    Fédéralisme et mariage entre personnes du même sexe. Quelques enseignements après United States v. Windsor

    International audienceThe case United States v. Windsor, judged by the Supreme Court of the United States in June 2013, posed a double issue: first, the existence or not of constitutional basis for the federal definition of marriage (DOMA), a matter connected with federalism and the balance of power in the U.S. federal system, and second, the case question concerning the validity and federal recognition of same-sex marriages celebrated according to States' law. To the extent that the contemporary debate on the normative principles of federalism is in a phase of profound doubts and interrogations, it may be useful to analyze the key findings of Windsor on federalism, for the sake of a better understanding of the federal principle in advanced democracies. On the other hand, to the extent that federalism is, as we shall see, the key to Windsor judgment, we will try to explain how federalism can be considered an effective argument in the defense and promotion of same-sex marriage. Windsor's analysis should help, on the one hand, to a better understanding of what federalism means in democracy, and on the other, to clarify the terms of democratic debate on same-sex marriage, often more or less disconnected from some fundamental democratic principles (majority rule, separation of powers, etc.)

    This article presents an analysis of the philosophical bases of the integral federalism of P J Proudhon, as well in its historical process and its reception and its influence in Spain, by means of Pi y Margall, as in its real topicality in the current Spanish and European political debate. The author centers his study on the Proudhon’s cognitive theory or dialectical serial, key factor, in his opinion, not to fall in groundless conclusions, like that of alleged sound hegelianism, idealism abstracted, utopism, etc., so frequents unfortunately among the researchers who direct or indirectly have dealt with his thought.Este artículo trata de presentar un análisis de las bases filosóficas del federalismo integral de P. J. Proudhon, tanto en su proceso histórico y su recepción e influencia en España, por medio de Pi y Margall, como en su actualidad efectiva en el actual debate político español y europeo. El autor se centra en el estudio de la teoría cognitiva o dialéctica serial de Proudhon, clave en su opinión para no caer en conclusiones infundadas, como la de su supuesto hegelianismo, idealismo abstracto, utopismo, etc., tan frecuentes por desgracia entre los estudiosos que directa o indirectamente se han ocupado de su pensamiento

    [Resumo] O Centro de Iniciativa para la Nueva Organización de Galicia nace en Santiago, en xuño de 1873, e pode considerarse como a primeira tentativa colectiva seria feita dende Galicia para pensar o federalismo e o lugar de Galicia na federación española. O coñecemento que hoxe se ten daquel pioneiro ensaio galego en prol do federalismo é, naturalmente, o que nos dá a historiografía galega, a cal se refire en non poucos casos ao devandito centro dun xeito moi significativo, pois de Centro de Iniciativa pasa a Centro de Iniciativas. Agora ben, por que engadir un onde non o hai? Que é o que ese plural nos está a dicir? Neste traballo téntase amosar que ese silencia ou desactiva, sen dúbida involuntariamente, unha parte fundamental da filosofía federal no pensamento do pacto, imposibilitando deste xeito o bo entendemento tanto, historicamente, do proxecto do centro, como a maiores, normativamente, da idea federal.[Abstract] The Centro de Iniciativa para la nueva organización de Galicia was founded in Santiago de Compostela in June 1873. It may be considered Galicia’s first serious collective attempt to think about federalism and to reflect its place within the Spanish federation. All we know today about this pioneering attempt in pursuit of federalism is naturally provided by Galician historiography, which refers in a not inconsiderable number of cases to the Centro, and in a way which is all the more meaningful since the term Centro de Iniciativa has gradually turned into Centro de Iniciativas. What is this plural supposed to mean? In this paper, we will try to explain that this silences or deactivates, although in an undoubtably involuntarily manner, a fundamental part of the philosophy of the federalist pact.     Photoluminescence Stokes shift and exciton fine structure in CdTe nanocrystals

    The photoluminescence spectra of spherical CdTe nanocrystals with zincblende structure are studied by size-selective spectroscopic techniques. We observe a resonant Stokes shift of 15 meV when the excitation laser energy is tuned to the red side of the absorption band at 2.236 eV. The experimental data are analyzed within a symmetry-based tight-binding theory of the exciton spectrum, which is first shown to account for the size dependence of the fundamental gap reported previously in the literature. The theoretical Stokes shift presented as a function of the gap shows a good agreement with the experimental data, indicating that the measured Stokes shift indeed arises from the electron-hole exchange interaction.Comment: 8 pages, 4 figures, LaTe
