    Protecting a Dream: Analyzing the Level of Review Applicable to DACA Recipients in Equal Protection Cases

    Faced with congressional inaction regarding comprehensive immigration reform, the Obama administration, through the Department of Homeland Security (DHS), implemented the Deferred Action for Childhood Arrivals (DACA) program in an effort to give young undocumented noncitizens the opportunity to contribute their skills and education to the American community by granting them deferred prosecutorial action and work authorization for a renewable term of two years. To date, DHS has granted DACA relief to over 521,825 young immigrants who would not otherwise be able to legally work in the United States. Although DACA recipients enjoy federal work authorization, states have adopted policies that restrict the benefits they receive from their employment authorization and bar them from pursuing certain professions. These policies treat DACA recipients differently from other noncitizens with temporary work permits. Yet, it is still unclear what level of review courts should apply to Equal Protection challenges arising from these policies because, although the DACA program effectively deems recipients lawfully present, it grants them no immigration status. This Comment argues that DACA recipients, like other lawfully present noncitizens, are entitled to heightened scrutiny in Equal Protection claims. First, this Comment will provide a general overview of judicial interpretation of the Equal Protection Clause. It will also explain the three major categories of noncitizens under current immigration law. Next, this Comment will examine judicial decisions in Equal Protection challenges regarding various categories of noncitizens. Lastly, this Comment will analyze why DACA recipients are entitled to heightened scrutiny under the Equal Protection Clause

    Inhale, Exile: Limiting Review of Aggravated Felonies and Crimes Involving Moral Turpitude after Moncrieffe v. Holder, 133 S. Ct. 1678 (2013)

    Although there is a general consensus that the immigration system in the United States is in dire need of reform, it is still unclear whether Congress will pass a comprehensive immigration reform bill in the near future. Under current immigration laws, noncitizens face serious consequences, even minor criminal convictions. The Immigration and Naturalization Act (“INA”) currently allows for a lawful permanent resident to be detained and placed in removal proceedings after a conviction for an “aggravated felony,” a conviction for a “crime involving moral turpitude” (“CIMT”) within five years of admission, or two convictions for “crimes involving moral turpitude.” Moreover, the overly broad interpretation of those terms has led to dire immigration consequences for even the pettiest of crimes. For instance, under the CIMT provision, a lawful permanent resident could be placed in removal proceedings for shoplifting no more than an article of clothing and a stuffed animal. Thus, a noncitizen could face removal over criminal convictions that, in many states, constitute misdemeanors and face penalties of no more than court supervision. This Note examines the effect of Moncrieffe v. Holder in removal proceedings based on an aggravated felony conviction or convictions for crimes involving moral turpitude. It will argue that in Moncrieffe, the Supreme Court correctly limited the scope of review for determining whether a criminal conviction constitutes an aggravated felony. It will also argue that, because of analogous statutory language, Moncrieffe should be interpreted to limit the immigration judges’ review of whether a criminal conviction involves moral turpitude

    Investigating the effects of neuromodulatory training on autistic traits: a multi-methods psychophysiological study.

    Autism spectrum disorder (ASD) is characterized by noticeable difficulties with social interaction and communication. Building on past research in this area and with the aim of improving methodological perspectives, a multi method approach to the study of ASD, mirror neurons and neurofeedback was taken. This thesis is made up of three main experiments: 1) A descriptive study of the resting state electroencephalography (EEG) across the spectrum of autistic traits in neurotypical individuals, 2) A comparison of 3 EEG protocols on MNs activation (mu suppression) and its difference according to self-reported traits of autism in neurotypical individuals, and 3) Neurofeedback training (NFT) on individuals with high autistic traits. In chapters 3 and 4 we employed simultaneous monitoring of physiological data. For chapter 3 EEG and eye-tracking was used, In the case of chapter 4, EEG and eye-tracking as well functional near infrared spectroscopy (fNIRS). Overall the findings revealed differences in mu rhythm reactivity associated to AQ traits. In chapter 2, the rEEG showed that individuals with high AQ scores showed less activation of frontal and fronto-central regions combined with higher levels of complexity in fronto-temporal, temporal, parietal and parieto-occipital areas. In chapter 3, EEG protocols that elicited Mu reactivity in individuals with different AQ traits suggested that as the AQ traits become more pronounced in neurotypical population, the event-related desynchronization (ERD) in low alpha declines. Chapter 3 was also the basis for the choice of pre/post assessment for chapter 4. In chapter 4 the multi-method physiological approach provided parallel physiological evidence for the effects of NFT in sensorimotor reactivity, namely, an increase in ERD in high alpha, higher levels of oxygenated haemoglobin and changes to the amplitude and frequency in the microstructure of mu for participants who underwent active training as opposed to a sham group

    Coping and Logotherapy in Terminal Patients and Primary Caregivers

    El objetivo del presente es describir de qué manera la intervención logoterapéutica ayuda en el afrontamiento del duelo al Paciente Terminal y a su Cuidador Primario en el área de Cuidados Paliativos en un Hospital al Norte del Estado de México permitiéndoles tener una calidad de vida óptima por medio de la comunicación asertiva y la identificación del sentido de vida; la metodología fue de carácter mixto, con enfoque dominante cualitativo. El procedimiento se desarrolló en siete fases: 1) Encuadre, 2) Evaluación (se utilizaron la entrevistas semi-estructuradas, el Logotest y el Cuestionario de Evaluación de Funcionamiento Familiar como herramientas para la valoración de los casos), 3) Diagnóstico, 4) Intervención basada en tareas de Terapia Breve y técnicas logoterapéuticas, 5) Post aplicación del Logotest en Cuidadores Primarios 6) Resultados y 7) Seguimiento. Participaron pacientes con pronóstico de vida terminal y sus cuidadores primarios. El análisis estadístico y del discurso demuestran que la Logoterapia es una alternativa efectiva en el afrontamiento del duelo en el Cuidador Primario, de igual forma la Logoterapia en el Paciente Terminal permite que afronte propositivamente su condición, por ende al hacer consciente su proceso de muerte, le da la oportunidad de revalorar y alcanzar la plenitud de su existencia

Se citan o comentan 24 especies de afiloforales de himenio liso encontradas sobre madera o hojas de Cistus en descompo sición . Se aportan dibujos de los caracteres microscópicos de algunos de los taxones. Proponemos una clave de identificación provisional para las especies estudiadas. Entre los taxones citados destacamos por su frecuencia: Vuilleminia macrospora, Radulomyees confluens,Athelia mutabilis, A. galzinii, Phanerochaete ericina, P. Martelliana y P. tuberculata.Alguns fongs corticioides trobats a les comunitats de Cistus de Catalunya. Es citen o comenten 24 espècies d'afil·loforats d'himeni llis trobades sobre fusta o fulles de Cistus en descomposició. S'aporten dibuixos dels caràcters microscòpics d'alguns dels tàxons.     Gender effect on the relationship between talent identification tests and later world triathlon series performance

    Background: We examined the explanatory power of the Spanish triathlon talent identification (TID) tests for later World Triathlon Series (WTS)-level racing performance as a function of gender. Methods: Youth TID (100 m and 1000 m swimming and 400 m and 1000 m running) test performance times for when they were 14–19 years old, and WTS performance data up to the end of 2017, were obtained for 29 female and 24 male “successful” Spanish triathletes. The relationships between the athletes’ test performances and their later best WTS ranking positions and performance times were modeled using multiple linear regression. Results: The swimming and running TID test data had greater explanatory power for best WTS ranking in the females and for best WTS position in the males (R2a = 0.34 and 0.37, respectively, p ≤ 0.009). The swimming TID times were better related to later race performance than were the running TID times. The predictive power of the TID tests for WTS performance was, however, low, irrespective of exercise mode and athlete gender. Conclusions: These results confirm that triathlon TID tests should not be based solely on swimming and running performance. Moreover, the predictive value of the individual tests within the Spanish TID battery is gender specific.Fundação para a Ciência e Tecnologia | Ref. UIDB / 00447/202

    The triple exclusion suffered by many Romaní women inEurope(on grounds of gender, ethnicity and, in many cases, low academic level) did not impede that they become today the engine for the transformation to improve their people’s life conditions. This article is based on a documental review on the impact of communicative methodology of research on public policies addressed to the Romani people and also on the improvement of their life conditions. Our analysis focuses specially on the role of Romani women throughout the whole process, in which they have been protagonists and end users at the same. Their communities and society as a whole also took benefit of Romani women’s contributions

    A universidade como uma instituição voltada a formação de novas gerações, e tendo como funções básicas o ensino, pesquisa e extensão deve ser vista também como importante espaço de geração de conhecimento, e de divulgação desse conhecimento, nesta perspectiva este trabalho tem como objetivo identificar a produção científica dos docentes do curso de Bacharelado em Turismo da Universidade Federal de Pelotas - UFPel, na referida área, Para atender o objetivo proposto, foram coletados dados nos currículos Lattes dos docentes do curso, no período de 2000 a 2013/1, no que se refere a sua produção científica e o projetos de pesquisa concluídos e em andamento, no período. Constatou-se que há a necessidade de crescimento da produção científica na área e podendo-se dizer, ainda que há uma relação entre a produção científica dos docentes e sua titulação
