Sytuacja prawna osób wykonujących pracę nakładczą

intérêt pour l'économie nationale, Cependant le travail à domicile n'est pas réglé
en Pologne de la façon qu'il mériterait. D’abord il n'existe pas de règles suffisantes
relatives au londement de l'emploi en question, ce qui ne contribue pas à clarifier
La situation juridique de ceux qui exécutent ce travail. Le doute essentiel qui surgit
est celui de savoir s'il faut leur donner le statut de travailleur ou bien celui des personnes
bénéficiant do certains droits do travailleur seulement. La présente étude analyse la situation juridique des personnes exécutant un travail
à domicile. Le problème clé est ici celui des sources juridiques et du caractère
du contrat de travail à domicile. S'il faut établir quelles sont les sources juridiques
de ce contrat c'est parce qu'il n’apparait séparément ni dans le code civil ni dans
le code du travail. Il n'est pas réglé non plus par d'autres dispositions légales. En
partie seulement il est concerné par le règlement du Conseil des ministres du 31 décembre
1975 sur les droits de travailleur des personnes exécutant un travail à domicile.
Il est vrai que le contenu de ce contrat a été défini par deux actes juridiques
rendus en vertu de ce règlement et contenant un modèle et un règlement du travail
à domicile, mais aucun de ces actes no remplit les conditions qui permettraient de lo
qualifier de source du droit. L'auteur admet donc qu'aux matières non réglées par
le règlement précité et relatives au contrat de travail à domicile sont directement
applicables les dispositions de la partie générale du code civil et les dispositions générales
du droit des obligations, ainsi que — par analogie — les dispositions sur les
contrats nommés réglés dans la partie spéciale du droit des obligations. En ce qui concerne le contrat de travail à domicile l'auteur aborde l'important
problème de savoir dans quelle branche du droit il y a lieu de classer les dispositions
du règlement précité. Cet acte a été rendu en vertu de l'art. 303 § 1 du code
du travail, mais cela ne saurait impliquer l’insertion de ces dispositions dans le
droit du travail. En effet cette branche du droit ne contient que les dispositions qui
règlent le rapport de travail et les autres rapports juridiques qui s'y rattachent.
Aussi, comme ce règlement règle un rapport d'obligation autre que le rapport de
travail, ne fait-il pas partie du droit du travail. Bien qu'elles restent en d -hors du droit du travail les normes du règlement en question sont unilatéralement, absolument obligatoires, c'est-à-dire qu'elles ont un
caractère propre à cette branche du droit. L’étude démontre qu’il existe des motifs
justifiant l'application de l'art. 18 du code du travail aux travailleurs à domicile,
disposition garantissant un tel fonctionnement dos règles du droit du travail. Il est vrai que cette disposition n'est pas mentionnée dans le règlement en question, mais la communauté d'objectifs des règles du droit du travail et du règlement de 1975 autorise à affirmer que les droits de travailleur accordés à ceux qui exécutent un
travail à domicile doivent bénéficier de la même protection que celle dont jouissent
les travailleurs. Le problème suivant abordé dans l'étude' c'est le caractère du contrat de travail
à domicile. Л cet effet, en s’appuyant sur l'état juridique existant et sur la
pratique établie, l'auteur analyse de laçon détaillée les éléments constitutifs de la
construction de. ce contrat, c'est-à-dire les sujets et l'objet de l'obligation ainsi que
les devoirs des parties.Du point de vue de la protection juridique qu'il convient d'assurer aux travailleurs
à domicile l'auteur juge que la meilleure solution consisterait à insérer le contrat
de travail à domicile dans les dispositions du droit du travail. On pourrait le faire
en étendant l'objet du droit du travail aux rapports juridiques qui obligent, comme
le rapport de travail, à exécuter un travail dans le cadre d'un lien durable unissant

Rola Kodeksu pracy w ochronie dóbr osobistych stron stosunku pracy
According to the thesis proposed in the article the Labour code does not ensure equal level of protection for both parties to the employment contract. It evidently gives preferential treatment to the employee, for the protection of employees’ personal value is a fundamental rule of labour law. It is suggested to introduce the rule of the employer’s personal values protection as one of the de lege ferenda conclusions. It would lead to a change in the perception of the protective role of labour law as a factor ensuring protection for both parties to the employment contract.W artykule postawiono tezę, że Kodeks pracy nie zapewnia w równym stopniu ochrony dóbr osobistych obydwu stronom stosunku pracy, wyraźnie preferując w tej ochronie pracownika, wobec którego traktuje ochronę tych dóbr jako podstawową zasadę prawa pracy. The Labour Code in art. 227 distinguishes two categories of diseases, that may occur in relation to work — occupational diseases and other diseases caused by working environment. In those both cases employer is required to do conduct appropriate preventive measures. However, only in occupational diseases case the list, recognition procedure and social security benefi ts that derived from those, was defi ned. In case of other, not directly defi ned diseases caused by working environment, only civil law procedure is available for aggrieved employee. Therefore, it was proposed, that legislator should clearly defi ne the procedure for certifi cation of such disease caused by working environment, as well as the scope of benefi ts that aggrieved employee is entitled to.

The Concept of the Common Good According to John Paul II – the Implications for Collective Labour Law
The author presents the view that collective labour law values are, inter alia, derived
from the achievements of the social doctrine of the Catholic Church. One of such values
is the common good. John Paul II refers to it many times. According to Him it is a personal
value that liberates from selfishness and vested interests. The essence of collective labour
law is based on a sense of the common good category, understood as a right expressing
a compromise between different interests. Means to implement that common good which
leads to social peace is a social dialogue. There are many regulations aimed at a social dialogue,
in particular, the provisions specifying the procedure for conducting negotiations

Ochrona danych osobowych w działalności społecznej inspekcji pracy
Społeczna inspekcja pracy będąca szczególną formą związkowej reprezentacji pracowniczej jest uprawniona do sprawowania kontroli nad pracodawcą w zakresie przestrzegania przez niego przepisów prawa pracy. Realizacja funkcji kontrolnej łączy się z potrzebą dostępu społecznego inspektora pracy do informacji i dokumentów, które mogą zawierać dane osobowe pracowników. W opracowaniu postawiono tezę, że społeczny inspektor pracy jest podmiotem przetwarzającym dane osobowe pracowników w imieniu zakładowej organizacji związkowej, która jest administratorem tych danych, zaś podstawą przetwarzania danych osobowych pracowników są odpowiednie przepisy RODO. Tezy postawione w opracowaniu posłużyły krytyce stanowiska Trybunału Konstytucyjnego w kwestii dopuszczalności pozyskiwania przez społecznego inspektora pracy danych osobowych. Problemy przedstawione w opracowaniu nie były dotychczas przedmiotem wypowiedzi doktryny.Social labour inspectorate, as a special form of unionised representation of employees’ interests, has the right to control employers in the field of their compliance with the provisions of the labour law in place. Exercising this controlling function involves the need for a social labour inspector to access the information and docu-ments that may contain personal data of employees. The study advances a thesis that a social labour inspector is an entity processing personal data of employees on behalf of a company trade union organisation – who is the controller of these data, and the grounds for the processing of personal data of employees are the relevant provisions of the GDPR. The theses proposed in the study aim to challenge the Constitutional Tribunal’s standpoint regarding a social labour inspector’s right to obtain personal data. The problems addressed in the study have not been a sub-ject of the existing views of legal academics and commentators, nor have they been covered in the established line of judicial decisions yet

A POWERFUL FORM OF NATIONAL LABOUR INSPECTORATE ACTION IN THE FIELD OF OCCUPATIONAL PROTECTIONThe National Labour Inspectorate, being a state supervision body for the observance of labour law, has at its disposal various forms of action, including the form of administrative decisions containing orders and prohibitions. The evolution of the legislation on the competence of the National Labour Inspectorate clearly indicates that these activities were introduced in particular for the occupational safety and health sphere, which constitutes the core of labour protection. This is evidenced by the need for the legislator to maximize the protection of the highest goods that are the life and health of the persons carrying out the work. The occupational health and safety OSH regulations of the National Labour Inspectorate should be understood broadly. These are primarily provisions stemming from labour law, but also from other branches of law mainly substantive administrative law, if their ratio legis relates to the sphere of OSH. Administrative decisions on OSH can also be based on the principles of OSH, which are non-regulatory rules resulting from life experience and the achievements of science and technology. These decisions, usually of declaratory character, are mainly preventive, enforcing the provision of healthcare for the people who work. These decisions are addressed not only to employers but also to those who employ on a different basis than the employment relationship.
