    A success in the business world could be seen one from the absence of problems nor disputes among the business people.The interests of investors either business people in conducting business transaction caused by the availability of a certainty within the business itself. The investor or business people would be interested to conduct a business or transaction with the result that there are teasing and ensure legal certainty in the position of conducting business or cooperation in these efforts. Perhaps even legal certainty is a major factor which is very important for them to conduct business, especially a business or partnership that has a very large nominal value, including the cooperation in transportation sector, especially the service provider. Legal certainty is a major factor to gain the trust and convince the investors to do a partnership in conducting business transactions. One of kinds of legal certaintycould be stated in a written agreement in which regulates everything that had been agreed upon by the parties who enter into agreement.     Nominee Contract Practice on Ownership of Foreign National Land in Indonesia

    Introduction: The nominee agreement in practice is done as legal smuggling against land control for foreigners based in Indonesia, which the Agrarian Principal Law limits. Such restrictions result in foreigners finding a way to obtain property rights under the Nominee Agreement and b the basis of Article 21 paragraph (1) of the fundamental agrarian law of land ownership by foreign nationals with proprietary status contrary to the principle of nationality.Purpose/Objective Study: This research aims to find out how the practice of nominee agreements in land ownership for foreign nationals in Indonesia and the legal consequences of nominee agreements in the application of transfer of property rights to land in Indonesia.Design/Methodology/Approach: This study is normative juridical research beginning on a legal event and then looking for references to a norm system. This legal research is conducted by examining primary and secondary legal materials and non-legal materials relating to nominee contract practice on ownership of foreign national land in Indonesia. In this study, the approach was the statute approach by examining all laws and regulations relating to legal issues and case approach by examining several cases that have a relationship with the legal issues to be discussed. Findings: The result of this study is that the nominee agreement made to transfer ownership of property rights to Foreign Nationals contrary to Article 26 paragraph (2) of the Agrarian Principal Law, based on Article 1320 of the Civil Code, does not meet the objective requirement that lawful clause. The agreement becomes null and void and has no binding power and cannot be used for the basis of rights in obtaining ownership of land for Foreign Nationals in Indonesia.Paper Type: Research articl

    Tujuan Penelitian ini untuk mengetahui strategi UKM industri kelor PT. Tri Utami jaya untuk menembus pasar internasional. Rumusan masalah yang di ajukan yaitu: Bagaimana pemasaran yang di lakukan PT industri kelor PT Tri Utami jaya untuk menembus pasar internasional ? Penelitian ini menggunakan pendekatan kualitatif, tekhik pengumpulan data di lakukan wawancara, observasi dan dokumentasi. Tehnik analisis dengan cara , pengumpulan informasi, redaksi data, penyajian data dan menarik kesimpulan.Hasil penelitian ini menunjukan UKM indusrti kelor PT Tri Utami Jaya menggunakan strategi pemasaran yaitu bauran pemasaran (marketing mix) berupa 4 elemen , seperti strategi produk, strategi harga, strategi, distribusi atau tempat dan strategi promosi . UKM Industri kelor juga menggunakan negosiasi dengan calon pembeli untuk memasuki pasar internasional dengan khasiat dan langkahnya produk kelor dan dengan memanfaatkan bantuan dari pemerintah melalui dinas perindusrtian dan perdagangan (Disperindag). Kendala usaha produk berbahan kelor CV. Tri Utami Jaya , yaitu biaya produk , biaya distribusi, kurang pengawasan dalam menggunakan teknologi mesin, sosial dan kebijakan pemerintah, persaingan yang tinggi dan kendala pada ekspor

    Financial Services Authority Regulation Number 19/POJK.03/2014 concerning Financial Services Without Offices In the Context of Inclusive Finance, the Financial Services Authority in collaboration with the Banking sector makes services sell well. In this study as clever behavior is Bank Central Asia, which is one of the banks that conducts Officeless Financial Services, because it needs to serve people in remote areas, it is necessary to know the definition of clever service in order to know how the legal position of Third Parties in managing smart services still unclear, especially the legal status of the Third Party as a liaison between the bank and the customer. The purpose of the study is to examine and analyze the legal standing of third parties in financial services without offices. This research is a normative legal research that examines the principles, legal concepts and legislation related to the legal position of third parties in the provision of financial services without offices. The conclusion of this study is that Officeless Financial Services is an activity of providing banking services and/or other financial services carried out not through office networks and legal relations of the parties based on cooperation agreements and internal circulars. The legal position of third parties is as a bank liaison with customers (agents) and an extension of the bank (partner), where in each implementation there are rights and obligations that must be fulfilled in order to achieve the implementation of salable services

    Introduction to The Problem: In order to guarantee the legal certainty for the Islamic banking customer in murābaḥah financing is the requirement of mortgage right. The bank customer may use mortgage right as collateral in murābaḥah financing. Furthermore, the right can be implemented in the indebtedness, which is different from debt.Purpose/Objective Study: This research aims to find out the contract (al-‘aqd) that is used by the shariah bank to implement the mortgage rights in murābaḥah financing.Design/Methodology/Approach: This study is normative juridical research with emphasis beginning on a legal event and then looking for references to a norm system. Therefore, this legal research is conducted by examining primary and secondary legal materials, and non-legal materials relating to the application of Mortgage Rights in Financing, especially for murābaḥah financing. In this study, the approach was the statute approach by examining all laws and regulations relating to legal issues, and case approach by examining several cases that have a relationship with the legal issues to be discussed.Findings: The result of this study is that the implementation of mortgage right in murābaḥah financing is the possibility of using another contract made by sharia banking with its customers; the contract of acknowledgment of debt. This basis is used as the justification of the implementation of mortgage rights in murābaḥah financing
