    Post legal positivism: new paradigm of legal science (jurisprudence) and practice in Brazil

    The relation between law, moral, society and science is shifting in Brazil as it is changing in democratic contemporary societies. This paper proposes to reflect about this change in the Brazilian legal and social context. Jurisprudence and legal practice have been transformed intensively after the Brazilian redemocratization that began in 1985 and Federal Constitution of 1988. In the field of Jurisprudence (Legal Theory), a new legal theory called post-positivism progressively has been overcoming legal critical studies and legal positivism. In recent years, ideas as any moral values can be improved by law (positivism) or law is one of many oppressive institutions in capitalist society (legal critical studies – Marxism) have been losing place in legal theory. Nowadays, when Brazilian Constitution implements just society and legal system, different from the authoritarian military regime (1964 – 1985), it is difficult to work with a complete relativistic idea of law (positivism) or difficult to accept that law is necessarily oppressive in capitalistic societies. Otherwise the idea of science in law at post-positivistic point of view try to overcome in a dialectic way a pure science methodology (normativistic positivism) and the complete political and economic studies of law (critical legal studies – Marxism). After that, the text will show that Brazilian legal practice have changed intensively after post positivistic methodology of law and will reflect about same dilemmas of post-positivism in Brazil in the legal theory and practice

    Todo empreendimento, inclusive na área de saúde, necessita, antes de ser implantado, da elaboração de um plano de negócios, buscando um dimensionamento eficaz e eficiente para o mesmo. Todos os custos de implantação e de manutenção no mercado por pelo menos cinco anos, devem ser considerados. A não realização desse plano pode levar o negócio à falência. Nesse trabalho, será descrito o caso de uma Clínica Médica Popular, situada em Nova Iguaçu, Baixada Fluminense do Rio de Janeiro, que não elaborou um plano de negócios antes de implantá-la, propiciando um cenário negativo atual. Dessa forma, serão listados os erros cometidos, bem como as ações estratégicas que podem minimizar o impacto trazido por um erro que não se admite mais, nos dias atuais.All enterprises, including those in the healthcare area, need to be prepared, before being implemented, to develop a business plan, seeking an effective and efficient design for it. All market deployment and maintenance costs for at least five years should be considered. Failure to accomplish this plan can lead to bankruptcy. In this paper, it will be described the case of a Popular Medical Clinic, located in Nova Iguaçu, Baixada Fluminense, Rio de Janeiro, which did not previously elaborate a business plan, providing a current negative scenario. This will list the mistakes made, as well as the strategic actions that can minimize the impact of an error that is no longer admitted today

    Whole-Body Vibration Exercise as an Intervention to Improve Musculoskeletal Performance

    The exposure of individuals to mechanical vibrations produced in vibrating platform can generate whole-body vibration (WBV) exercise. This modality of exercise represents a less tiring alternative to sport, which could benefit mechanical human behavior and prevent sports injuries and musculoskeletal disorders. The specificity of the human body, articulated and connected segments, requires to take into account the biomechanical parameters in protocols involving WBV exercise. Moreover, work time, rest time between the bouts in each session number of sessions, extension of the intervention, and week periodicity must be also well established. Responses to WBV exercise are observed at musculoskeletal, neurological, endocrinological and vascular levels. With respect to the musculoskeletal level, it is verified increase of muscle strength, endurance and power, improvement of the balance, increase of bone mineral density and the decrease of risk of falls. There are several tools to evaluate the responses of the body to WBV exercise. The aim of this chapter is to highlight the relevance of the WBV exercise as an intervention of the physical therapy for the better human optimization
