Tesis por compendioThis PhD thesis, which is presented in the mode of published articles, explores the differentiating factors of a High Academic Achievement Program at a public technological university in Spain and how they can affect the definition of the university strategies. The Universitat Politècnica de València (UPV), launched in the 2010-11 academic year the High Academic Achievement Groups ("Grupos de Alto Rendimiento Académico", from now on ARA Groups), characterized by a good number of courses taught using English as a medium of instruction, a small number of students in the class, and highly qualified teachers. English taught courses are a global phenomenon, associated to improved English language and internationalization skills, but it raises concerns about learning outcomes and equity (Dearden, 2014). The purpose of this study was to assess the first promotion (2010-2014) of this program at the five university bachelor degrees of the UPV that offered it. We wanted to analyze if this action has had any impact on a set of variables related to academic outcomes, international exchange programs, and business internships of the participating students in comparison with the rest of students of these degrees and hence, on their employability upon graduation. The sample consisted in the total of 3,543 students of the five degrees offering this innovation, of which 560 belonged to the ARA Groups. The first article "Effects of business internships on students, employers, and higher education institutions: a systematic review" (Sanahuja Vélez, G., and Ribes Giner, G., 2015) was published by the Journal of Employment Counselling on September 2015. The second publication consists of a Book Chapter published by Springer International Publishing on January 2017: "Intrapreneuring within a higher education institution: Introducing virtual business internships" (Sanahuja Vélez, G., Ribes Giner, G., Moya Clemente, I., 2017) in Entrepreneurial Universities (Peris-Ortiz, M., Alonso Gómez, J., Merigó Lindahl, J. M., and Rueda-Armengot, C., Eds.). The third publication is a "Systematic review of English Medium of Instruction (EMI) in higher education institutions. The case of a Business School", presented as a conference at the 2nd Seminar on Learning Internationalization: English Medium of Instruction (EMI) of the Centro de Lenguas of the Universitat Politècnica de València (March 30 and 31st, 2017) and which is currently being reviewed for its publication in its international journal. The fourth research work is the article "Enhancing student internationalization and employability in a Business School", which is presently been given full consideration for publication at the Journal of Business Management and Business Economics. The fifth article presents the core results of the empirical part of this research work and it is entitled: "Introducing a High Academic Achievement Program in a Technological University as a Social Innovation Mechanism to Enhance Graduates' Employability". This paper is currently given full consideration for publication at the journal Technovation. The overall conclusions of our research allow us to conclude that, from the academic point of view, the objectives of the High Academic Achievement Groups of the UPV were met, as results show that academic performance was enhanced. Our results also show that participation into exchange programs, at the School of Business Administration and Management and in the UPV as a whole, was almost four times higher in the ARA groups. Having in mind that better grades and international experience are directly linked to future employability and mobility of graduates, it is expected that these graduates will have a superior reception in the labor market. Resolving the Patent-Antitrust Paradox Through Tripartite Innovation

    Get PDF
The issues presented by-the intersection of the patent system and the antitrust laws have never been as pressing as they are today. The number of issued patents is skyrocketing. Companies are more frequently entering into arrangements with competitors not only to recover their investment from creating patented products but also to avoid the patent landmines that line the path of innovation. They form patent pools for laser eye surgery, MPEG-2 video compression technology, and DVD formatting; enter into alliances, mergers, and settlements in the biopharmaceutical industry; refuse to license their patented products in various industries; and cross-license their patents in the semiconductor industry. But the need for collaborative and exclusionary conduct under the patent system is matched by the heightened suspicion of the antitrust laws. Antitrust looks at these patent-based activities and sees competing firms conspiring to limit competition. It sees increased price, reduced output, and lessened competition. And it pays scant attention to the benefits of the activity in promoting innovation or the justification for the activity based on the patent system. Thus, the patent-antitrust paradox. Stated on its simplest level, the patent and antitrust systems promote welfare in different, often conflicting, ways: the patent system is based on exclusion, while antitrust law focuses on competition. Since exclusion-based acts often restrict competition, courts are left to reconcile two systems for promoting welfare without any compass to guide them. One need not look far to stumble upon their wayward path, as revealed by judicial analyses based on the defendant\u27s intent, the scope of the patent, the presence of an essential facility, and the effect of the activity on competitors. This Article offers a paradigm to resolve the patent-antitrust paradox. Three steps comprise the paradigm. First, the Article proposes innovation as the common denominator of the patent and antitrust laws. Second, it proposes a new explanation that firms can offer in defense of the challenged activity: that it is reasonably necessary to attain tripartite innovation. Tripartite innovation denotes the three temporal stages of innovation: the creation of the product, the recovery of the investment incurred in creating the product, and the circumvention of patent bottlenecks that block the path of innovation. Third, the Article recommends a greater role for the justification than that currently accorded to other explanations in antitrust analysis. Specifically, a showing of reasonable necessity for tripartite innovation should receive (1) immunity from a charge of monopolization, (2) heightened consideration in the review of mergers, and (3) greater weight in an asymmetric balance against anticompetitive effects in the analysis of agreements. The Article is constructed as follows. Part I sketches the conflict between the patent system and the antitrust laws and illustrates the range of approaches that courts and the federal antitrust enforcement agencies recently have applied to the intersection. Part II proposes innovation as the common denominator allowing the reconciliation of the patent and antitrust laws. This part relies on the text and legislative history of the relevant statutes, courts\u27 jurisprudence, and economic theory

    Get PDF
The current environment that characterizes the software industry is extremely dynamic and somewhat complex demanding high-performance solutions, rapid development and cost efficiency. The collaboration relationship with universities has been represented a key resource, to the extent that together more easily can promote technological development that underpins innovation solutions. In addition, several studies point out knowledge sharing as an important and strongly influential factor in a collaboration relationship. In this context, the present thesis aims to identify a set of factors that can enhance and/or facilitate the collaboration relationship between the university and the software industry in a sustainable way, based on knowledge management. In line with the general objective three research questions were defined: (i) What are the main motivations that lead to the decision of establishing a collaboration relationship?; (ii) What are the management mechanisms used in the governance of collaboration relationships?; (iii) What are the principles and culture of knowledge management and of knowledge sharing in these organizations? In order to answer those questions and, consequently, achieve the general objective, an initial quantitative study based on a questionnaire was conducted. This study aims to explore and understand the practice of knowledge sharing and collaboration in the context of a university. Overall it was concluded that, knowledge sharing positively affects the collaboration behavior. The obtained results also showed that in order to promote and encourage knowledge sharing and, consequently, to foster collaboration relationships, it is important to work mechanisms based on intrinsic motivation and networking. Subsequently, it was conducted a qualitative study based on interviews in order to identify a set of factors that could enhance/facilitate the collaboration relationship between the university and the software industry in a sustainable way, based on knowledge management. Participants with complementary visions and different experiences in the two types of involved industries and simultaneously, with decisionmaking positions were interviewed. The results revealed that collaboration relationships established among these organizations are set-up only as a ‘connection’. This ‘connection’ is characterized by being a simple exchange, without building a sustainable collaboration relationship; although, those involved point to advantages in the existence of a sustainable collaboration relationship. The results also revealed that the collaboration relationships are usually conducted through informal communication channels, which makes it difficult to capture and disseminate knowledge to other remaining members of each involved organizations. In nutshell and in practical terms, this work contributes to the identification and analysis of a set of factors that enhance a collaboration relationship between university and software industry. This result can support organizations in the strategies definition for the development of actions, in order to promote a sustainable collaboration relationship. In theoretical terms, this work contributes to the increase of the body of knowledge in the area, with empirical results, since the literature point the lack of empirical studies as the main gap in this area of knowledge.O atual ambiente que carateriza a indústria de software é extremamente dinâmico e, de certa forma complexo, exigindo soluções de alto desempenho, de desenvolvimento rápido e eficientes em termos de custos.

A data-driven approach for a project management methodology for R&D Projects.

267 p.The thesis is based on the proposal of an R&D project management methodology based on the Earned Quality Method (EQM) and data analysis to improve the efficiency of R&D projects in a near-real production environment in a TRL 5 to 7. The thesis relies upon published papers that propose measuring and improving the management of R&D projects. The methodology leans on the formulation and gradual and recurrent evaluation of quality criteria as a performance indicator of the work carried out. The thesis stands on the concept that quality is a measurable quantity that accumulates throughout the project. The proposed project management methodology is built on three main aspects: Collaboration between the University and Industry; The correct interpretation of the TRL where research projects are developed; The study of different metrics for project management, such as the measurement of the success of projects, the KPIs of a project-based organisation, and the EQM. The methodology has been tested with three actual use cases with different characteristics in terms of project size, funding and team members; and validated on an R&D Centre in Advanced Manufacturing in Aeronautics. The pillars of the thesis are focused on the analysis of the mentioned components and their integration for the development of a methodology to improve the efficiency in the use of resources and the quality of obtained results in the R&D projects' framework. The key findings of these studies demonstrate the effectiveness of using quality criteria for measuring progress in the management of R&D projects, as well as providing a better understanding of several critical aspects of the realisation of these projects

Impact of BIM/LEAN on the interaction of construction project design teams

BIM and Lean methodologies have a positive impact on construction projects. Besides, there is evidence of the combined implementation of BIM and Lean; however, it is not known the empirical relationship between Lean practices and BIM uses in the design phase. Also, there is not a deeper understanding of the social phenomena that are generated among design teams when BIM-Lean management methodologies are implemented. Therefore, the objective of this research is to understand the impact of Lean design management (LDM) practices, and BIM uses in the interaction of construction project design teams. The research method has two phases: (1) the creation of tools to assess the level of implementation of LDM practices and BIM uses and to understand the interactions in a design team; and (2) the relationship analyses between BIM, Lean, and interaction, based on empirical information from construction projects in the design phase.
