The challenges of HIV/AIDS education for the 'ordinary' class and subject teacher: A principial reflection HIV/AIDS has become a wide-spread epidemic. It has already claimed thousands of lives and many others are infected daily. HIV/AIDS education forms an important facet in the struggle against the disease, also in schools where ‘ordinary’ teachers (i.e. not professional AIDS practitioners) find themselves having to deal with classes of students in which learners infected by HIV or suffering from full-blown AIDS might be present. HIV/AIDS education confronts these teachers with several challenges. Feedback from an empirical survey in a province of South Africa where HIV/AIDS has assumed rampant proportions revealed that, while these ‘ordinary’ teachers were quite prepared to become involved in the struggle against HIV/AIDS, they did not see themselves as adequately equipped and prepared for the task. A number of recommendations are made to deal with this shortcoming in their training
Replacing property rules with liability rules : encroachment by building
CITATION: Van Der Merwe, A. J. 2008. Replacing property rules with liability rules : encroachment by building. South African Law Journal, 125(3):592-628.The original publicatio is available at https://journals.co.za/content/journal/ju_saljAccording to South African common law, movables attached permanently to land lose their independence and become part of the land; the landowner 'acquires' ownership of them through accession. In encroachment cases it has accordingly always been said that the affected landowner could demand that the encroaching structures be removed, but since the decision of the Orange Free State High Court in Rand Waterraad v Bothma 1997 (3) SA 120 (O) it appears as if the South African courts might be inclined, in certain instances, to leave the encroachment in place and order the encroaching neighbour to pay compensation instead. At least in some cases, this replacement of a property rule with a liability rule might appear just and it generally seems to conform to trends in other modern legal systems. In some cases South African courts have gone even further and ordered that the land affected by encroachment be transferred to the encroacher against payment of compensation. Quite apart from the fairness of replacing injunctive relief with compensation, this raises the further question whether such a forced sale of land is legitimate in terms of s 25 of the South African Constitution.Publisers versio
On the pumping of the CS() masers in W51 e2e
We present the results of numerically solving the rate equations for the
first 31 rotational states of CS in the ground vibrational state to determine
the conditions under which the J=1-0, J=2-1 and J=3-2 transitions are inverted
to produce maser emission. The essence of our results is that the CS()
masers are collisionally pumped and that, depending on the spectral energy
distribution, dust emission can suppress the masers. Apart from the J=1-0 and
J=2-1 masers the calculations also show that the J=3-2 transition can be
inverted to produce maser emission. It is found that beaming is necessary to
explain the observed brightness temperatures of the recently discovered CS
masers in W51 e2e. The model calculations suggest that a CS abundance of a few
times and CS() column densities of the order
are required for these masers. The rarity of the CS
masers in high mass star forming regions might be the result of a required high
CS abundance as well as due to attenuation of the maser emission inside as well
as outside of the hot core.Comment: 13 pages, 15 figure
