    Corrective Justice For Medical Personnel Who Violate The Law: Where Is The Professional Organizations Involvement?

    The provision of criminal sanctions for medical personnel who violate the law in the form of gross negligence creates legal uncertainty apart from the unclear definition of serious negligence and does not involve the role of professional medical professional organizations in determining criminal witnesses for medical personnel. This study aims to formulate aspects of corrective justice for medical personnel who violate the law, especially in the realm of criminal law. This research is a normative legal research with a concept and statutory approach. The results of the study confirm that the criminal responsibility of medical personnel requires the role of the professional organization of the medical personnel concerned. This is because the assessment of the professional organization of medical personnel is important as a form of guaranteeing justice and legal certainty for medical personnel. Corrective justice-based medical personnel accountability orientation can actually be carried out by involving the roles and recommendations of medical professional organizations. In addition, health law reform is also needed by formulating criminal sanctions for medical personnel based on ultimum remidium, namely utilizing non-prison criminal sanctions in order to achieve justice for medical personne

    Nowadays increasing attention is paid to the issues of the relationships between minor patients and medical personnel. There are several problematical issues in relationships mentioned above and one of the most significant is the legal regulation awareness of people providing medical services. The aim of the study is to make evaluation of the legal knowledge of medical personnel who work with minor patients and find out the main problems medical personnel deal with in particular area. Material and methods: the first group consisting of 70 medical personnel completed the questionnaire about knowledge of legal regulations by medical personnel. As the result the participants possess the low level of knowledge in providing information to minor patients about their health status. Insufficient knowledge is resulting in low quality of legal perspective of provided services. And this fact puts medical personnel at risk of being liable for breaching the laws

    A preliminary audit of medical and aid provision in English Rugby union clubs:compliance with Regulation 9

    BackgroundGoverning bodies are largely responsible for the monitoring and management of risks associated with a safe playing environment, yet adherence to regulations is currently unknown. The aim of this study was to investigate and evaluate the current status of medical personnel, facilities, and equipment in Rugby Union clubs at regional level in England.MethodsA nationwide cross-sectional survey of 242 registered clubs was undertaken, where clubs were surveyed online on their current medical personnel, facilities, and equipment provision, according to regulation 9 of the Rugby Football Union (RFU).ResultsOverall, 91 (45. 04%) surveys were returned from the successfully contacted recipients. Of the completed responses, only 23.61% (n = 17) were found to be compliant with regulations. Furthermore, 30.56% (n = 22) of clubs were unsure if their medical personnel had required qualifications; thus, compliance could not be determined. There was a significant correlation (p = −0.029, r = 0.295) between club level and numbers of practitioners. There was no significant correlation indicated between the number of practitioners/number of teams and number of practitioners/number of players. There were significant correlations found between club level and equipment score (p = 0.003, r = −0.410), club level and automated external defibrillator (AED) access (p = 0.002, r = −0.352) and practitioner level and AED access (p = 0.0001, r = 0.404). Follow-up, thematic analysis highlighted widespread club concern around funding/cost, awareness, availability of practitioners and AED training.ConclusionThe proportion of clubs not adhering overall compliance with Regulation 9 of the RFU is concerning for player welfare, and an overhaul, nationally, is required

    Performance Medical is to provide nursing services to individuals, families, groups or communities according diagnose problems that occur from a problem that is both simple to complex.Kampar District Government strongly supports the health program. In this study discusses the performance of medical personnel in the northern Kampar district health centers. Still the complaints of patients with medical personnel were slow, doctors were minimal, doctors often do not exist in the clinic during working hours make less than the maximum performance of medical personnel. The problem in this research is how the performance of medical personnel northern Kampar district health centers, the factors that hinder the performance of medical personnel northern Kampar district health centers. For the purpose of this study to determine and analyze the performance of medical personnel in Kampar District Health Clinics North, to identify and analyze the factors that hinder the performance of medical personnel in Kampar District Health Clinics North.This study uses the theory of Anwar Prabu Mangkunegara to know how the quality, quantity, duties and responsibilities of the performance of medical personnel in the northern Kampar district health centers. Type of this research is qualitative descriptive method which uses a sampling technique with snowball sampling. Informants in this study is the northern Kampar district health clinic, medical personnel and the public or patients.Performance of medical personnel in health centers North Kampar not maximum , based on the results of interviews that researchers do to patients , residents , and family parties .     Administrative and legal protection of medical personnel against criminal and tortious negligence

    Background: Medical personnel are bound toexperience some difficulties in the course of duty and they may end up criminally or civilly liable in the performance of these responsibilities. Across the globe, many medical employees have lost their license to practice their profession after facing disciplinary committees for breach of duties. Some have been sued by patients for negligent treatment. Administratively, the hospital management boards have protected their staff against liabilities by being sued instead of the staff, paying some patients off or write off their hospital bills to compensate them for the liabilities of their medical personnel. Legally, medical personnel are also shielded from medical liabilities as long as they observe a high level of care and skills in the course of duty, otherwise, the law will remove the veil of protection and charge them as liable.Methodology: In order to achieve the objectives of this research, the doctrinal and qualitative methodology was adopted. The doctrinal approach enables the authors to explore the position of the Nigerian law to examine the liabilities of medical personal in cases of any malpractice whether intentionally or unintentionally. The qualitative approach was used to analyze the administrative protection of medical personnel by the hospital management board.Conclusion: The study concludes that as long as there is lack of proper supervision of medical personnel by their superior officers, no constant supply of electricity, no improved welfare package for medical personnel, lack of educational sponsorship for career advancement, deliberate observation of advanced professional ethics and honesty on the part of medical personnel, negligence in the course of treatment would not be abated in Nigerian hospitals.Keywords: Medical Personnel, Negligence, Liabilities, Hospital Management, La

    This journal explains the effectiveness of legal protection for medical personnel, especially in implementing Occupational Safety and Health during the COVID-19 period. The number of COVID-19 cases that continue to develop in Indonesia certainly affects the implementation of OHS for medical personnel. Various problems also emerged in the first year of the spread of COVID-19, from medical personnel, instruments, and components supporting the implementation of OHS and the condition of COVID-19 in Indonesia. OHS accommodation for medical personnel has been listed in various laws and regulations in Indonesia. In this study, the author uses socio-legal legal research methods. The final result of this research is a study of the legal conditions of the laws and regulations governing the implementation of OHS for medical personnel in Indonesia, accompanied by various cases. This conclusion of the article provides the effectiveness of the implementation and compliance of das sollen and das sein law in Indonesia, especially regarding accommodating the implementation of Occupational Health and Safety (OHS) in accordance with legal regulations. With this issue, there is a need for synergy among the government, hospitals, healthcare workers, and relevant parties to ensure the implementation of OHS protection for medical personnel dealing with COVID-19 and the potential new mutated viruses emerging in Indonesia

    Health center health workers are the main resource to create a healthy community. Medical and non-medical personnel also play an important role in public health services. The Banguntapan II Health Center in Bantul has a wide working area so that it will be correlated with the availability of human resources at the Puskesmas both for the number of human resources, performance and productivity of the health services provided by the Puskesmas to the community, especially considering the current state of the COVID pandemic. The purpose of this study was to find out how the work productivity of medical and non- medical personnel with the time and motion study method at the Banguntapan II Health Center, Bantul, Yogyakarta in 2021. This type of research uses a combination method (Mixed Method Research) with quantitative and qualitative approaches with Explanatory Sequential Design. The number of respondents who were studied by total sampling technique was 41 people and the research subjects who were examined by quota sampling technique were 12 people, taken from medical and non-medical personnel at Banguntapan II Public Health Center, Bantul Yogyakarta. Work productivity at Banguntapan II Public Health Center is seen from the standard time for medical personnel totaling an average of 7 hours 3 minutes, and non- medical personnel totaling an average of 6 hours 39 minutes. The factor that affects the work productivity of medical and non-medical workers is the work environment. The results showed that medical and non-medical personnel at Banguntapan II Health Center had good work productivity. However, the Puskesmas needs to pay attention to the needs of non- medical personnel to maximize the program from Public Health Center

    Generalized anxiety disorder associated with individual work performance of Indonesian medical personnel during COVID-19 outbreak

    Coronavirus disease (COVID-19) outbreak has the potential to affect the mental health of medical personnel. This study aimed to investigate the anxiety experienced by medical personnel during the COVID-19 outbreak and its correlation with individual work performance. A cross-sectional study was conducted on 501 Medical Personnel in Indonesia. Anxiety level and work performance were assessed by the GAD-7 and IWP-1.0. Data analysis techniques used were descriptive statistics, Man-Whitney test, Kruskal-Wallis test, and Spearman's Rank-Order Correlation. The results showed that 33.33% of the participants did not experience anxiety, followed by moderate, mild, and severe levels (31.14%, 27.74%, and 7.78%). Furthermore, the level of anxiety was different in terms of sex, age, and type of medical personnel, while there was no difference in the length of time of work. The results of the correlation analysis showed that anxiety was correlated with task performance and contextual performance, but there was no correlation with the counter-productive work behavior. There is a crucial need for psychological assistance to medical personnel in orders to reduce their anxiety as well as improve their performance
