Some advances in legal practical reason: for a progressive dialogue with contemporary hermeneutics

This paper intends to critically discuss some points of the contemporary thesis concerning constitutional hermeneutics and methodology of law. Once identified some authors and the lines of argumentation affiliated grosso modo to the linguistic turn and rhetoric, as well as the core of the transcendental powers of communication (v.g. N. MacCormick, R. Alexy, K. Günther), the objective is to identify some dialogue with economics and political science, enlightened by recent researches about Hegel-Marx interpretations of social life. Of course the discussion inevitably passes through methodological questions, opposing analytics vs. dialectics, idealistic vs. realists standpoints. In a effort to foment the inclusive dialogue between points of view concerning the concept of law that may create (not necessarily) radical opponents, the lines of conclusion intents to revisit some foundations of Hegelian "method" (so to speak) and intends to give a modest contribution to a more profound analysis of the relations between sein and sollen categories, in order to enrich the discussions about technology and social life, specially the life of the law nowadays

La crítica marxista a la religión desde una perspectiva laica

La tesis marxista de la religión como opio del pueblo ha sido tergiversada y convertida en uno de los principales argumentos que ha utilizado el pensamiento neoliberal y religioso contemporáneo para denostar en su integridad el pensamiento marxista. En este artículo pretendemos recuperar el sentido genuino de aquella sentencia, intentando ser justos con el propósito emancipador general de la filosofía marxista. Mostraremos la vinculación que existe entre la crítica a la religión de Marx y su defensa de la libertad de conciencia desde una perspectiva laica. Por último, veremos como el planteamiento marxista, leído desde una perspectiva laicista, puede arrojar luz sobre la alianza actual entre el neoliberalismo y el clericalismo religioso.The Marxist statement about religion as ‘the opium of the people’ has been distorted and turned into one of the main arguments utilized by contemporary neoliberal and religious thinkers to deride the entirety of Marxist thougth. The aim of this work is to restore the true meaning of this statement in an attempt to do justice to the generally emancipatory rhetoric of Marxist philosophy. This article will demonstrate the relationship between Marx’s criticism about religion and his advocacy for freedom of conscience from the point of view of philosophy of laicism. Finally, this piece will reveal how Marxist thought, read from a laicist point of view, unveils the current complicit relationship between neoliberalism and religious clericalism

Pablo Guadarrama y su vocación filosófica : la perspectiva humanista del marxismo latinoamericano.

This text is to recognize that investigations of Cuban philosopher Pablo Guadarrama around Latin American Marxism are important in at least two lines. The first because it allows you to display a line of Marxist philosophical thought in our continent. The second is relevant in that it establishes a recognition of Latin American philosophical production in the history of Latin American ideas. In this context the written production of Guadarrama we address is a contribution to the debate on Latin American philosophy. In this philosophy a wide recognition to the philosophy of the liberation is had already, but the recognition of Latin American Marxist philosophy is more diffuse. The distinction between the philosophy of liberation and Latin American Marxist philosophy allows clearer distinction.En este texto se pretende reconocer que las investigaciones del filósofo cubano Pablo Guadarrama en torno al marxismo latinoamericano resultan importantes por lo menos en dos líneas. La primera debido a que permite visualizar una línea de pensamiento filosófico marxista en nuestro continente. La segunda tiene relevancia en cuanto establece un reconocimiento a la producción filosófica latinoamericana dentro de la historia de las ideas latinoamericanas. En este contexto la producción escrita de Guadarrama que abordamos es un aporte para la reflexión sobre la filosofía latinoamericana. En dicha filosofía se tiene ya un reconocimiento amplio a la filosofía de la liberación, pero el reconocimiento a la filosofía marxista latinoamericana resulta más difuso. ¿Cómo pensar la historia más allá de la tradición hegeliano-marxista y al mismo tiempo contra la perspectiva contingencialista? El presente artículo buscará responder a esta pregunta a través de un recorrido por la obra de Merleau-Ponty, focalizando en la imbricación entre lo político y lo histórico a partir de una filosofía de la carne y una teoría política de la acción. Para ello, intentaremos enhebrar el hilo conceptual que dibuja la relación entre lo histórico y lo político a partir de la lectura merleau-pontyana de Max Weber y Georg Lukács, porque sólo a través de ella podremos entrever el surco que trazó Merleau-Ponty a fin de eludir las trampas del materialismo histórico (sin necesidad de renunciar a Marx), los restos dispersos del hegelianismo y, en suma, la idea de Historia como teología secularizada. En síntesis: la intelección de ese surco que cruza lo político con la experiencia de la historia será el objetivo central del presente artículo.How to think History beyond Marxist tradition and at the same time against contingency perspective? This article will attempt to answer this question focusing on Merleau-Ponty’s work; particularly, on the overlap between the political and the historical, as regarded by a Philosophy of “Flesh” and a Political Theory of action. For this, we will follow the conceptual thread that draws the relationship between the historical and political from merleau-pontian reading of Max Weber and Georg Lukacs, because it is only through it that can we glimpse the furrow delineated by Merleau-Ponty to avoid the pitfalls of historical materialism (without having to renounce to Marx), the scattered remnants of hegelianism and the idea of History as secularized theology. El ejercicio filosófico de raíz marxista en Chile tiene un capítulo escrito por los intelectuales comunistas de la década del 60 del siglo XX. Uno de ellos, Sergio Vuskovic, se abocó a discutir con las tesis althusserianas que identificaron la teorización de Marx como un antihumanismo teórico.
