The ideal of the certainty in law: the skin and the heart of law

The doubt about certainty like an absolute value in law and as an ideal full in legal system (argument about impossibility) is a controversial fact in contemporary legal theory. In this text I examine some contemporary doctrines about the classic understanding (in critical sense) of this ideal. I have selected the most representative doctrines: doctrine about "open texture of Law" (H.L.A. Hart), starting point in this discussion; doctrine about "Il Diritto mite" (G. Zagrebelsky), from the continental European legal tradition at present; and doctrine about "vagueness in Law" (T.A.O. Endicott), this doctrine is the most recent, from the Anglo-Saxon legal tradition. Finally, in Conclusions, I analyze if this doubt (argument about impossibility) contaminates (in some sense) to the concept of law or to the characteristics that describe law in the contemporary Constitutional State

Living the creed: How chapters of Sigma Lambda Beta International Fraternity, Inc., contribute to civic engagement

National associations such as the Association of American Colleges and Universities (AAC&U) and Campus Compact create initiatives that promote service-learning and campus based service programs to improve civic engagement in higher education; they often fail to include Greek-letter organizations, especially Latino Greek-letter organizations, as co-curricular service opportunities. The purpose of this exploratory case study of five chapters of Sigma Lambda Beta International Fraternity Inc. (SLB) in the Midwest region of the United States, was to provide an in-depth understanding of chapters’ service experiences and perceptions of benefits. In this qualitative study, a revised version of Yosso’s (2005) community cultural wealth served as a conceptual framework to illustrate how chapters of SLB contribute to service. Implications for higher education and the Executive Office of SLB are discussed as well as recommendations for future research

Computing the Component-Labeling and the Adjacency Tree of a Binary Digital Image in Near Logarithmic-Time

Connected component labeling (CCL) of binary images is one of the fundamental operations in real time applications. The adjacency tree (AdjT) of the connected components offers a region-based representation where each node represents a region which is surrounded by another region of the opposite color. In this paper, a fully parallel algorithm for computing the CCL and AdjT of a binary digital image is described and implemented, without the need of using any geometric information. The time complexity order for an image of m × n pixels under the assumption that a processing element exists for each pixel is near O(log(m+ n)). Results for a multicore processor show a very good scalability until the so-called memory bandwidth bottleneck is reached. Infractores, víctimas y características del abuso sexual contra menores en España

Esta investigación se encuadra en la fase de diagnóstico del proyecto de investigación estatal I+D+i "Valoración de la eficiencia e impacto de la respuesta social y jurídica a la pederastia a partir del análisis criminológico" (DER2015-67303-P). Con el objetivo de proporcionar evidencia empírica sobre la cual proponer respuestas jurídico-penales y criminológicas más eficaces a la pederastia, este capítulo analiza las características de los infractores, las víctimas y el abuso sexual contra menores en España a partir de un análisis sistemático de 945 sentencias condenatorias de Audiencias Provinciales españolas. Los resultados permiten concluir que el abuso sexual a menores se produce en el ámbito intrafamiliar del menor, y que responde a las patrones relacionados con las actividades cotidianas de infractores y víctimas. Este estudio, además, introduce el análisis de la duración del abuso y su relación con las características de las víctimas, los agresores y la situación en la que se comete el abuso. Los resultados obtenidos permiten concluir que el abuso de larga duración está asociado con el que se da en el contexto intrafamiliar sobre víctimas mujeres de entre cinco y diez años en la casa donde conviven víctimas y agresores. Estos resultados refuerzan la conclusión de que el abuso sexual infantil está determinado por factores de oportunidad. Los esfuerzos en la prevención del abuso sexual infantil, así como la propuesta de medidas penales, deben ir por tanto encaminadas principalmente a luchar contra el abuso sexual a menores en el contexto intrafamiliar

Un proceso de remodelación radical del espacio funcional y social, inducido por el nuevo régimen de acumulación: la destrucción de la memoria histórica y del patrimonio urbano

El rescate de la cuestión del patrimonio de su habitual confinamiento en el campo de la cultura, donde se elabora con materiales ideológicos diversos que alteran y desvirtúan su naturaleza, para situarlo en la encrucijada de los fenómenos sociales y urbanos, se ha venido realizando según patrones propios de las ciudades europeas. Estos patrones que aspiran a generalizarse son de difícil aplicación en otras realidades. De ahí la importancia de confrontarlos con diversos procesos de transformación de la sociedad y de su sustrato material. En ese sentido, las transformaciones del centro de Guadalajara a mediados del siglo XX que suponen la eliminación casi total del patrimonio urbano de la ciudad, ofrecen un ejemplo bien diferente de remodelación radical del espacio funcional y social, inducido por el nuevo régimen de acumulación que se despliega en esas fechas y que permite reflexionar en otro contexto sobre el sentido, las alternativas y oportunidades de introducir la dimensión patrimonial en la evolución de la ciudad.The rescue of the issue of patrimony in its cultural confinement has been conducted according to patterns of European cities. Criminólogos : instrucciones de uso : un análisis de futuras líneas aplicadas en criminología

La figura del criminólogo en España tiene una tradición muy reciente. Hace apenas unos años que comenzaron a aprobarse los primeros títulos oficiales en Criminología, y es ahora cuando están egresando los primeros titulados. Sin embargo, la creciente oferta y demanda de títulos en Criminología contrasta con el mercado laboral, donde la presencia de criminólogos es prácticamente nula. Las razones pueden encontrarse en su relativa juventud y la multidisciplinariedad que caracteriza su ciencia, mal entendida por la sociedad. Por ello, este trabajo pretende analizar aquellos ámbitos en los que se debería incluir la figura del criminólogo. Del análisis realizado se concluye que el criminólogo es un profesional adecuado y necesario para el correcto funcionamiento de importantes parcelas de la sociedad. Sin embargo, la situación en la que se encuentra ahora, unida a algunos problemas a los que debe hacer frente (v.g. falsas creencias sobre el objeto de estudio de esta ciencia), requiere de distintas acciones que promocionen la Criminología entre la sociedad española, mediante la ruptura de prejuicios y la difusión de sus conocimientos
