LEGAL ARRANGEMENTS REGARDING REASONS FOR THE ELIMINATION OF CRIMINAL PROCEDURE IN THE CRIMINAL CODE (KUHP)

The current Penal Code, especially the regulation of reasons that can eliminate criminality, is influenced by neo-classical schools. Such influence is seen in considering the personal self-worth of the offender and about other conditions that cause a person to commit a violation against the law (an act that can be punished). This can be seen by the regulation regarding the abolition, reduction and weighting of penalties as formulated in Chapter III of the First Book of the Criminal Code. The birth of the reasons for the elimination of crimes in the modern criminal system is inseparable from the emergence or birth of schools in criminal law that have been known, namely the classical school, neo-classical and positive schools. These streams are not looking for a legal basis or justification of the criminal / law as contained in criminal theories, but trying to find the purpose of imposing a criminal sanction is applied along with the development of society. Reasons for the elimination of criminal penalties for perpetrators of criminal offenses are regulated in the first book (general regulation) of the Criminal Code (KUHP), which includes Article 44 which regulates mentally ill offenders, Article 48 which is forced , Article 49, which is about self-defense, Article 50, which is about implementing Law and Article 51, which is about carrying out orders.Keywords: Legal Arrangement, Reasons for the Elimination of Criminal Procedure, Criminal Cod

PENGARUH IKLIM SEKOLAH DAN KONSEP DIRI TERHADAP MOTIVASI DAN HASIL BELAJAR BIOLOGI SISWA SMA NEGERI DI KABUPATEN BONE

Abstrak. Penelitian ini adalah penelitian Ex-post-facto. Populasi dalam penelitian ini adalah seluruh siswa kelas XI IPA Biologi SMA Negeri di Kabupaten Bone. Pengambilan sampel yang digunakan adalah cluster random sampling. Teknik pengumpulan data menggunakan instrumen berupa angket untuk mengumpulkan data iklim sekolah, konsep diri dan motivasi siswa serta dokumentasi untuk mengumpulkan hasil belajar Biologi semester ganjil tahun ajaran 2017/2018. Analisis data menggunakan analisis regresi sederhana maupun ganda. Hasil penelitian menunjukkan bahwa (1) terdapat pengaruh iklim sekolah dan konsep diri secara bersama-sama terhadap motivasi belajar Biologi siswa (2) terdapat pengaruh iklim sekolah dan konsep diri secara bersama-sama terhadap hasil belajar Biologi siswa. ANALISIS EKONOMI REGIONAL SEKTOR BASIS DAN NON BASIS DI KABUPATEN GRESIK, KABUPATEN MADIUN DAN KABUPATEN PACITAN

Perkembangan pembangunan perekonomian daerah tergantung dari kondisi dan potensi sumber daya yang dimiliki masing-masing daerah. Pembangunan daerah lebih memprioritaskan kepada pembangunan dan memperkuat sektor-sektor dibidang ekonomi dengan mengembangkan, meningkatkan dan mendayagunakan sumber daya yang ada secara optimal Tujuan penelitian ini adalah untuk mengetahui sektor yang menjadi sektor basis dan sektor unggulan di Kabupaten Gresik, Kabupaten Madiun dan Kabupaten Pacitan, Penelitian ini adalah penelitian deskriftif yang tujuannya adalah untuk membuat deskripsi atau gambaran secara sistematis, faktual, dan akurat mengenai fakta-fakta , sifat-sifat, serta hubungan antar fenomena yang diselidiki. Penelitian ini merupakan penelitian perpustakaan, yaitu penelitian yang dilakukan dengan mneghimpun data dari berbagai literatur, baik dari perpustakaan maupun tempat-tempat lain. Untuk menganalisa pertumbuhan ekonomi daerah dalam penelitian ini maka digunakan analisis Location Quoetient (LQ). Berdasarkan hasil penelitian untuk Kabupaten Gresik terdapat dua sektor yang merupakan sektor basis, yaitu sektor perdagangan, hotel dan restoran serta sektor Industri pengolahan. Sedangkan untuk Kabupaten Madiun terdapat tiga sektor basis, yaitu sektor pertanian, sektor perdagangan, hotel dan restoran serta sektor jasa-jasa. Dan di kabupaten Pacitan terdapat dua sektor basis, yaitu sektor pertanian dan sektor jasa-jasa. Untuk sektor unggulannya, di kabupaten gresik adalah sektor industri pengolahan, Sedangkan di kabupaten Madiun sektor unggulannya adalah sektor pertanian dan sektor perdagangan, hotel dan restoran. PENGARUH PANDEMI COVID-19 TERHADAP PELAKSANAAN PERSIDANGAN PERKARA PIDANA DI PENGADILAN

ABSTRACT Courts as part of the criminal justice system are used by litigants as a place to obtain justice by upholding a simple trial with a fast time and low cost. Judges in the process of conducting trials refer to the principles of trial examination. Some of the principles of trial examination are examinations open to the public and direct and oral examinations. At present, the corona virus pandemic (Covid-19) is endemic in the world, including in Indonesia, which also affects the implementation of trials in court which results in direct trial processes facing each other in the courtroom cannot be carried out.The type of research used is a type of normative research where the implementation of research is carried out by examining library materials or only based on secondary data. Researchers obtained research material through a normative juridical approach. The normative research approach is a legal research approach based on legislation. Conducted on the problem by referring to the side of legislation then appear literature or scientific work and doctrine (expert opinion).Examination in criminal cases with ordinary examinations, broad regulatory provisions, with the stages of court examination starting with the reading of indictments, exceptions, responses of public prosecutors, interlocutory decisions, evidence, requisites, pledoi, replicates, duplicates and decisions. Each inspection process is carried out face to face. However, this has changed since the Covid-19 outbreak, where the Supreme Court as the judiciary body issued Circular No. 1 of 2020 which is used as new in carrying out criminal case trials in court. Subsequently, a joint agreement was signed between the Supreme Court, the Attorney General's Office and the Ministry of Law and Human Rights of the Republic of Indonesia (KEMENKUMHAM RI) regarding the Implementation of Trials via Teleconference. WHY DOES MUZAKKI PAY ZAKAT THROUGH BAITUL MAAL INSTITUTION?

Abstract Islamic economic philanthropy through zakat is a means of distributing income from the rich to the poor. The decision of muzakki to pay zakah via zakat institution contributes to equal income distribution within an economy. Thus, it crucial to determine the factors causing muzakki to pay zakah via zakat institution. On this basis, this study intends to examine the effect of transparency, motivation, culture, and reputation on the decision of Muzakki to pay the zakat at the baitu maal institution. The method of analysis used in this research is a binary logit regression model. The sampling technique was purposive sampling with as many as 66 respondents. The results showed that transparency, motivation, culture, and reputation had a positive and significant effect on the decision of Muzakki to pay zakat at the baitu maal institution. To increase the interest of muzakki to pay zakat through the baitu maal institution, muzakki needs to be motivated to obey in paying zakat. The baitu maal institution is required to improve its reputation through optimizing service quality

PENGARUH PENGETAHUAN, PENDAPATAN, RELIGIUSITAS, DAN MOTIVASI TERHADAP MINAT MASYARAKAT MEMBAYAR ZAKAT DI BAITUL MAL ACEH SELATAN

Tulisan ini bertujuan untuk menganalisis pengaruh pengetahuan, pendapatan, religiusitas, dan motivasi terhadap minat. Penelitian ini merupakan penelitian kuantitatif dengan metode survey dan kuesioner. Populasi dalam penelitian ini yaitu seluruh masyarakat Aceh Selatan yang menjadi muzakki. Sementara sampelnya berjumlah 100 responden. Metode analisis data yang digunakan yaitu analisis regresi linier berganda. Hasil penelitian menunjukkan bahwa secara simultan pengetahuan, pendapatan, religiusitas, dan motivasi berpengaruh positif terhadap minat. Sedangkan secara parsial pengetahuan tidak berpengaruh terhadap minat, pendapatan berpengaruh positif terhadap minat, religiusitas berpengaruh positif terhadap minat, dan motivasi berpengaruh positif terhadap minat

PENGARUH KOMUNIKASI DAN MOBILISASI KADER POSYANDU TERHADAP UPAYA PENCEGAHAN STUNTING

Tujuan: Stunting adalah kondisi gagal tumbuh. Ini bisa dialami oleh anak-anak yang mendapatkan gizi buruk,. Upaya mencegah stunting yang telah dilakukan lebih difokuskan pada ibu hamil, ibu menyusui dan baduta dalam hal mewujudkan terpenuhinya nutrisi yang seimbang sesuai kebutuhan. Tujuan penelitian adalah untuk menidentifikasi apakah ada pengaruh komunikasi dan mobilisasi kader terhadap perubahan perilaku masyarakat dalam upaya pencegahan stunting, khususnya ibu hamil, ibu menyusui dan ibu yang mempunyai balita dalam program germas dengan melaksanakan intervensi gizi spesifik dan gizi sensitive.Metode: Penelitian dilakukan korelasi dengan menggunakan pendekatan cross sectional. Penelitian di Lokasi Fokus Stunting Desa Seunebok Panton Kecamatan Darul Falah Kabupaten Aeh Timur . penelitian dilakukan pada bulan JuliAgustus 2020Hasil: Hasil uji statistik Komunikasi diperoleh nilai p=0.001 maka dapat disimpulkan Ada pengaruh komunikasi Kader terhadap upaya pencegahan stunting, diperoleh nilai OR= 18,40, artinya kader yang melakukan komunikasi 18 kali lebih baik dalam dalam upaya perubahan perilaku terhadap pencegahan stunting dan variabel mobilisasi diperoleh nilai p=0.000 maka dapat disimpulkan ada pengaruh Mobilisasi Kader terhadap upaya pencegahan stunting, diperoleh nilai OR=41.23, artinya kader yang melakukan mobilisasi 41 kali lebih baik dalam dalam upaya perubahan perilaku terhadap pencegahan stunting.Simpulan: Kinerja dan dedikasi kader dalam menjalankan kegiatan Posyandu sangat menentukan pencapaian penurunan Stunting.Kaca kunci: komunikasi, mobilisasi, stunting, kader, pencegahan
