México: instituciones constitucionales, democracia y cambio

El presente es un estudio sobre nuestras instituciones constitucionales a partir del análisis de las propuestas de diversos politólogos nacionales y extranjeros sobre el sistema político mexicano. Inicia con las opiniones de Linz, Shugar y Sartori sobre los sistemas que, institucionalmente, facilitan la aparición y consolidación de la democracia. Continúa con un análisis de la Constitución mexicana de 1917 y realiza un balance sobre su aplicación, aplicabilidad e influencia en el sistema político mexicano y viceversa. Culmina con una serie de conclusiones y propuestas sobre posibles reformas a nuestro entramado estatal.This is an essay about the topic of political Systems. Bases on the ideas of Linz, Shugart and Sartori, what the author is looking for is just to try to show the influence of the Mexican Constitution in the political System and the influence of this in the structure of the Mexican State. The second part is focused on the analysis of the current constitutional norms and the posibility to change them. Finally, the author offer several conclusions and proposals of constitutional reforms

El fortalecimiento de la autonomía de los órganos electorales

The article discusses the conflict generated by the electoral powers conferred on the Political Constitution of the United Mexican States (CPEUM) and the Federal District Legislative Assembly (ALDF), which arises with the appointment of the positions of chair adviser and electoral advisers for the Federal District. The author describes the case in detail, outlining the regulatory amendments that were made, the injunction processes that took place and ends by presenting the resolution that was passed by the Supreme Court. The text delves into the analysis of the concepts of “independence” and “autonomy”. It argues that in the case of electoral institutions it is not an absolute but a relative concept; it also debates who the electoral entities are independent of.El artículo expone el conflicto generado entre las atribuciones en materia electoral de la Constitución Política de los Estados Unidos Mexicanos (CPEUM) y la Asamblea Legislativa del Distrito Federal (ALDF), el cual surge con el nombramiento de los cargos de Consejero Presidente y Consejeros Electorales para el Distrito Federal. El autor describe con minuciosidad el caso, detallando las modificaciones normativas que se emitieron, los procesos de impugnación que se realizaron, y finaliza mostrando la resolución dictada por la Suprema Corte de Justicia. El texto ahonda en el análisis de los conceptos de «independencia» y «autonomía». Sostiene que en el caso de los órganos electorales no es un concepto absoluto sino relativo; asimismo, participa en el debate respecto de qué o quién son independientes los institutos electorales

Jurisprudencia sobre la prueba en el derecho electoral federal mexicano

Based on the analysis of the many sentences emitted by Mexico’s Electoral Tribunal of the Federal Judiciary over the last twenty years, the article addresses the principles that can be applied with regard to evidence in the electoral domain. Subsequently it defines and discusses the recognized forms of evidence, then it delves into documentary evidence (public and private documents), technical evidence, expert evidence, and deduced evidence. Then, it analyzes the performance tools and supervening evidence, and concludes with the assessment of evidence and the means to provide better evidence. In summary, in this work you can appreciate the importance of the law of electoral processes and the role of the means of evidence.A partir del análisis de las numerosas sentencias que el Tribunal Electoral del Poder Judicial de la Federación de México ha emitido a lo largo de los últimos veinte años, el artículo desarrolla los principios aplicables en materia de pruebas en el ámbito electoral. A continuación define y expone los medios de prueba reconocidos, luego se desarrolla la prueba documental (documentos públicos y privados), la prueba técnica, la prueba pericial, la prueba por presunciones. Posteriormente, se analiza la instrumental de actuaciones y las pruebas supervenientes, para concluir con la valoración probatoria y las diligencias para mejor proveer. En síntesis, en este trabajo se puede apreciar la importancia del derecho electoral procesal y el papel de los medios de prueba

The effects of interset rest on adaptation to 7 weeks of explosive training in young soccer players

The aim of the study was to compare the effects of plyometric training using 30, 60, or 120 s of rest between sets on explosive adaptations in young soccer players. Four groups of athletes (age 10.4 ± 2.3 y; soccer experience 3.3 ± 1.5 y) were randomly formed: control (CG; n = 15), plyometric training with 30 s (G30; n = 13), 60 s (G60; n = 14), and 120 s (G120; n = 12) of rest between training sets. Before and after intervention players were measured in jump ability, 20-m sprint time, change of direction speed (CODS), and kicking performance. The training program was applied during 7 weeks, 2 sessions per week, for a total of 840 jumps. After intervention the G30, G60 and G120 groups showed a significant (p = 0.0001 – 0.04) and small to moderate effect size (ES) improvement in the countermovement jump (ES = 0.49; 0.58; 0.55), 20 cm drop jump reactive strength index (ES = 0.81; 0.89; 0.86), CODS (ES = -1.03; -0.87; -1.04), and kicking performance (ES = 0.39; 0.49; 0.43), with no differences between treatments. The study shows that 30, 60, and 120 s of rest between sets ensure similar significant and small to moderate ES improvement in jump, CODS, and kicking performance during high-intensity short-term explosive training in young male soccer players

Large-scale patterns of turnover and basal area change in Andean forests

General patterns of forest dynamics and productivity in the Andes Mountains are poorly characterized. Here we present the first large-scale study of Andean forest dynamics using a set of 63 permanent forest plots assembled over the past two decades. In the North-Central Andes tree turnover (mortality and recruitment) and tree growth declined with increasing elevation and decreasing temperature. In addition, basal area increased in Lower Montane Moist Forests but did not change in Higher Montane Humid Forests. However, at higher elevations the lack of net basal area change and excess of mortality over recruitment suggests negative environmental impacts. In North-Western Argentina, forest dynamics appear to be influenced by land use history in addition to environmental variation. Taken together, our results indicate that combinations of abiotic and biotic factors that vary across elevation gradients are important determinants of tree turnover and productivity in the Andes. More extensive and longer-term monitoring and analyses of forest dynamics in permanent plots will be necessary to understand how demographic processes and woody biomass are responding to changing environmental conditions along elevation gradients through this century

La omisión legislativa y su inconstitucionalidad en México.

A partir de la discusión sobre la posibilidad o imposibilidad de aplicar aquellos artículos de la Constitución acerca de los cuales no existe legislación secundaria que desarrolle su contenido, el autor presenta un estudio sobre la inconstitucionalidad por omisión legislativa. En primer lugar, analiza la supremacía constitucional y la llamada "defensa de la Constitución". Después, trata el tema de la Constitución como norma jurídica y expone la clasificación de las normas constitucionales según su eficacia. Más tarde, explica lo que debe entenderse por omisión legislativa. Finalmente, después de un estudio sobre la legislación local mexicana en la materia, destaca la necesidad de incluir este tema en el debate sobre una nueva Constitución
