    Oracle in Brussels

    It was hands across the water when both a U.S. district court and the European Commission cleared the $10.3 billion merger of Oracle and PeopleSoft. The Department of Justice, which had opposed the deal, had decided not to appeal its defeat in the San Francisco court, and it is thought that the Commission took this as a sign that U.S. regulators would not take it amiss if their European counterparts also let the merger proceed. In any event, there was none of the resentment and outrage that bubbled over not so long ago when U.S. antitrust authorities approved the GE/Honeywell deal and their European counterparts killed it. With Oracle/PeopleSoft, convergence was the word of the day. But a close look at the U.S. court decision and the European regulatory ruling in late 2004 reveals how often the San Francisco judge and the Brussels authorities took dramatically different approaches to important components of their decisions. Two lawyers representing Oracle before the European Commission, Wilmer Cutler Pickering Hale and Dorr ’s Sven Völcker and Christian Duvernoy of the firm’s Brussels office, identify no fewer than six key issues on which the American court and the European Commission took diametrically opposed positions. Fielding a team led by former Director-General of DG Competition at the European Commission, Claus-Dieter Ehlermann, Wilmer was EU antitrust co-counsel to Oracle together with long-standing European antitrust2004 when the bidder announced that it had at last gained control of its target. Oracle CEO Lawrence Ellison had been reviewing strategic acquisitions for some time and PeopleSoft had been on his list of candidates. Larry Ellison has said publicly that software is due for consolidation and he clearly wanted to be a survivor

    N° ISBN - 978-2-7380-1284-5International audienceThis paper results from an on-going research on the interconnections between rural development processes and farming development in the South of France. (Haute-Garonne and Tarn departments). We elaborate a tool to classify the links between farming and territorial development in territorial projects, according to two geographical theories of territoriality. We have analysed the representations of farming in three sample “Pays” (cross-municipality structures with participatory local development attributions, plus, in some cases, land planning attributions) in the vicinity of Toulouse, the 4th largest city in France. These territories share the same twofold feature: a deep and increasing intertwining of urban development and rural land uses, and the preservation of their rural character as an identity label. In each case, we have examined the local territory project and operation documentation, and conducted interviews with the major actors in territorial planning and farming development institutions in the area. This research leads to a comparative assessment of the underlying creative thinking in each territorial project, and more particularly how farming activities and land use are included in the different territorial projects

    Une agriculture multifonctionnelle dans le projet urbain : quelle reconnaissance, quelle gouvernance ?

    The recognition of the multifunctional character of agriculture and its translation in development projects change the local governance of these projects. Through various international study cases, this paper presents theways of implication agriculture in urban management projects. In these projects, the arena of decisions changes with new stakeholders and new concertation procedures. At first, we will present how the multifunctionality of urban and periurban agriculture is recognized and what is the legitimacy of this type of agriculture in local public policies. In a second part, we will present the translation of urban agriculture functions in town planning documents. In the last part of this paper, we will present the different stakeholders involved in those projects, focusing on the agricultural institutions.La reconnaissance de la multifonctionnalitĂ© de l'agriculture et sa mise en Ɠuvre explicite dans des projets de dĂ©veloppement (urbains ou agricoles) se traduit par des changements dans la gouvernance de ces projets. En s'appuyant sur des Ă©tudes de cas dans diffĂ©rents pays, cet article traite plus spĂ©cifiquement des modes d'intĂ©gration de l'agriculture aux projets urbains. Dans ce cas, le contenu des projets d'amĂ©nagement ainsi que le processus de dĂ©cision sont modifiĂ©s. La prise de dĂ©cision se complexifie avec l'Ă©mergence de nouvelles parties prenantes et le dĂ©veloppement des procĂ©dures de concertation. Les modes de reconnaissance d'une agriculture urbaine et pĂ©riurbaine multifonctionnelle et les Ă©lĂ©ments de la lĂ©gitimitĂ© d'une action publique locale sur cette agriculture sont tout d'abord prĂ©sentĂ©s. Pseudo AV block was related to the presence of premature junctional or ventricular beats with concealed conduction. Response to therapy confirmed the initial diagnosis of pseudo AV block. Awareness of clinical conditions simulating type II second degree AV block is important because of the therapeutic implications and prognosis
