    Online Dispute Resolution Through the Lens of Bargaining and Negotiation Theory: Toward an Integrated Model

    [Excerpt] In this article we apply negotiation and bargaining theory to the analysis of online dispute resolution. Our principal objective is to develop testable hypotheses based on negotiation theory that can be used in ODR research. We have not conducted the research necessary to test the hypotheses we develop; however, in a later section of the article we suggest a possible methodology for doing so. There is a vast literature on negotiation and bargaining theory. For the purposes of this article, we realized at the outset that we could only use a small part of that literature in developing a model that might be suitable for empirical testing. We decided to use the behavioral theory of negotiation developed by Richard Walton and Robert McKersie, which was initially formulated in the 1960s. This theory has stood the test of time. Initially developed to explain union-management negotiations, it has proven useful in analyzing a wide variety of disputes and conflict situations. In constructing their theory, Walton and McKersie built on the contributions and work of many previous bargaining theorists including economists, sociologists, game theorists, and industrial relations scholars. In this article, we have incorporated a consideration of the foundations on which their theory was based. In the concluding section of the article we discuss briefly how other negotiation and bargaining theories might be applied to the analysis of ODR

    Los sistemas multi-agente (SMA) son sistemas distribuidos donde entidades autónomas llamadas agentes, ya sean humanos o software, persiguen sus propios objetivos. El paradigma de SMA ha sido propuesto como la aproximación de modelo apropiada para aplicaciones como el comercio electrónico, los sistemas multi-robot, aplicaciones de seguridad, etc. En la comunidad de SMA, la visión de sistemas multi-agente abiertos, donde agentes heterogéneos pueden entrar y salir del sistema dinámicamente, ha cobrado fuerza como paradigma de modelado debido a su relación conceptual con tecnologías como la Web, la computación grid, y las organizaciones virtuales. Debido a la heterogeneidad de los agentes, y al hecho de dirigirse por sus propios objetivos, el conflicto es un fenómeno candidato a aparecer en los sistemas multi-agente. En los últimos años, el término tecnologías del acuerdo ha sido usado para referirse a todos aquellos mecanismos que, directa o indirectamente, promueven la resolución de conflictos en sistemas computacionales como los sistemas multi-agente. Entre las tecnologías del acuerdo, la negociación automática ha sido propuesta como uno de los mecanismos clave en la resolución de conflictos debido a su uso análogo en la resolución de conflictos entre humanos. La negociación automática consiste en el intercambio automático de propuestas llevado a cabo por agentes software en nombre de sus usuarios. El objetivo final es conseguir un acuerdo con todas las partes involucradas. Pese a haber sido estudiada por la Inteligencia Artificial durante años, distintos problemas todavía no han sido resueltos por la comunidad científica todavía. El principal objetivo de esta tesis es proponer modelos de negociación para escenarios complejos donde la complejidad deriva de (1) las limitaciones computacionales o (ii) la necesidad de representar las preferencias de múltiples individuos.     Mediation, Walrasian Tatonement, and Negotiations as an Exchange Economy

    Alternative dispute resolution (ADR) procedures, such as mediation and arbitration, are becoming increasingly used to help resolve disputes in a variety of arenas. Among ADR procedures, mediation is the most utilized yet least analyzed procedure. This article examines negotiations and dispute resolution using the tools of general equilibrium theory. Specifically, mediators function as the Walrasian auctioneers of exchange theory by altering trade-off rates among bargaining issues. In this way, mediators facilitate a process leading towards voluntary settlement. This idea of Walrasian mediation is supported by the literature on mediation and mediator techniques, and so this insight opens up mediation to much more rigorous economic analysis. Among the implications of this approach are: 1) successful mediation leads to Pareto efficient settlements; 2) non-neutral mediators—those with a stake in the outcome—can guide negotiators towards preferred outcomes by introducing resources into mediation; 3) mediation Pareto dominates arbitration for resolving disputes.

    Unanimously acceptable agreements for negotiation teams in unpredictable domains

    A negotiation team is a set of agents with common and possibly also conflicting preferences that forms one of the parties of a negotiation. A negotiation team is involved in two decision making processes simultaneously, a negotiation with the opponents, and an intra-team process to decide on the moves to make in the negotiation. This article focuses on negotiation team decision making for circumstances that require unanimity of team decisions. Existing agent-based approaches only guarantee unanimity in teams negotiating in domains exclusively composed of predictable and compatible issues. This article presents a model for negotiation teams that guarantees unanimous team decisions in domains consisting of predictable and compatible, and alsounpredictable issues. Moreover, the article explores the influence of using opponent, and team member models in the proposing strategies that team members use. Experimental results show that the team benefits if team members employ Bayesian learning to model their teammates’ preferences. 2014 Elsevier B.V.     Resilience: Building Better Users and Fair Trade Practices in Information

    Symposium: Rough Consensus and Running Code: Integrating Engineering Principles into Internet Policy Debates, held at the University of Pennsylvania\u27s Center for Technology Innovation and Competition on May 6-7, 2010. In the discourse on communications and new media policy, the average consumer-the user-is frequently eliminated from the equation. This Article presents an argument rooted in developmental psychology theory regarding the ways that users interact with technology and the resulting implications for data privacy law. Arguing in favor of a user-centric construction of policy and law, the Author introduces the concept of resilience. The concept of resilience has long been discussed in terms of the structure of technology systems themselves; but, the resilience of the human users of these systems-though equally if not more important to their functioning-has been neglected. The goal of fostering user resilience should be explicitly included in the discourse on technology policy with respect to data privacy and information security; a base of resilient users is an essential building block for the long run of a trusted marketplace in information technology products. Contract law reflects a long standing consideration of resilience concerns and offers promising avenues for building better users

    Parent Mediated Instruction of Functional Skills for Children with Autism

    This study adds to the literature on successful parent mediated behavioural intervention using a manual plus brief consultative model to assess outcomes for parent competency and child skill acquisition. Parent participants of young children with autism spectrum disorder, were asked to choose three functional skills to teach their child. A multiple baseline design across a set of behaviours was used to analyze no intervention, parent manual only, and parent manual plus brief behavioural consultation and their relationship with parent competency and child skill acquisition. Following baseline, parents were introduced to an instructional manual on the implementation of ABA teaching strategies. Behavioural consultation was provided in two home visits for a total of 3 hours and two follow-up maintenance visits were completed 2 weeks after home consultation. Parent 1 demonstrated improvement in the overall mean score for competency at each phase, with scores maintained at follow up near 80%. For Parent 2, a steady increase in mean competency scores was observed from baseline to manual plus consultation. This increase was maintained at follow up with a mean score of 90%. Baseline results for child one show a high mean rate of errors and a low rate of correct and prompted trials. Following the introduction of the manual and manual plus consultation phases, correct and prompted responses increased and errors decreased to near zero for two skills, while the control skill responses remained variable. The results for Child 2 across phases show an increasing trend in correct responses, fewer errors and greater use of parent prompts. In the manual plus consultation phase, one skill achieved 100% correct, and a second skill was near errorless. The control skill showed stable improvement but below the level of the other two
