    Information obligations in the Dutch constitutional state

    Administrative compliance obligations incurred by private enterprise entail a vital component of the Dutch democracy. The Netherlands government has to be able to supervise and ensure compliance with laws governing for instance a clean environment and safe labour conditions. Efficient data compilation in this respect is however not always guaranteed, as administrative compliance obligations entail a severe burden for private enterprise. EIM designed the first theoretical framework of this kind to explain the origins, the legal setting and the role of administrative compliance obligations. Amongst others, the study outlines the increasing recognition of (the significance of) administrative compliance obligations.

    The administrative burden reduction policy boom in Europe: comparing mechanisms of policy diffusion

    Much has been written on the diffusion of public management and regulatory reform tools. Available evidence suggests that cross-national policy diffusion is an increasingly significant phenomenon, especially in the European context. While internationalisation of policy discourses and expert communities are regarded as key driving forces of policy diffusion, public management reforms are also said to be particularly vulnerable to mechanisms of 'diffusion without convergence'. This paper analyses the case of policies aiming at reducing administrative burdens of regulations through the lens of the literature on policy diffusion. The diffusion of the so-called Standard Cost Model for measuring administrative burden between 2003 and 2007 is used as a case to explore the mechanisms facilitating policy diffusion in this domain. The analysis reveals patterns of rapid diffusion. This policy boom has been driven by a combination of different mechanisms of policy diffusion rather than by a single driving factor

    En los últimos tempos la educación infantil ha adquirido especial relevancia en el marco de las políticas educacionales de los países latinoamericanos y en especial de Chile (CONTRERAS, HERRERA; LEYTON, 2007; DIEZ, 2011; DUSSAILLANT, 2009; TOKMAN, 2010). La investigación centra su atención en la calidad educativa y, en particular, en los procesos autoevaluativos que demuestran los niños de edades tempranas. Desde una perspectiva paradigmática cuantitativa, apoyada de reportes cualitativos, el estudio presenta la capacidad explicativa de las variables metacognición, autorregulación, autoeficacia, lenguaje y autoconcepto, respecto del desarrollo de la autoevaluación y su vinculación con mejores niveles de logros en párvulos de cinco a seis años. Los hallazgos muestran que la autoevaluación es una dimensión que muestra diversos niveles de expresión en el grupo investigado, fuertemente influenciada por las profesionales del área, tal como se aprecia en los discursos infantiles. Además, las variables analizadas presentan diferentes grados de contribución a la explicación de la autoevaluación en el grupo estudiado

    El trabajo analiza las obligaciones de información a los tomadores de seguro impuestas por la normativa sectorial y la jurisprudencia para la comercialización de productos financieros basados en seguros. La comercialización de esta modalidad de productos plantea dos cuestiones fundamentales: La primera, relativa a su naturaleza jurídica, consiste en determinar, de un lado, si son auténticos seguros o son productos de inversión y, de otro, que elementos resultan necesarios para considerar a estos productos como contratos de seguro. La segunda se refiere a los requisitos exigidos para su comercialización, una vez que se ha determinado su naturaleza asegurativa. A este respecto, la normativa de la Unión Europea ha establecido similares obligaciones de información para la distribución de productos de seguro que la exigida para la comercialización de productos de inversión minorista, aunque considera que la regulación de dichas obligaciones debe plasmarse en la normativa específica de mediación de segurosThe paper analyzes the information obligations to policyholders imposed by the sectoral legislation and the jurisprudence for the commercialization of fi nancial products in the form of insurance. The commercialization of this type of product raises two fundamental questions: The first, concerning its legal nature, is to determine, on the one hand, whether they are real insurances or are investment products and, on the other, what elements are necessary to consider these products as insurance contracts. The second one refers to the requirements required for its commercialization, once its insurance nature has been determined.
