    Rethinking Criminal Law and Family Status

    In our recent book, Privilege or Punish: Criminal Justice and the Challenge of Family Ties (OUP 2009), we examined and critiqued a number of ways in which the criminal justice system uses family status to distribute benefits or burdens to defendants. In their review essays, Professors Alafair Burke, Alice Ristroph & Melissa Murray identify a series of concerns with the framework we offer policymakers to analyze these family ties benefits or burdens. We think it worthwhile not only to clarify where those challenges rest on misunderstandings or confusions about the central features of our views, but also to show the deficiencies of the proposed alternatives. While we appreciate and admire the efforts of our critics to advance this important conversation, we hope this Essay will illuminate why the normative framework of Privilege or Punish remains a more helpful structure to policymakers assessing how family status should intersect with the criminal law within a liberal democracy such as our own

    Criminal Justice and the Challenge of Family Ties

    This Article asks two basic questions: When does, and when should, the state use the criminal justice apparatus to accommodate family ties, responsibilities, and interests? We address these questions by first revealing a variety of laws that together form a string of family ties subsidies and benefits pervading the criminal justice system. Notwithstanding our recognition of the important role family plays in securing the conditions for human flourishing, we then explain the basis for erecting a Spartan presumption against these family ties subsidies and benefits within the criminal justice system. We delineate the scope and rationale for the presumption and under what circumstances it might be overcome. When the presumption is overcome, we urge distributing the benefit on terms that are neutral to family status, if possible, with a focus instead on functions served by established relationships of care-giving responsibility

    We compute the resummed hadronic transverse energy (E_T) distribution due to initial-state QCD radiation in vector boson and Higgs boson production at hadron colliders. The resummed exponent, parton distributions and coefficient functions are treated consistently to next-to-leading order. The results are matched to fixed-order calculations at large E_T and compared with parton-shower Monte Carlo predictions at Tevatron and LHC energies.Comment: 24 pages, 15 figure

    Climate Teleconnections and Recent Patterns of Human and Animal Disease Outbreaks

    Interannual climate variability associated with the El Niño/Southern Oscillation (ENSO) phenomenon and regional climatic circulation mechanisms in the equatorial Indian Ocean result in significant rainfall and ecological anomaly patterns that are major drivers of spatial and temporal patterns of mosquito-borne disease outbreaks. Correlation and regression analyses of long time series rainfall, vegetation index, and temperature data show that large scale anomalies occur periodically that may influence mosquito vector populations and thus spatial and temporal patterns of Rift Valley fever and chikungunya outbreaks. Rift Valley fever outbreak events occurred after a period of ∼3–4 months of persistent and above-normal rainfall that enabled vector habitats to flourish. On the other hand, chikungunya outbreaks occurred during periods of high temperatures and severe drought over East Africa and the western Indian Ocean islands. This is consistent with highly populated environmental settings where domestic and peri-domestic stored water containers were the likely mosquito sources. However, in Southeast Asia, approximately 52% of chikungunya outbreaks occurred during cooler-than-normal temperatures and were significantly negatively correlated with drought. Besides climate variability, other factors not accounted for such as vertebrate host immunity may contribute to spatio-temporal patterns of outbreaks

    Absolut “copper catalyzation perfected”; robust living polymerization of NIPAM : Guinness is good for SET-LRP

    The controlled polymerization of N-isopropyl acrylamide (NIPAM) is reported in a range of international beers, wine, ciders and spirits utilizing Cu(0)-mediated living radical polymerization (SET-LRP). Highly active Cu(0) is first formed in situ by the rapid disproportionation of [Cu(I)(Me6-Tren)Br] in the commercial water–alcohol mixtures. Rapid, yet highly controlled, radical polymerization follows (Đ values as low as 1.05) despite the numerous chemicals of diverse functionality present in these solvents e.g. alpha acids, sugars, phenols, terpenoids, flavonoids, tannins, metallo-complexes, anethole etc. The results herein demonstrate the robust nature of the aqueous SET-LRP protocol, underlining its ability to operate efficiently in a wide range of complex chemical environments

    KELT-1b: A Strongly Irradiated, Highly Inflated, Short Period, 27 Jupiter-mass Companion Transiting a mid-F Star

    We present the discovery of KELT-1b, the first transiting low-mass companion from the wide-field Kilodegree Extremely Little Telescope-North (KELT-North) survey. The V=10.7 primary is a mildly evolved, solar-metallicity, mid-F star. The companion is a low-mass brown dwarf or super-massive planet with mass of 27.23+/-0.50 MJ and radius of 1.110+0.037-0.024 RJ, on a very short period (P=1.21750007) circular orbit. KELT-1b receives a large amount of stellar insolation, with an equilibrium temperature assuming zero albedo and perfect redistribution of 2422 K. Upper limits on the secondary eclipse depth indicate that either the companion must have a non-zero albedo, or it must experience some energy redistribution. Comparison with standard evolutionary models for brown dwarfs suggests that the radius of KELT-1b is significantly inflated. Adaptive optics imaging reveals a candidate stellar companion to KELT-1, which is consistent with an M dwarf if bound. The projected spin-orbit alignment angle is consistent with zero stellar obliquity, and the vsini of the primary is consistent with tidal synchronization. Given the extreme parameters of the KELT-1 system, we expect it to provide an important testbed for theories of the emplacement and evolution of short-period companions, and theories of tidal dissipation and irradiated brown dwarf atmospheres.Comment: 30 pages, 19 figures.     Quantum dynamics as a physical resource

    How useful is a quantum dynamical operation for quantum information processing? Motivated by this question we investigate several strength measures quantifying the resources intrinsic to a quantum operation. We develop a general theory of such strength measures, based on axiomatic considerations independent of state-based resources.
