(Excerpt) Part I provides an overview of the Fourth Amendment’s protection against unreasonable searches and seizures, first discussing general Fourth Amendment principles, then analyzing the Supreme Court’s Summers decision. Part II addresses the circuit split over extending Summers where the occupant of the premises has left the property. Part II discusses the approaches taken by the four circuits that have applied, and the two circuits that have declined to apply, Summers to off-premises detainments. Part III argues that the circuits that have extended Summers where officers have detained occupants off premises are correct. It asserts that such detainments are reasonable seizures so long as the officers detained the occupants as soon as practicable after observing the occupants leave the property, and it provides guidelines for applying this test. Part III further contends that the policies underlying the Fourth Amendment and the Summers decision support that result. Finally, Part IV addresses the Supreme Court’s recent decision rejecting the “as soon as practicable” standard and articulates why the Court’s approach falls short and needs to be revisited

Acute effect of induced fatigue on passing ability in elite U-19 soccer players

Increased fatigue may be observed during a soccer match, with a reduction of the high intensity activities owing to physical demands. These actions lead to a decline in players’ performance. The aim of the study was to analyze the acute effects of induced fatigue on passing ability in elite U-19 soccer players. Twenty-three elite U-19 soccer players (17.9 ± 0.7 years; weight 69.7 ± 8.1 kg; height 177.2 ± 7.6 cm) performed the Loughborough Soccer Passing Test (LSPT) to evaluate passing ability: control, dribbling, accuracy and decision making. Repeated sprint ability (RSA) was used to induce fatigue, 12 x 30 m sprints followed by 30 s recovery time. Heart rate (HR), Borg’s rating of perceived exertion (RPE), time in 5 m and 30 m, sprint decrement (Sdec) and the fatigue index (FI) was collected. Student's t test was applied to compare the difference between pre-test and post-test. Differences were interpreted using Cohen’s d effect size. Fatigue led to a significant increase in the number of penalties in the LSPT (p < 0.001; d = 0.54) and in total time to perform the test (p = 0.001; d = 0.37). Of the different types of error, passing accuracy was the ability that declined most (p = 0.010 d = 0.72). Ball control was also affected, but to a lesser extent (p = 0.030; d = 0.39). The results shown that passing ability was affected by fatigue in elite U-19 soccer players. This study provides detailed information for football coaches and physical trainers on the effects of fatigue on passing ability, describing the decline in performance of this specific ability in soccer

El ‘Plan B’ de la Constitución Europea: ¿mirar hacia otro lado?

El fracasado Consejo Europeo de los días 16-17 de junio ha abierto una grave crisis en el seno de la Unión Europea. Los días 16-17 de junio, los líderes europeos, reunidos en torno al Consejo, tenían la obligación de dar una respuesta a la difícil situación creada por el doble “no” francés y holandés a la Constitución Europea. Sin embargo, tanto la falta de unanimidad en la respuesta a la crisis constitucional como la incapacidad de desbloquear la negociación del presupuesto 2007-2013 han abocado al proyecto de integración europeo a una muy profunda crisis. Este análisis se centra en tres aspectos centrales de la actual crisis: uno, la decisión sobre si suspender o continuar con el proceso de ratificación; dos, la falta de liderazgo; y tres, los escenarios posibles de integración que se derivan de la actual crisis. Como se deduce de las decisiones tomadas en estos días, hay algo sobre lo que los políticos europeos han sido absolutamente sinceros: realmente no había Plan B alguno más que mirar hacia otro lado durante algún tiempo

Quantum properties of two-component two-sites Bose-Hubbard model

The atom-atom interactions within each species and among the two species are taken as variable parameters while the hopping terms are kept fixed. To characterize the ground state we use observables such as the imbalance of population and its quantum uncertainty. The quantum many-body correlations present in the system are further quantified by studying the degree of condensation of each species, and the entanglement between the two species. The latter is measured by means of the Schmidt gap, the von Neumann entropy or the purity obtained after tracing out a part of the system. A number of relevant states are identified, e.g. Schrödinger catlike many-body states, in which the outcome of the population imbalance of both components is completely correlated, and other states with even larger von Neumann entropy which have a large spread in Fock spac

This article studies some of the most remarkable female roles in opera repertoire: Manon, Carmen, Dalila, Mélisande, Salomé and Lulú, exploring the similarities that can be found among them at different levels, despite the disparity of their literary origin and conception. The central point is constituted by their relationship with the features of the Femme Fatale. The article takes an etymological starting point such as the interpretation of the term «fatale» which relates the attraction they provoke in men with a tragic fate that inexorably links love and death in an inexorable way. We focus only on certain important features such as the tremendous impression they cause on men, their musical presentation and their premonition or prediction of death.Este artículo estudia algunos de los personajes femeninos más destacados del repertorio operístico: Manon, Carmen, Daila, Mélisande, Salomé y Lulú, indagando el paralelismo que se establecen en diversos niveles entre ellas pese a la disparidad de sus orígenes y concepción literarios, y tomand como hilo conductor los aspectos que las relacionan con alguno de los rasgos de la femme fatale. Votar y vetar en la Unión: una interpretación de la posición española en la CIG 2003

El sábado 4 de octubre se abrió en Roma la Conferencia Intergubernamental (CIG) que debe examinar el Proyecto de Tratado Constitucional elaborado por la Convención Europea. Como era previsible, la cuestión del sistema de representación y votación de los Estados Miembros en el Consejo de la Unión se ha situado en primer plano de debate y polémica. Este análisis examina en detalle la posición del Gobierno español tanto desde el punto de vista de su fundamento y justificación como desde el ámbito de sus estrategias negociadoras y posibilidades de éxito. En línea con lo manifestado por el Gobierno español durante y después de la Convención, nuestro Gobierno ha situado como elemento central de su posición ante el proyecto de Tratado Constitucional, que examina estos días la Conferencia Intergubernamental, el rechazo a las reglas de decisión en el Consejo propuestas por el artículo 24 de dicho proyecto constitucional. En lugar de la doble mayoría (simple) de Estados y población (tres quintos) que plantea el proyecto constitucional, el Gobierno español ha reiterado públicamente en numerosas ocasiones que el mantenimiento de los acuerdos alcanzados en Niza era una cuestión de principios

Claves para entender la abstención en las elecciones europeas

Las recientes elecciones europeas han registrado una tasa de participación de sólo el 45.5%. Este análisis examina las razones de tan elevada abstención así como algunas de sus implicaciones. La elevadísima abstención en las recientes elecciones europeas abre numerosos interrogantes acerca del nivel de apoyo ciudadano al proceso de integración europeo. Que la abstención representa un problema de primer orden es obvio, pero, ¿para quién?, ¿para el Parlamento Europeo?, ¿para los Gobiernos nacionales?, ¿para los partidos políticos?, ¿para los propios ciudadanos? Este análisis examina alguna de las hipótesis más plausibles que pueden explicar satisfactoriamente el fenómeno de la abstención en las elecciones europeas y concluye que no puede ser interpretada en su totalidad desde una óptica de rechazo al proceso de integración. En el análisis se argumenta, además, que la facilidad con la que los Gobiernos y los partidos políticos nacionales trasladan la responsabilidad a las instituciones europeas y al propio proceso de integración europea es contradictoria con el hecho de son dichos gobiernos y partidos los que conforman dichas instituciones europeas e impulsan el propio proceso de integración. Finalmente, se advierte acerca del impacto negativo de estas elecciones sobre el proceso de ratificación de la Constitución
