Review of Jan Sowa’s book "The phantom body of the king. Peripheral struggles with modern form", Universitas, Cracow 2012
Pagrindinė recenzuojamos knygos tema – prielaida, kad Lenkija ir kitos Rytų bei Centrinės Europos šalys kenčia nuo lėtinio „neišsivystymo“, kurio šaknų ieškoma praeityje. Recenzijoje didžiausias dėmesys skiriamas vienai iš dviejų knygos temų, t. y. neanalizuojami ekonominiai klausimai, apžvelgiami tik politiniai. Knygoje teigiama, kad tik šalys, patyrusios absoliutinės monarchijos santvarką, vystėsi teisingai. Nagrinėdamas Ernsto Kantorowicziaus idėją, Janas Sowa teigia, kad tokia politinė sistema yra vienintelė šalies stabilumo ir tęstinumo garantija: po karaliaus „fizinio kūno“ mirties išlieka jo „politinis kūnas“. Abiejų Tautų Respublikoje monarchai buvo renkami, o bajorija siekė suverenumo, todėl „politinis kūnas“ išnyko, o šalis tapo „fantomu“.The main thesis of the book reviewed is an assumption that Poland and other countries of East- Central Europe suffer from a chronic underdevelopment, whose sources the Author is trying to find in the past. The review focuses on one of the two main themes of the book, i.e., leaving out the economic issues, it concentrates on the politics. The Author sets out to claim that only those countries develop correctly which have experienced absolute monarchy in their history. Referring to the idea of Ernst Kantorowicz, Jan Sowa assumes that such a political system is the only guarantee of stability and continuity of a country: on the death of the “physical body” of the king, his “political body” continues to last. In Polish-Lithuanian Commonwealth, because of the elective character of the monarchy and the claims of the nobility to play the role of the sovereign, the “political body” disappeared, and the country turned out to be a “phantom body”. For the Author, this means an atrophy of the country following the death of the last Jagiellonian king, Sigismund II Augustus. Between 1572 and 1795 there is no Polish statehood, since the Author regards the Polish-Lithuanian Commonwealth as only an “illusion”. Both the theories presented above and the sources used to prove their correctness raise substantial doubts. The Author confuses basic notions, identifying sovereignty with absolutism, and he makes basic historical mistakes, regarding the Jagiellons’ throne in the Crown of the Kingdom of Poland as hereditary, and also assuming the factual decay of statehood as early as in 16th century, with its symbolic confirmation in 18th century. He finds the grounds for his theories in political theology and psychoanalysis, using historical and legal historical sources to a very limited extent

Z wprowadzenia: "W latach 1990-1998 został wprowadzony samorząd terytorialny w jednostkach
gminnych, powiatowych i wojewódzkich. Jego praktyczne funkcjonowanie wzbudza
szeroką dyskusję społeczną. Krytyce poddaje się rozwiązania prawne, głównie
systemu wyborczego, zmierzające w ostateczności do objęcia przez rządzące siły

Sejmy walne w latach 1588-1598 i ich dorobek ustawodawczy
"Lata 1588-1598 to pierwsze dziesięciolecie rządów Zygmunta III Wazy. Sejmy
zbierają się wówczas z dużą częstotliwością, zgodnie jednak z ówczesnym prawem.
Artykuły henrykowskie przewidywały bowiem obowiązek zwołania sejmu
nie tylko co dwa lata, lecz tak często, jak wymagał tego interes państwa. Powody
były w owym czasie rozmaite. Sejm 1589 r. zebrał się, gdyż obowiązek jego zwołania
został wpisany do recesu sejmu koronacyjnego. Następne obradowały ze
względu na potrzebę zapewnienia bezpieczeństwa państwa. Dwukrotnie również
król zwoływał sejm w celu uregulowania wszelkich niezbędnych spraw przed
swoim odjazdem do Szwecji, zaplanowanym na 1593 oraz 1598 r. Na pierwsze
dziesięciolecie rządów Zygmunta III Wazy przypada zatem 10 sejmów. W każdym
kolejnym roku, z wyjątkiem 1594 r., dochodzi do zwołania sejmu walnego."(...

Prawne i polityczne uwarunkowania wolności słowa w Rzeczypospolitej
The article concerns importance of freedom of speech in the public debate. It is one of the most
important and fundamental conditions for the development of democracy and building of civil
society. This is a liberty that requires responsibility for what is said. It may cause plenty of damage
when lies are resorted to as a method of attaining goals at any cost. Such instances destroy
the truth in its capacity of an extremely important value in public life. Fight for the truth takes
courage. From its earliest days to the contemporary times, the history of the Polish state provides
an excellent example of the significance of freedom of speech, attempts at its curtailment until
complete abolition, and grappling with lies used as a tool for propaganda and manipulation.Dieser Beitrag setzt sich mit der Bedeutung der Meinungsfreiheit für die öffentliche Debatte
auseinander. Die Meinungsfreiheit ist eine der grundlegendsten und wichtigsten Bedingungen
für die Gestaltung der Demokratie und der Zivilgesellschaft. Es ist eine Freiheit, die auch der
Verantwortung für das Wort bedarf. Sie kann viele Schäden einrichten, wenn Lüge als Methode
der Zielerreichung um jeden Preis angenommen wird. Dann wird die Wahrheit, als ein für das
öffentliche Leben sehr bedeutender Wert, geradezu vernichtet. Der Kampf um die Wahrheit

Beispiel für die Bedeutung der Meinungsfreiheit, für die Versuche, sie zu Beschränken oder
gänzlich zu eliminieren, sowie für das Ringen gegen die Lüge als Werkzeug der Propaganda und
Manipulation
