parameters are done. The results
can be used to define the level of buffering that is required at each node of the
distributed system.
In FTT-based distributed systems it is possible to implement a centralized
holistic scheduling, taking into consideration the interdependences between
producer/consumer tasks and messages. A set of constraints that guarantee
the system feasibility can then be derived from tasks and messages’
parameters such as the periods and execution/transmission times. In this thesis
the net-centric perspective, i.e., the one in which the scheduling of messages is
done prior to the scheduling of tasks, and the node-centric perspectives are
studied.
A simple mechanism to dispatch tasks and messages for CAN-based
distributed systems is also proposed in this work. This mechanism extends the
one that exists in the FTT for the dispatching of messages. The study of the
implementation of this mechanism in the nodes gave birth to the specification of
a kernel. A goal for this kernel was to achieve a low overhead so that it could
be included in nodes with low processing power.
In this work a simulator to preview the timeliness of the transmission of
messages and of the execution of tasks in a distributed system is presented.
The inputs to the simulator are the so-called data streams, which include the
producer tasks, the correspondent messages and the tasks that use the
transmitted data. Using the worst-case execution time and transmission time,
the simulator is able to verify if deadlines are fulfilled in every node of the

Prevalência do consumo de drogas ilícitas nas Forças Armadas estudo epidemiológico num dos ramos
RESUMO: Desde 1976 que as Forças Armadas desenvolvem acções de prevenção do consumo de drogas e álcool. Na década de 80 foi criada capacidade laboratorial e deu-se início a um programa de rastreios toxicológicos. No quinquénio 2001 a 2005, as proporções de resultados positivos, associando todos os tipos de rastreio, variaram entre 3,7% e 1,5%. De Outubro de 2006 a Julho de 2007 realizou-se um estudo analítico transversal, para estimar a prevalência do consumo de drogas (canabinóides, opiáceos, cocaína e anfetaminas) num dos Ramos das Forças Armadas, com base nos despistes realizados pelo seu laboratório. Foi utilizada uma amostra aleatória simples de 1039 militares, profissionais (QP) e contratados (RC), no activo e de ambos os sexos. Desde a nomeação dos militares a rastrear, passando pela cadeia de custódia das amostras até à obtenção do resultado foi utilizado apoio informático específico. O processo de pesquisa utilizou duas técnicas de triagem por imunoensaio e tecnologia de confirmação por GC/MS, de acordo com as recomendações europeias, permitindo estabelecer uma metodologia standard para organizações e empresas. A prevalência estimada, de consumidores de droga, foi de 3,8/1.000, para um erro de 0,37%. O número de casos registado (4) não permitiu a utilização de testes estatísticos que conduzissem à identificação de características determinantes da positividade, mas não deixou de revelar aspectos inesperados. A observação de séries de casos e a realização regular de estudos epidemiológicos, que ajudem a redefinir grupos alvo e a perceber a dimensão, as determinantes e as consequências do consumo de drogas é sugerida, em conclusão.---------------------------------------
RÉSUMÉ: Depuis 1976, les Forces Armées mettent au point des mesures visant à prévenir la consommation de drogues et d'alcool. En 1980, fut créé capacité laboratoriel et ont ensuite commencé un programme de dépistage toxicologique. Au cours des cinq années allant de 2001 à 2005, les proportions de consommateurs, impliquant tous les types de dépistage, allaient de 3,7% à 1,5 %. D'octobre 2006 à juillet 2007, une étude analytique transversale a été organisée pour évaluer la prévalence de l’usage de drogues (cannabis, opiacés, cocaïne et amphétamines) dans une branche de les Forces Armées, basée sur les dépistages faites par un laboratoire militaire, à l'aide d'un échantillon aléatoire de 1039 militaires, professionnels (QP) et sous contract (RC), à l’actif et des deux sexes. Tout au long du procès, de la nomination des donneurs, en passant par la chaine de garde des échantillons, jusqu’à obtention du résultat, il fut employé un appui informatique sécurisé. Le processus de recherche employa deux techniques de tri par imunoessay et la technologie de confirmation GC/MS, selon les recommandations européennes, permettant d'établir une méthodologie standard pour les organisations et les entreprises. La prévalence estimée fut de 3,8/1.000 pour une marge d’erreur de 0,37%. Le nombre de cas enregistrés (4) n'autorise pas l'utilisation de testes statistiques de menant à l'identification de caractéristiques déterminant de la positivité, mais il permet à révéler des aspects inattendus. L'observation de séries de cas et la tenue régulière d’études épidémiologiques, qui contribuent à redéfinir les groupes cibles et de comprendre l'ampleur, les déterminants et les conséquences de l'usage de drogues, est suggéré, en fin de compte.--------------------------------------- ABSTRACT: Since 1976, the Armed Forces, have been developing measures to prevent the use of drugs and alcohol. In 1980, was created laboratory facility which then started a program of toxicological screenings. In the five years running from 2001 to 2005, the proportions of consumers, involving all types of screening, ranged from 3,7% to 1,5%. From October 2006 to July 2007, a cross-sectional study was held to estimate the prevalence of drug use (cannabinoids, opiates, cocaine and amphetamines) in one branch of the Portuguese Armed Forces, based on laboratory screenings, using a random sample of 1039 military, professional (QP) and enlisted (RC), active-duty and of both sexes. Specific computer support was used all the way, from the appointment, including the chain of custody of samples, to the obtaining of the result. The process of search used two techniques for sorting by immunoassay and confirmation technology GC/MS, according to European recommendations, allowing to establish a standard methodology for organizations and companies. The estimated prevalence of drug users was 3.8/1.000 for a 0.37% error (95% confidence interval). The number of cases registered (4) does not permit use of statistical testing leading to the identification of characteristics weighing in the establishing to extrapolate for the population, but it allows revealing unexpected aspects. The observation of series of cases and the regular holding of epidemiological studies, which help redefine target groups and to understand the extent, the determinants and consequences of drug use, is suggested, in conclusion

The influence of relationship quality and culture in the relations between exporter and distributor : the case of portuguese exports to Angola
The objective of this research is to investigate the role of the relationship quality, cooperation and culture between Portuguese companies and their export market intermediaries in Angola. In particular, we aim to understand the importance that the quality of the relationship has in cooperation and the role of cultures in export activities.
An important aspect of this study is precisely the fact that it includes an African country, where, in terms of the literature, there is a strong lack of studies.
In terms of methodology we opted for qualitative analysis; we present the results of two case studies of Portuguese exporting companies and one case study of Angolan intermediate.
In general, the results are that the business relationships are characterized by trust, commitment, cooperation, culture, similar values, as in the past, Angola belonged to Portugal there is easy communication because both countries share the same. Such factors will influence the trade relations between Portuguese exporters and their Angolan distributors
