    En el presente informe se desarrollan los principales problemas jurídicos sobre Derecho Colectivo y Derecho Constitucional encontrados a raíz de la demanda interpuesta por el Sindicato Único de Trabajadores de la Minera Barrick Misquichilca S.A. contra la Minera Barrick Misquichilca S.A. Durante los actuados se desarrollan diversos problemas originados como consecuencia de que la demandada otorga el Bono de Integración únicamente a trabajadores no sindicalizados, lo que devino en el cuestionamiento de si este bono es una extensión del Convenio Colectivo 2013-2016. A partir de ello, se debate si la extensión del Convenio es válida en mérito a la intención de la demandada de preservar la igualdad entre sus trabajadores o si el actuar de la demandada deviene en inválido por la lesión al derecho de la libertad sindical. Por lo que se analiza si en los actuados se enfoca de manera adecuada los temas controversiales y si se resuelven en atención al carácter tuitivo del Derecho Laboral. Para ello, se usan los instrumentos que forman parte del bloque de constitucionalidad con la finalidad de realizar una interpretación que garantice el respeto de los derechos fundamentales involucrados. Así, en este trabajo, se llega a la conclusión de que existe una extensión de un convenio colectivo celebrado con un sindicato minoritario, el cual afecta el derecho a la libertad sindical, toda vez que genera un desincentivo para la afiliación a este, en vista de que todos los trabajadores recibirán el mismo beneficio, sin asumir ninguna obligación por ser parte del proceso de negociación colectiva; ello, trae como consecuencia la imposibilidad de que la organización sindical alcance el equilibrio necesario para que efectivamente se pueda desarrollar una negociación colectiva en la que la diferencia de poder entre las partes sea mínim

    Interaction between nearby strangers: serendipity and playfulness

    “Nearby strangers” provides an interestingly paradoxical space for interaction design. There are various social norms, cultural practices, and privacy concerns hindering interaction with nearby strangers, but by ignoring them, people constantly miss social opportunities. Technology enabling ad-hoc interactions between co-located people has been explored for years in research but real-life applications are still rare. The potential focus areas include increasing awareness of social possibilities; light-weight playful interactions, play and gaming; serendipitous and ad hoc social interaction; anonymous exchange of content; matching interests for various purposes; icebreakers and provocation to interact, and ambient representation of the nearby strangers. This workshop convenes researchers and practitioners to gather and advance the state of research on interactions between nearby strangers. We aim to explore this design space and collaboratively identify new research and design opportunities that novel communication technology creates

    Mental Health First Aid Training in Rural Maryland during the COVID-19 Pandemic: Program Implementation through Virtual Delivery

    The growing mental health concerns during COVID-19, particularly among rural residents, is a public health emergency. Rural residents are at an elevated risk, as rurality has been associated with various disparities, including lower accessibility to mental health services. Maryland Rural Opioid Technical Assistance (ROTA; Maryland Extension) aimed to address this issue by delivering evidence-based programs on opioid misuse and mental health to rural community members and practitioners throughout Maryland when the COVID-19 pandemic hit the U.S. and all research activities had to transition to the virtual setting. The current study provides an overview of the implementation process of the Mental Health First Aid (MHFA) program and reports the findings from the evaluation efforts. Participants (N = 398) completed a one-time online survey and answered open-ended questions, reporting high satisfaction rates and positive experiences with the virtual delivery of the program. Results suggested that the virtual format was still effective in program content delivery and that virtual delivery of evidence-based programs may be an opportune strategy to reach more rural residents. Recommendations for future research and practice efforts include building sustainable partnerships with local community organizations and considering rurality and prolonged-pandemic factors for effective program implementation

    Visualization of the intracellular behavior of HIV in living cells

    To track the behavior of human immunodeficiency virus (HIV)-1 in the cytoplasm of infected cells, we have tagged virions by incorporation of HIV Vpr fused to the GFP. Observation of the GFP-labeled particles in living cells revealed that they moved in curvilinear paths in the cytoplasm and accumulated in the perinuclear region, often near the microtubule-organizing center. Further studies show that HIV uses cytoplasmic dynein and the microtubule network to migrate toward the nucleus. By combining GFP fused to the NH2 terminus of HIV-1 Vpr tagging with other labeling techniques, it was possible to determine the state of progression of individual particles through the viral life cycle. Correlation of immunofluorescent and electron micrographs allowed high resolution imaging of microtubule-associated structures that are proposed to be reverse transcription complexes. Based on these observations, we propose that HIV uses dynein and the microtubule network to facilitate the delivery of the viral genome to the nucleus of the cell during early postentry steps of the HIV life cycle

    Comparison of triploid and diploid rainbow trout (Oncorhynchus mykiss) fine-scale movement, migration and catchability in lowland lakes of western Washington

    Fisheries managers stock triploid (i.e., infertile, artifcially produced) rainbow trout Oncorhynchus mykiss in North American lakes to support sport fsheries while minimizing the risk of genetic introgression between hatchery and wild trout. In Washington State, the Washington Department of Fish and Wildlife (WDFW) allocates approximately US $3 million annually to stock hatchery-origin rainbow trout in>600 lakes, yet only about 10% of them are triploids. Many lakes in Washington State drain into waters that support wild anadromous steelhead O. mykiss that are listed as threatened under the U.S. Endangered Species Act. As a result, there is a strong interest in understanding the costs and benefts associated with stocking sterile, triploid rainbow trout as an alternative to traditional diploids. The objectives of this study were to compare triploid and diploid rainbow trout in terms of: (1) contribution to the sport fshery catch, (2) fne-scale movements within the study lakes, (3) rate of emigration from the lake, and (4) natural mortality. Our results demonstrated that triploid and diploid trout had similar day-night distribution patterns, but triploid trout exhibited a lower emigration rate from the lake and lower catch rates in some lakes. Overall, triploid rainbow trout represent a viable alternative to stocking of diploids, especially in lakes draining to rivers, because they are sterile, have comparable home ranges, and less often migrat

    Molecular gas and star formation in early-type galaxies

    We present new mm interferometric and optical integral-field unit (IFU) observations and construct a sample of 12 E and S0 galaxies with molecular gas which have both CO and optical maps. The galaxies contain 2 x 10^7 to 5 x 10^9 M\odot of molecular gas distributed primarily in central discs or rings (radii 0.5 to 4 kpc). The molecular gas distributions are always coincident with distributions of optically-obscuring dust that reveal tightly-wound spiral structures in many cases. The ionised gas always approximately corotates with the molecular gas, evidencing a link between these two gas components, yet star formation is not always the domi- nant ionisation source. The galaxies with less molecular gas tend to have [O III]/H{\beta} emission-line ratios at high values not expected for star formation. Most E/S0s with molecular gas have young or intermediate age stellar populations based on optical colours, ultraviolet colours and absorption linestrengths. The few that appear purely old lie close to the limit where such populations would be undetectable based on the mass fractions of expected young to observed old stars. The 8{\mu}m polycyclic aromatic hydrocarbon (PAH) and 24{\mu}m emission yield similar star formation rate estimates of E/S0s, but the total infrared overpredicts the rate due to a contribution to dust heating from older stars. The radio-far infrared relation also has much more scatter than for other star-forming galaxies. However, despite these biases and additional scatter, the derived star formation rates locate the E/S0 galaxies within the large range of the Schmidt-Kennicutt and constant efficiency star formation laws. Thus the star formation process in E/S0s is not overwhelmingly different than in other star-forming galaxies, although one of the more reliable tracers (24{\mu}m) points to a possible lower star-formation efficiency at a given gas surface density.Comment: submitted to MNRA

    Endothelial Wnt/β-catenin signaling inhibits glioma angiogenesis and normalizes tumor blood vessels by inducing PDGF-B expression

    Endothelial Wnt/β-catenin signaling is necessary for angiogenesis of the central nervous system and blood–brain barrier (BBB) differentiation, but its relevance for glioma vascularization is unknown. In this study, we show that doxycycline-dependent Wnt1 expression in subcutaneous and intracranial mouse glioma models induced endothelial Wnt/β-catenin signaling and led to diminished tumor growth, reduced vascular density, and normalized vessels with increased mural cell attachment. These findings were corroborated in GL261 glioma cells intracranially transplanted in mice expressing dominant-active β-catenin specifically in the endothelium. Enforced endothelial β-catenin signaling restored BBB characteristics, whereas inhibition by Dkk1 (Dickkopf-1) had opposing effects. By overactivating the Wnt pathway, we induced the Wnt/β-catenin–Dll4/Notch signaling cascade in tumor endothelia, blocking an angiogenic and favoring a quiescent vascular phenotype, indicated by induction of stalk cell genes. We show that β-catenin transcriptional activity directly regulated endothelial expression of platelet-derived growth factor B (PDGF-B), leading to mural cell recruitment thereby contributing to vascular quiescence and barrier function. We propose that reinforced Wnt/β-catenin signaling leads to inhibition of angiogenesis with normalized and less permeable vessels, which might prove to be a valuable therapeutic target for antiangiogenic and edema glioma therapy

    Endophyte Microbiome Diversity in Micropropagated Atriplex canescens and Atriplex torreyi var griffithsii

    Microbial diversity associated with micropropagated Atriplex species was assessed using microscopy, isolate culturing, and sequencing. Light, electron, and confocal microscopy revealed microbial cells in aseptically regenerated leaves and roots. Clone libraries and tag-encoded FLX amplicon pyrosequencing (TEFAP) analysis amplified sequences from callus homologous to diverse fungal and bacterial taxa. Culturing isolated some seed borne endophyte taxa which could be readily propagated apart from the host. Microbial cells were observed within biofilm-like residues associated with plant cell surfaces and intercellular spaces. Various universal primers amplified both plant and microbial sequences, with different primers revealing different patterns of fungal diversity. Bacterial and fungal TEFAP followed by alignment with sequences from curated databases revealed 7 bacterial and 17 ascomycete taxa in A. canescens, and 5 bacterial taxa in A. torreyi. Additional diversity was observed among isolates and clone libraries. Micropropagated Atriplex retains a complex, intimately associated microbiome which includes diverse strains well poised to interact in manners that influence host physiology. Microbiome analysis was facilitated by high throughput sequencing methods, but primer biases continue to limit recovery of diverse sequences from even moderately complex communities
