    Free and Open Source Software Licensing : and the Mystery of Licensor's Patents

    The study concerns overlapping intellectual property rights patents and copyrights in computer programs under the US and EU law including the national laws of Finland. The focus of the study is the less frequently studied subject of patents in context of free and open source software (FOSS) licensing and specifically, exhaustion of patents and grant of implied patent licenses in context of FOSS. The main research questions are: What is the exposure to FOSS licensor's patent portfolio based on sale, licensing and/or mere distribution of FOSS? What forms of FOSS licensing may trigger exhaustion of patent rights in computer programs under statutory and/or case law of the US and EU? In what circumstances may FOSS licensing trigger implied patent rights under the US or EU law (mainly laws of Finland in Nordic context) even in the absence of express grant of patent rights in the FOSS (copyright) licenses subject to the study. In order to understand exhaustion of software patents and grant of implied patent licenses, also copyright exhaustion and express copyright licensing as well as related contract theories are examined in FOSS context. In addition to copyright law, also contract law is used as a tool in the study despite that the main research questions concern patent law. The results of the study include that FOSS licensing may constitute sale of software triggering exhaustion of patents in copies of FOSS program. Further, FOSS licensing may trigger, based on the totality of the circumstances, an implied patent license despite that the FOSS licenses subject to the study do not include express patent license grants. Finally, despite the differences in the legal doctrines and concepts of the US and EU law, the exposure to FOSS licensor's patent portfolio based on patent exhaustion or implied patent license may be similar in the different jurisdictions subject to the study.Tutkimus koskee tietokoneohjelmien patenttioikeuksia ja tekijänoikeuksia sekä sitä, mikä vaikutus avoimen lähdekoodin lisensoinnilla on lisenssinantajan (patentinhaltijan) patenttisalkulle. Useat tavanomaiset avoimen lähdekoodin lisenssit, kuten esimerkiksi GPLv2, eivät sisällä nimenomaista patenttilisenssiä. Tutkimuksessa tarkastellaan avoimen lähdekoodin lisensoinnin vaikutusta lisenssinantajan patenttisalkulle kahden patenttiteorian, patenttien sammumisen sekä implisiittisen patenttilisenssin, valossa sekä Yhdysvaltain että Euroopan (erityisesti Suomen) oikeuden näkökulmasta. Patenttioikeuden lisäksi tutkimuksessa käytetään työkaluna tekijänoikeutta ja sopimusoikeutta. Tutkimuksen keskeisiä tuloksia on se, että avoimen lähdekoodin lisensointi voi laukaista sekä patenttien sammumisen että implisiittisen patenttilisenssin tietyin edellytyksin siitä huolimatta, että tarkastelun kohteena olevat avoimen lähdekoodin (tekijänoikeus)lisenssit eivät sisällä nimenomaista patenttilisenssiä.     A framework to apply cloud-based enterprise resource planning in the United Arab Emirates manufacturing companies-a case approach

    Enterprise Resource Planning (ERP) systems provide great benefits to companies. Companies in the Middle East realises that there is an urgent need for understanding ERP adoption and implementation issues since use of ERP systems are still in the early stages in these countries. Also, use of cloud ERP is very limited and there is no much empirical study has been carried out in this field. The purpose of studying this topic is to examine factors that influence the selection and adoption of cloud based ERP in UAE manufacturing companies. A comparative study was carried out in UK and UAE SMEs to evaluate the differences in the perception and application of cloud based ERP. Through empirical study and extensive statistical analysis, the technological and cultural barriers that impede the adaptation and implementation of cloud based ERP successfully in UAE manufacturing companies were recognised. Based on the critical success factors identified in the analysis, a cloud based manufacturing ERP model (CBMERP) with a specific focus on flexibility, scalability, faster deployment, access to advanced technologies and more ease of use was developed. Validation study of CBMERP revealed that UAE SMEs which experimented the proposed model achieved improvement in their manufacturing operations through shorter cycle times, reduced manufacturing costs, improved supply chain management practices and shorter delivery times. This research contributed to the existing body of knowledge by identifying that a significant gap exists in the factors that influence the success of an ERP system in manufacturing SMEs particularly in UAE. This study addressed this gap by providing a conceptual framework of the influential factors involved in the success of a cloud based manufacturing ERP model suited for UAE SMEs

    The development of secretarial and administrative support staff: influential factors in the identification of need

    Merged with duplicate record 10026.1/583 on 27.02.2017 by CS (TIS)Radical advances in microelectronics applications during the 1970's precipitated rapid developments in new office technology which was held to threaten the very existence of the traditional secretarial task role. Many contemporary commentators conceived a correlative link between the emergence of the new technology and the displacement of administrative support staff, whilst others predicted that a form of "Taylorism" was about to invade the office environment with all manner of dehumanising connotations. The reality proved somewhat different and, far from eradicating the role of the secretary or reducing it to assembly-line proportions, the technology helped to facilitate the flattening of organisational structures, thereby exposing secretaries to new opportunities as they asserted control over the new communications. Companies subsequently perceived the benefits of horizontally enlarging secretarial roles to encompass paraprofessional activities such as personnel, finance, sales and marketing, etc., or vertically extending them to undertake supervisory or monitorial tasks that were previously the domain of functional managers. Thus, the training and development of secretarial and administrative support staff became of paramount importance, yet this was frequently left to the vagaries of chance, to the whim of management, or to questionable analytical practices. The following thesis discusses the role of the secretary in its inner and outer context and explores the literature to ascertain weaknesses in contemporary approaches to needs analysis. Moreover, from a survey of Times Top 1,000 Companies, it examines the forces for change that are influencing these organisations and charts the ways that secretarial and administrative support staff are increasingly addressing performance gaps in corporate indices of effectiveness. Equally, in combining a survey of secretaries, it establishes the range of competencies that are considered important in reconciling individual, task and organisational goals and suggests a diagnostic procedure that might effectively accomplish this without the biases and concerns that have resolutely pervaded needs analysis methodologies

    Modellgetriebene Testfallkonstruktion durch Domänenexperten im Kontext von Systemfamilien

    This work presents MTCC (Model-Driven Test Case Construction), an approach to the construction of acceptance tests by domain experts for testing system families based on feature models. MTCC is applied to the application domain of Digital Libraries. The basic hypothesis of this thesis is that the involvement of domain experts in the testing process for members of system families is possible on the basis of feature models and that such a testing approach has a positive influence on the efficiency and effectiveness of testing. Application quality benefits from the involvement of domain experts because tests specified by domain experts reflect their needs and requirements and therefore can serve as an executable specification. One prerequisite for the inclusion of domain experts is tooling that supports the specification of automated tests without formal modeling or programming skills. In MTCC, models of automated acceptance tests are constructed with a graphical editor based on models that represent the test-relevant functionality of a system under test as feature models and finite state machines. Feature models for individual testable systems are derived from domain-level systems for the system family. The use of feature models by the test reuse system of MTCC facilitates the systematic reuse of test models for the members of system families. MTCC is a Model-Driven test automation approach that aims at increasing the efficiency of test execution by automation while keeping independence from the implementation of the testee or the test harness in use. Because tests in MTCC are abstract models that represent the intent of the test independent from implementation specifics, MTCC employs a template-based code generation approach to generate executable test cases.Diese Arbeit stellt den Model-driven Test Case Construction (MTCC) Ansatz zur Konstruktion von wiederverwendbaren Akzeptanztests durch Domänenexperten im Kontext von Systemfamilien vor. Die Hypothese der vorliegenden Arbeit ist, dass die Einbeziehung von Domänenexperten in einen automatisierten Testprozess für die Systeme einer Systemfamilie auf Grundlage eines modellgetriebenen Ansatzes möglich ist und dass ein solcher Ansatz die Effektivität und Effizienz des Testens steigert. Die Qualität von Systemen profitiert von der Einbeziehung von Domänenexperten da deren Anforderungen durch die Tests wiedergegeben werden und diese somit als ausführbare Spezifikation dienen. Eine Voraussetzung für die Einbeziehung von Domänenexperten in das Testen ist eine Form der Werkzeugunterstützung die die Spezifikation von automatisierten Tests ohne Kenntnisse der Programmierung oder der formalen Modellierung gestattet. In MTCC werden abstrakte Modelle von Akzeptanztests mittels eines einfachen, graphischen Editors realisiert der seinerseits auf Modellen basiert die die testrelevant Funktionalität von Testlingen mittels Featuremodellen und endlichen Automaten darstellen. Featuremodelle repräsentieren einzelne Systeme der zu testenden Systemfamilie die von Domänenmodellen auf Ebene der der Systemfamilie abgeleitet sind. MTCC ist ein modellgetriebener Ansatz zur Automatisierung von Tests der der Steigerung der Effektivität der Testausführung dient und zugleich von den Spezifika der Implementierung des Testlings und der jeweiligen Software zur Testausführung entkoppelt. Da Tests in MTCC abstrakte Modelle sind, die die Semantik eines Tests unabhängig von Implementierungswissen ausdrücken, verwendet MTCC ein auf Templates basierendes Verfahren zur Generierung von ausführbaren Testskripten

    Strengthening Young Adult Chinese Adventists in Malaysia in Christian Living

    Problem Progress of the gospel work among the Chinese in Malaysia has been slow. Church growth is insignificant. An important asset of the church—the young people— could be a driving force for church growth. Church leaders need to start a pilot training program catered to the needs of young people, especially helping them to grow in various aspects of their lives, and equipping them to do God’s work. Method An ethnographic approach will be used to review current literature including books, articles, interviews, and questionnaires. For the benefit of the Project Director, the Malaysian culture and the needs of young people as well as church growth data from the Peninsular Malaysia Mission will be obtained and analyzed. Results A strategy for a five-module curriculum in a retreat-style training setting will be developed and implemented. Evangelistic efforts will be carried out as a result of the training program. Monitoring and evaluation of the outcomes of the curriculum design, implementation of the retreat-style training activities, and evangelistic efforts will be tabulated. Hopefully the outcome of the training curriculum will be motivated young people ready to serve God. Conclusions Young Chinese Adventists equipped with knowledge and skills in various aspects of their lives will eventually benefit the church. This is in agreement with Paul’s biblical philosophy of “the more we give, the more we receive.” The success of the curriculum module training will be a positive “push” for additional training programs to be established for the young people, as well as for the church members in general. The training efforts will eventually result in more Chinese churches being planted all over Malaysia

    TrafoDagstuhl brought together representatives of the research communities in re-engineering, XML processing, model-driven architecture and other areas of software engineering that involve grammar- or schema-driven transformations. These various existing fields and application contexts involve widely varying transformation techniques -- the tradeoffs of which are worth analysing. This seminar initiated a process of understanding each other\u27s transformation techniques -- their use cases, corresponding methods, tool support, best practises, and open problems. This process makes it possible to exchange knowledge and experience between these various communities. This effort should also help in transposing transformation concepts from established application fields to new fields. This executive summary reports on the conception of the seminar, the program, outcomes and future work.
