    Labour rights of fishers in Namibia

    Fishers make an important contribution to the global economy and add value to a country’s gross domestic product. Their contribution is even more important in countries such as Namibia that rely heavily on the fishing industry as a source of income. The working conditions of fishers have recently come under scrutiny as a result of poor labour standards when compared to employees ashore. A background of the working conditions of fishers is provided illustrating the unique working conditions of the fishing industry. After that the international standards, namely those of the United Nations and the International Labour Organisation (hereinafter referred to as “the ILO”), are discussed and the challenges in the regulations of the condition of employment of fishers are pointed out. The ILO recently adopted the Work in Fishing Convention (hereinafter referred to as “the WIFC”) in 2007, which is the primary instrument applicable to fishers’ conditions of employment. Namibia has not ratified the Convention and, as a result, it has no legal obligation to comply with the standards it sets. The international standards were tested against the national legislation of Namibia. This was done to determine the extent of Namibia’s compliance with those standards. The dissertation revealed that, if Namibia were to immediately ratify the Convention it would not conform with the standards and, as a result, would be in breach of its international obligation. The dissertation takes a step further by comparing the approach taken in regulating the conditions of employment in Namibia to the approach taken in South Africa. The purpose of the comparison is to determine the lessons Namibia can learn, if any, to improve the regulation of the condition of employment for its fishers. The dissertation 7 reveals that there are lessons Namibia can learn from South Africa to improve the conditions of employment of the fishers. These lessons relate to introducing a bargaining council and, where necessary, statutory councils for the fishing industry. The introduction of a bargaining council and statutory councils would give organisations such as trade unions more power to negotiate a general standard across multiple sectors within the fishing industry. The standards that are negotiating could incorporate the standards provided in the WIFC even though Namibia has not ratified the convention

    Polycentric regional ocean governance opportunity in the Benguela current convention

    The Benguela Current Convention (BCC) has been operational for a decade and has emerged from the precursor natural and fisheries science large marine ecosystem programs. This regional ocean governance institution emerged indigenously as an intergovernmental working arrangement across the Republics of Angola, Namibia, and South Africa. The Convention has been described as a Centralized Authority mode of regional ocean governance. This paper explores this description with reference to the ecosystem-based approach to marine management. The study is focused on the level of working arrangements within the Convention and its Commission across the national and regional scales. It finds that the BCC does meet the theoretical criteria of a polycentric governance mechanism at the resolution of its operations. Polycentric ocean governance mechanisms are valued in regional ocean governance as they potentially offer greater impact through higher levels of coordination, code sign, and integration. Polycentric governance systems incorporate multiple centers of authority that operate at different scales. Existing instances and further opportunities for polycentric governance mechanisms within the working arrangements of the Convention are identified for the Southeast Atlantic

    This Chapter analyzes the major underlying causes of marine biodiversity loss and focuses specifically on the lessons learnt for transformative ocean governance in the context of area-based management and spatial planning. It illustrates the broad recognition of the vital need for integrative, anticipatory, adaptive and inclusive governance of ocean biodiversity. Fundamentally, however, the Chapter underscores the need for transdisciplinary governance in supporting integration, inclusion and learning in ocean affairs for transformative change. An alternative governance approach is proposed: building on the inter-dependencies between human rights and marine biodiversity, a broader approach to fair and equitable benefit-sharing can support institutionalized shifts towards more transdisciplinary, integrative, inclusive and adaptive governance for the ocean at different scales

    The ocean’s enormity and depth are illustrated by the limited ability of humankind to comprehend it. The current science and policy seascape remains largely fragmented, and as a result the integrity of marine life and the well-being of those (human and nonhuman) dependent on a healthy ocean is being negatively impacted. Fragmented governance is an indirect driver of ocean biodiversity loss due to its inability to provide synergistic solutions to address simultaneously multiple direct drivers for such loss (overfishing, land-based and marine pollution, and climate change). This governance problem is well known (Kelly et al., 2019; Watson-Wright and ValdĂ©s, 2018), and to some extent it is being addressed in ongoing international negotiations on an international instrument on marine biodiversity of areas beyond national jurisdiction (A/RES/72/249, 2017)

    Transdisciplinarity in transformative ocean governance research—reflections of early career researchers

    This paper interrogates the concept of transdisciplinarity, both theoretically and practically, from a perspective of early career researchers (ECRs) in transformative ocean governance research. Aiming to advance research methodologies for future complex sustainability challenges, the paper seeks to illuminate some common uncertainties and challenges surrounding transdisciplinarity from a marine science perspective. Following a literature review on transdisciplinary research, workshops, and a series of surveys, we determine that transdisciplinarity appears to be a concept in search of definition, and that there is a need to explore transdisciplinarity specifically from an ocean research perspective. The paper discusses a number of challenges experienced by ECRs in conducting transdisciplinary research and provides recommendations for both ECRs wishing to undertake more equitable transdisciplinary research and for the UN Decade for Ocean Science to support ECRs in this endeavour (Figure 1). Based on our findings, we interrogate the role of non-academic collaborators in transdisciplinary research and argue that future transdisciplinarity will need to address power imbalances in existing research methods to achieve knowledge co-production, as opposed to knowledge integration
