Role of UAE courts in international commercial arbitration
As a requirement for LLM (International Business & Commercial Law), School of Law, University of BedfordshireConcept of arbitration has been prevalent, historically, in the Middle East since the early days of Islam. The arbitral process has been problematic in the UAE however, it has not been until recently that the UAE has recognized the importance of arbitration as a powerful dispute resolution alternative and revised its legislation to accommodate the proceedings of domestic and
international arbitration.
In the past, foreign investors have been reluctant to select the UAE seat for their arbitration proceedings. There has been a perception that, as a general rule, the practice of international commercial arbitration in the Middle East is still in its infancy. The UAE is now demonstrating to the international community that it has the necessary infrastructure and laws in place to successfully count itself as one of the key arbitration players, alongside London, Paris and Hong Kong. This has been the result of the UAE updating their laws, reforming dispute resolution practice and procedures and through the establishment of key regional arbitration centres.
The UAE's accession to the New York Convention was also seen as a significant step in demonstrating the UAE's commitment to foreign investors and the international community. Under Federal Decree No. 43 of 2006, the UAE managed to accede to the New York Convention. The UAE's accession is considered as a mile stone towards provision for a more straightforward arbitral process and enforcement of foreign arbitral awards in other Convention states.
As a recent development, the UAE has evidenced the joint venture between the Dubai International Financial Centre ('the DIFC') and the London Court of International Arbitration ('the LCIA'), in February 2009, to create the DIFC-LCIA Arbitration Centre ('the DIFC~LCIA'). The DIFC-LCIA operates alongside the longer-established Dubai International Arbitration Centre ('the DlAC'). Both offer their own procedural rules and regulations for the amicable settlement of disputes through arbitration.
The Courts role is vital in an arbitral proceeding in any jurisdiction. Although arbitration is believed as a court-free, independent forum for dispute resolution; the court plays fundamental role to ensure that the arbitral proceeding is taking place in a moderate and independent decorum. The UAE Court's role towards the International commercial arbitration has been very problematic and the courts historically used to intervene in the arbitral proceeding over tiny issues. The new UAE arbitration laws has changed the situation and curtailed the courts powers to interfere the arbitral proceeding. At present, the arbitration in the UAE is more independent and straightforward. The proposed UAE arbitration law has much more similarities with the Model Law UNCITRAL and meets the International standards. A lot of work still has to be done in order to make the arbitration more independent, straightforward and friendly in the UAB. The Court's role is vital and is required to be more supportive then it is at present in the arbitral process
FASHION: MALAYSIAN MUSLIM WOMEN PERSPECTIVE
This paper introduces an in-depth discussion of the various interpretations of what fashion is, and the items considered as part and parcel of fashion. Generally fashion is seen as an object of beautification for women, yet it brings new meanings to their lives when it enhances selfconfidence, facilitates the communication of their self-identity and selfesteem, besides depicting their culture or society. A discussion of the purposes of fashion items such as shoes, makeup/cosmetics, apparel and accessories is discussed. A section of the paper is devoted to a discussion of the Muslim scarves (hijab), as the focus of this paper is on the perception of what fashion means to Muslim women. This paper serves as a fruitful insight into the minds of the Muslim women consumers and provides impetus for the marketing of fashion-related items to serve this segment of the market. A conceptual framework developed for this study would be the initial attempt at developing a more comprehensive study into the related moderating and mediating variables that has an effect on fashion. This study also suggests that future researchers may consider testing the proposed model empirically, not only in Malaysia but also in other countries. Lastly, a promising attempt would be to test for invariance among different countries on the same model
Adolescent Perception of Genre Related to Early Childhood Marriage In Kabalutan Island Central Sulawesi
Adolescent perceptions of early childhood marriage are responded positively or negatively because of the high sexual urges of teenagers because of permissive and almost unlimited environmental influences. The Planning Generation Program (GENRE) which is focused on adolescents is expected to be an innovative solution for the community, especially families with teenagers. This study aims to analyze the perceptions of adolescents about the acceptance of the GENRE concept related to early childhood marriage on Kabalutan Island. This research is a qualitative research with an explanatory approach. Data collection was conducted with Focus Group Discussions and in-depth interviews as well as observations on 14 informants consisting of teenagers who were early marriages and not early marriages, parents of teenagers who had married early and parents of unmarried teenagers and local community leaders consisting of officers health and teachers. To obtain the factors that drive teenagers' perceptions, the data are analyzed using taxonomic analysis. This study has succeeded in identifying the perceptions of adolescents about GENRE and early childhood marriages on the island of Kabalutan. The family environment and socio-culture of the local community and the interventions provided by some Parties provide a diverse understanding of adolescents. Therefore, it is recommended for cross-sector stakeholders who are interested in equating perceptions and joint interventions so that the acceptance of GENRE can be maximized in overcoming early marriage.Keywords: Acceptance, Concept, Marriage, Behavior, Adolescent
Factors Influencing Consumer Purchase Intention: A Study of Bookstores in Kurdistan Region of Iraq
Background problems: Due to the weakness of the banking system infrastructure, there is no online bookstore or E-commerce business in Kurdistan. Many customers complain about the problem of the parking facility, most of the bookstore locations have not enough parking space nearby for the customers to be able to visit the bookstores and spend quite enough time to search for books and buying them. Main objective: So, the researcher has decided to study the impact of social media marketing on customer purchase intention toward bookstores in Kurdistan region. Research methods: The sample of the study consists of 300 respondents of which 231 are males, and 69 are females. The instrument of the study is adapted from previously established studies. The first part of the survey was designed to investigate respondents’ demographics, whereas, the second part focused on the independent and dependent variables of the study. Finding: The results showed that all the independent variables significantly influenced customer purchase intention toward bookstores in Kurdistan. Contribution: The findings of the study implied valuable contribution in two aspects. Theoretically, the study findings showed evidence for the establishment of TAM. In terms of managerial implication, the study provided a practical recommendation for the practitioners. The research findings come to validate SMM as a potential promotional strategy for bookstores in the region. Conclusion: So, bookstore marketers need to include social media marketing to their promotional strategy and improve social media marketing skills which can give advantage for the bookstores
KONDISI FISIK, PENGETAHUAN, PENDIDIKAN, PEKERJAAN IBU, DAN LAMA PEMBERIAN ASI SECARA PENUH
Berbagai studi dan pengamatan memperlihatkan kecenderungan penurunan pemberian ASI dan berganti dengan susu fomula menjadi kebiasaan umum di dalam masyarakat. Penelitian ini bertujuan mengetahui pola pemberian ASI pada periode 12 bulan umur bayi dan perbedaan pengaruh variabel determinan terhadap lama pemberian ASI secara penuh (ASI secara penuh) tanpa makanan lain. Penelitian observasional analitik yang dilaksanakan di dua wilayah kerja puskesmas Kecamatan Tallo Kota Makassar ini menggunakan rancangan studi potong lintang dengan jumlah sampel 300 responden. Analisis multivariat dilakukan dengan metode Cox Proportional Hazard. Hasil penelitian menunjukkan bahwa proporsi bayi untuk mendapatkan ASI secara penuh pada bulan pertama adalah sekitar 0,86, pada bulan ke 6 menurun sekitar 31%, dan pada periode 5,06 bulan menurun menjadi sekitar 50%. Ada perbedaan lama pemberian ASI secara penuh berdasarkan variabel keadaan fisik ibu, pengetahuan ibu, pendidikan, dan pekerjaan. Hasil analisis lanjut menunjukkan variabel yang berbeda secara nyata dalam hubungan dengan durasi pemberian ASI secara penuh adalah keadaan fisik ibu dan pengetahuan ibu.Various studies and observations indicate declining trend of breastfeeding and replacing breast milk with formula is already a common thing in society. This study aimed to find out the pattern of breastfeeding in infants up to 12 months, and to know the difference effect of the determinant variables of full breastfeeding. This observational research with cross sectional study design that involved 300 respondents was conducted in the Tallo District of Makassar City. Data analysis was performed by univariate, bivariate with Kaplan Meier and multivariate with Cox Proportional Hazard. The results showed that proportion of infants get full breastfeeding in first month was 0.86, infants who still get full breastfeeding on the 6th month are 31%, and half of the number of infants are not get full breastfeeding after 5.06 months. There are differences in the duration of full breastfeeding on the mother\u27s physical status, education, and occupation. The further analysis showed a markedly different variables in influencing the duration of full breastfeeding are mother\u27s phisical status and knowledge
The impact of technology CSFs on customer satisfaction and the role of trust: an empirical study of the banks in Malaysia
Purpose – The purpose of this paper is to identify and test technology-related critical success factors (CSFs) and its impact on trust and customer satisfaction.
Design/methodology/approach – This paper analyses the causal relationship that exists between technology CSFs and customer satisfaction. It also investigates the mediating role of trust between these two. For this purpose data were collected quantitatively from 349 employees working in different banks, through self-administered questionnaire. The data analysis was conducted using SPSS and AMOS software. Factor analysis was performed to extract and decide on the number of factors underlying the measured variables of interest. Structural equation modelling was then used to examine the variables and the fitness of proposed model.
Findings – The result revealed that technology CSFs positively affect customer satisfaction. Also, trust partially mediates the relationship between technology CSFs and customer satisfaction. A significant positive impact of technology CSFs on trust, and trust on customer satisfaction have also been obtained.
Practical implications – The significant influence that technology CSFs have on customer satisfaction and trust shows that technology-related CSFs are inevitable for the success of customer relationship management (CRM) in financial services industry, particularly banks. Policy makers of service industry in general and financial service industry in particular may benefit from the findings of this study.
Originality/value – Despite the plethora of research on CSFs for CRM, very limited attention has been given to testing and validating the identified CSFs. Negligible research has been conducted to investigate trust as a mediating variable in the relationship between technology CSFs and customer satisfaction. This paper, therefore, offers valuable insight into technology-related CSFs and trust with their impact on customer satisfaction
DIVERSIFIKASI USAHA OLAHAN RUMPUT LAUT MELALUI PEMBUATAN EKADO
Rumput laut merupakan salah satu komoditas hasil laut yang diunggulkan dikarenakan memiliki kandungan yodium yang tinggi. Tingginya kandungan yodium yang dimiliki rumput laut membuat komoditas ini dapat dikembangkan menjadi produk subsitusi tepung terigu menjadi produk pangan olahan khususnya ekado. Ekado merupakan makanan yang dibungkus dengan adonan kulit pangsit. Adonan kulit pangsit terbuat dari tepung terigu dengan penambahan rumput laut. Kegiatan pengabdian ini bertujuan untuk: (1) Meningkatkan pengetahuan dan keterampilan kelompok usaha Matahari dalam menghasilkan ekado; (2) Meningkatkan pengetahuan kelompok usaha Matahari mengenai aspek keamanan pangan dan pemilihan jenis kemasan yang tepat; (3) Meningkatkan pengetahuan manajemen dan strategi pemasaran produk. Metode pelaksanaan kegiatan pengabdian yang dilakukan meliputi penyuluhan dan pelatihan. Metode penyuluhan dan pelatihan dilakukan untuk menjelaskan tentang manfaat ekado, cara membuat ekado, keamanan pangan dan pengetahuan manajemen dan strategi pemasaran. Sementara itu metode pelatihan diberikan untuk meningkatkan keterampilan ibu-ibu kelompok usaha Matahari membuat ekado dan mengemas vakum produk olahan rumput laut. Hasil yang diperoleh dari kegiatan pengabdian ini adalah ibu-ibu kelompok usaha Matahari banyak memperoleh pemahaman diversifikasi olahan rumput laut seperti ekado. Selain itu peserta menyadari pentingnya keamanan pangan dalam proses produksi, pemilihan jenis kemasan yang tepat dan mengetahui cara penggunaan kemasan vakum. Bahkan, peserta juga menyadari pentingnya kemasan yang menarik dalam memasarkan produk olahan dan cara memasarkan produk olahan ekado. Analisis Sosial Budaya terkait Pernikahan Usia Dini di Kepulauan Selayar
ABSTRAKLatar Belakang. Pernikahan di usia dini menimbulkan dampak negatif terhadap remaja baik dalam aspek fisik, psikologis dan biologis. Pernikahan di usia dini sangat erat kaitannya dengan tradisi yang ada di lingkungan masyarakat seperti perjodohan.Tujuan. Penelitian ini bertujuan untuk mengeksplorasi sosial budaya terkait pernikahan usia dini di Pulau Selayar.Metode. Penelitian ini menggunakan metode kualitatif dengan pendekatan fenomenologi deskriptif. Informan terdiri termasuk remaja, orang tua, penyedia kesehatan, dan kepala komunitas. Data dikumpulkan menggunakan wawancara mendalam dan diskusi kelompok terarah sesuai dengan tujuan penelitian. Data dianalisis dengan menggunakan analisis domain.Hasil. Tiga domain utama yang ditemukan dalam penelitian ini terkait pernikahan usia dini adalah: (1) perjodohan merupakan faktor yang mendukung terjadinya pernikahan di usia dini (2) dukungan sosial yang diberikan masyarakat terhadap pernikahan di usia dini karena adanya tradisi perjodohan yang berlaku dalam lingkungan masyarakat (3) pengetahuan yang dimiliki masyarakat dan remaja masih kurang mengenai dampak pernikahan usia dini.Kesimpulan. Sosial budaya yang ada di masyarakat dapat digunakan sebagai salah satu pendekatan untuk menurunkan angka pernikahan di usia dini. ABSTRACTBackground. Marriage at an early age has a negative impact on adolescents in physical, psychological, and biological aspects. Marriage at an early age is closely related to traditions in society such as arranged marriage.Objective. This study aimed to to explore the socio-culture related to early marriage on Selayar Island.Method. This study used a qualitative method with a descriptive phenomenology approach. Informants include youth, parents, health providers, and community heads. Data were collected using in-depth interviews and focus group discussions following the research objectives. Data were analyzed using domain analysis.Results. Three main domains found in this study related to early marriage are: (1) arranged marriage is a factor that supports early marriage (2) social support from the community supporting marriage at an early age because of the prevailing arranged marriage tradition in the society (3) the knowledge possessed by the community and adolescents is still lacking about the impact of early marriageConclusion: Social culture in the community can be an approach to reducing early marriage
Islamic business coaching from the perspective of Indonesian coaches
In an increasingly competitive era of trade, training is insufficient to help solve business problems and challenges that often change daily. Meanwhile, business professionals realize that the coaching process used for the past dozen years by athletes, orators, and artists to improve their performance can also be used to help entrepreneurs to help accelerate business goals and personal success. Organizations that offer coaching have grown rapidly over the past decade. Even though in Indonesia, several coaching Islamic businesses have their communities, until now there is limited literature on Islamic business coaching. This study develops definitions for Islamic business coaching along with its characteristics for the Indonesian setting. This was achieved using qualitative research. Data were collected with interviewing 5 Islamic Indonesian master coaches. Recording of interviews was transcribed and coded. Then, those were analyzed with content analysis. The paper concludes that Islamic business coaching differs from conventional coaching due to being based on Islamic religiosity and principles.
