Os efeitos do incumprimento dos serviços mínimos

Este estudo pretende começar por transmitir aos leitores, de uma forma clara, qual a relação entre o exercício do direito à greve e os serviços mínimos. Neste contexto, a obrigação de prestar serviços mínimos surge para fazer face a situações concretas, em que o exercício do direito à greve pelos trabalhadores se revela intolerável pela sociedade. Como forma de a combater, o nosso ordenamento jurídico estabelece alguns limites ao exercício do referido direito e que se consubstanciam na obrigação de prestar serviços mínimos pelos trabalhadores. Esta prestação destina-se apenas a empresas ou estabelecimentos que visem a satisfação de necessidades sociais impreteríveis, devendo ainda ser prestados os serviços necessários à segurança e manutenção de equipamentos e instalações. Estes conceitos, atenta a sua controvérsia jurídica, serão analisados ao abrigo da segunda Lei da Greve e do atual Código do Trabalho, por forma a compreender a sua evolução. Contudo, e tendo em consideração os prejuízos que o incumprimento da prestação dos serviços mínimos pode acarretar para os utentes (e empregador), pode então, e desde já, adiantar-se que o incumprimento é suscetível de gerar diversas consequências, as quais comportam o seu devido regime e que serão aqui devidamente analisadas. Assim, torna-se imprescindível desenvolver os temas atinentes aos institutos da requisição civil, do poder disciplinar e da responsabilidade civil, dando, sempre que possível, exemplos práticos de situações ocorridas em Portugal.This study aims to start by conveying to readers, in a clear manner, the relationship between the exercise of the right to strike and the minimum services. In this context, the obligation to provide minimum services emerges to face concrete situations where the exercise of the right to strike by the workers yields intolerable by society. As a way of combating it, our legal system establishes certain limits to the exercise of the aforementioned right, which are embodied in the obligation of providing minimum services by the workers. This provision is intended exclusively for companies or establishments that aim the fulfillment of indispensable social needs, having also to provide the services necessary for the safety and maintenance of equipment and facilities. These concepts, in view of their legal controversy, will be under the second Law of the Strike and the current Labor Code, in order to understand its evolution. However, and considering the losses that the non-compliance of the minimum services may entail for users (and employer), then it can be pointed out that the default is susceptible to create various consequences, which have specific legal regime, and which will be duly analyzed here. Thus, it becomes essential to develop the themes related to the institutes of civil requisition, of disciplinary power and of civil liability, providing, when possible, practical examples of situations occurring in Portugal

Criatividade em Creche: um olhar supervisivo apoiado por um instrumento de avaliação

Ao longo das décadas, a criatividade tem vindo a ser objeto de estudo por vários autores, surgindo uma diversidade de conceitos associados a este tema. Conhecido o facto que aquilo que somos enquanto adultos tem como base as nossas experiências na infância, o desenvolvimento da criatividade, desde uma idade precoce, proporciona benefícios para a vida futura da criança. Dada a pertinência desta temática existe a necessidade de repensar a educação no sentido de formar alunos criativos, capazes de lidar com as inúmeras mudanças que caracterizam a evolução da sociedade. A supervisão surge, neste sentido, como um elemento crucial para a mudança e a melhoria das escolas no que reporta a uma educação orientada para a criatividade, ao invés de uma educação tradicional, metódica e uniformizadora. Este estudo exploratório procura apurar as conceções de criatividade de especialistas ligados a esta área, bem como, de educadores de infância que exerçam, ou já tenham exercido, funções nesta valência, criando um instrumento de avaliação que permita avaliar as dimensões que promovem a criatividade em creche.Over the decades, creativity has come to be an object of study by several authors, emerging a variety of associated concepts with it. Well known is the fact that what we are as adults is based on our childhood experiences, creativity development from an early age, provides benefits for the child's future life. Given the relevance of this issue, there is a need to rethink education in order to train creative students capable of dealing with the upcoming future changes that characterize society development. Supervision arises, in this sense, as the crucial element for changing and improving schools regarding education targeted at creativity rather than a traditional, methodical and standard education. This exploratory study seeks to ascertain the conception of creativity from creativity experts connected to this field as well as kindergarten teachers who work, or have been working, in this field, creating an evaluation tool that will measure the dimensions to promote creativity in day care center

De que (poesia) são feitos os dias da escola

O presente Relatório de Estágio, com o título De que (poesia) são feitos os dias da escola, é reflexo da identidade docente que se foi construindo ao longo da unidade curricular de Prática Educativa Supervisionada, do Mestrado em Ensino do 1.º Ciclo e de Português e História e Geografia de Portugal no 2.º Ciclo do Ensino Básico, condição para a obtenção do grau de Mestre e habilitação legal para a docência no 1.º ciclo e nas mencionadas áreas disciplinares do 2.º ciclo. Este relatório desenha um caminho de descoberta pessoal e profissional, pautado pelo gosto e vontade de crescer e aprender mais. Marcada por uma atitude crítica, reflexiva e investigativa, a prática pedagógica caracterizou-se pela concretização de sequências didáticas amparadas sob o mesmo fio condutor – a presença da Poesia na escola. Sob este mote, procurou-se dinamizar intervenções em sala de aula, articuladas entre os dois ciclos, possível pela presença, no mesmo horizonte temporal, nos dois ciclos, cujo trabalho foi o “alimento” para as intervenções na escola, envolvendo a comunidade educativa. Para a prática pedagógica, assumiu relevância o trabalho desenvolvido no âmbito da Supervisão Pedagógica, que se baseou no diálogo e na reflexão permanente, o que permitiu a concretização de situações de ensino e de aprendizagem fundamentadas e contextualizadas. Na sala de aula privilegiouse a metodologia oficinal, a metodologia de aprendizagem cooperativa, com especial atenção no espaço e ambiente de sala de aula. Na mesma senda, o desenho do projeto de investigação vem reforçar o espaço protagonista que a Poesia pode assumir na aula de Português, convocando textos de outros géneros e em diversos suportes para, com eles, construir uma malha articulada de saberes.Entitled “De que (poesia) são feitos os dias da escola”, the present internship report, reflects the teaching identity built all throughout the Supervised Educational Practice. The mentioned internship is part of the Master’s Degree of Education (M. Ed) in Primary Education and Portuguese and Portuguese History and Geography in Secondary Education, which is fundamental in obtaining the masters degree and legal qualification for teaching the first cycle and the above mentioned subjects of the second cycle. This report draws a path of professional and personal discovery, always lined by the willingness to learn and self-grow. Marked by a critical, reflexive and investigative attitude, the pedagogical practice was characterized by the accomplishment of teaching sequences, driven by a common thread - the presence of Poetry in school. Baring this in mind, classroom interventions were boosted, articulating both cycles and only possible by the presence, in the same time horizon, in both of them. This was the “fuel” for school interventions involving the whole school community. The developed work, within Pedagogical Supervision, based in constant dialog and reflection, allowing teaching accomplishments and reasoned and contextualized learning, was of most importance to the pedagogical practice. Classroom work, was privileged by workshop methods and collaborative learning methodologies, focusing on classroom environment. Within the same path, this work aims to empower the leading role that Poetry, along with texts from other literary genres and various media, has in classroom, and together create articulated experiences and knowledge

Immunohistochemical expression of EGFR in oral leukoplakia : association with clinicopathological features and cellular proliferation

Objectives: to investigate the immunoexpression of epidermal growth factor receptor (EGFR) in a sample of oral leukoplakias (OL) and to determine the receptor?s association with dysplasia, tobacco consumption, lesion site, and proliferation rate. Although EGFR should be overexpressed in some oral leukoplakias, the factors that may interfere with this expression and the influence of this receptor on epithelial proliferation have yet to be investigated. Study Design: Samples of oral leukoplakias (48) and of normal oral epithelium (10) were immunohistologically examined for expression of EGFR. Immunohistochemistry for Ki-67, and p27 were also performed in leukoplakias. EGFR expression was associated with clinical and pathological features. Results: EGFR was positive in 62.5% of the leukoplakias and 50% of normal oral epithelium. The number of EGFR positive OL located in high-risk sites was significantly higher than EGFR positive OL located in low-risk sites. Most of the p27 negative leukoplakias were EGFR positive, and the p27 index in the parabasal layer was diminished in the presence of dysplasia. Positivity for EGFR was not associated with dysplasia, tobacco exposure, or Ki-67. Conclusion: EGFR is expressed in leukoplakia regardless of dysplasia, but EGFR positivity should be more frequent in lesions sited in areas of high cancer risk. The association between EGFR and p27 may represent an important mechanism in the control of cellular proliferation and malignant progression of oral epithelium and therefore warrants further investigation

Development of Neurogenic Detrusor Overactivity after Thoracic Spinal Cord Injury Is Accompanied by Time-Dependent Changes in Lumbosacral Expression of Axonal Growth Regulators

Thoracic spinal cord injury (SCI) results in urinary dysfunction, which majorly affects the quality of life of SCI patients. Abnormal sprouting of lumbosacral bladder afferents plays a crucial role in this condition. Underlying mechanisms may include changes in expression of regulators of axonal growth, including chondroitin sulphate proteoglycans (CSPGs), myelin-associated inhibitors (MAIs) and repulsive guidance molecules, known to be upregulated at the injury site post SCI. Here, we confirmed lumbosacral upregulation of the growth-associated protein GAP43 in SCI animals with bladder dysfunction, indicating the occurrence of axonal sprouting. Neurocan and Phosphacan (CSPGs), as well as Nogo-A (MAI), at the same spinal segments were upregulated 7 days post injury (dpi) but returned to baseline values 28 dpi. In turn, qPCR analysis of the mRNA levels for receptors of those repulsive molecules in dorsal root ganglia (DRG) neurons showed a time-dependent decrease in receptor expression. In vitro assays with DRG neurons from SCI rats demonstrated that exposure to high levels of NGF downregulated the expression of some, but not all, receptors for those regulators of axonal growth. The present results, therefore, show significant molecular changes at the lumbosacral cord and DRGs after thoracic lesion, likely critically involved in neuroplastic events leading to urinary impairment

CARTOGRAFIAS E “SUBJETIVIDADES” DAS CRIANÇAS COM DEFICIÊNCIA: UTILIZAÇÃO DE PRÁTICAS ECOPEDAGÓGICAS E INCLUSIVAS

ABSTRACT: This article aims to map the "children's subjectivities" about using ecopedagogic and inclusive practices, from the needs of children with intellectual disabilities, visual, auditory, physical and multiple (BRAZIL, 1995) and the relationship with the actor-network (LATOUR, 2000 and 2001) belonging to them (teachers, principals and parents). Three educational institutions were chosen for the research, one particular, municipal and other non-governmental, located in Vitória da Conquista in Bahia. The research theoretical and methodological was based on the mapping of subjectivities and Controversies (PASSOS, KASTRUP, ESCÓSSIA, 2010; DELEUZE and GUATTARI, 1987 and 1995). It was used as research technique workshop drawings with children with disabilities and the focus group with the actors-network. The results show the use of cartography of subjectivity and controversy adapted to the detection of facilitating or limiting devices of school inclusion of children with disabilities, as subsidized cartographic simultaneous interventions in feasible improvements regarding the ecopedagogic and inclusive practices.RESUMEN: En este artículo se pretende trazar las "subjetividades delos niños" sobre el uso de ecopedagógicas y prácticas inclusivas, a partir de las necesidades de los niños con discapacidad intelectual, visual, auditiva, física y múltiple (Brasil, 1995) y la relación con el actor de la red (Latour, 2000 y 2001) que pertenece a ellos (profesores, directores y padres de familia). Tres instituciones educativas fueron elegidos para la investigación, uno en particular, municipal y otro no gubernamental, con sede en Vitória da Conquista, en Bahía. La investigación teórica y metodológica se basó en la asignación de las subjetividades y Controversias (PASSOS, KASTRUP, Escóssia, 2010; Deleuze y Guattari, 1987 y 1995). Fue utilizado como planos de taller de técnica de investigación con niños con discapacidad y los grupos focales con los actores de la red. Los resultados muestran el uso de la cartografía de la subjetividad y la controversia adaptada a la detección de facilitar o dispositivos de inclusión escolar de los niños con discapacidad que limita, como subsidiado intervenciones simultáneas cartográficos en mejoras factibles en cuanto a la ecopedagógicas y prácticas inclusivas.      RESUMO: Esse artigo objetiva cartografar as “subjetivações infantis” acerca da utilização de práticas ecopedagógicas e inclusivas, a partir das necessidades das crianças com deficiência intelectual, visual, auditiva, física e múltipla (BRASIL, 1995) e da relação com os atores-rede (LATOUR, 2000 e 2001) que os integram (professoras, diretoras e pais). Três instituições de ensino foram escolhidas para a pesquisa, sendo uma particular, uma pública municipal e outra não governamental, localizadas em Vitória da Conquista na Bahia. A pesquisa fundamentou-se teórico-metodologicamente na Cartografia das Subjetividades e das Controvérsias (PASSOS, KASTRUP, ESCÓSSIA, 2010; DELEUZE e GUATTARI, 1987 e 1995). Utilizou-se como técnica de pesquisa a oficina de desenhos com as crianças com deficiência e o grupo focal com os atores-rede. Os resultados apontam a utilização da cartografia das subjetividades e das controvérsias adaptadas à detecção dos dispositivos facilitadores ou restritivos da inclusão escolar das crianças com deficiência, pois subsidiaram simultâneas intervenções cartográficas nas melhorias exequíveis no que tange as práticas ecopedagógicas e inclusivas.

Zinner’s Syndrome: Case Report of a Rare Maldevelopment in the Male Genitourinary Tract

Zinner’s syndrome is a rare embryologic anomaly of the distal portion of the mesonephric duct comprising a triad of ipsilateral renal agenesis, seminal vesicle cyst and ejaculatory duct obstruction. We report ultrasound and magnetic resonance imaging findings of this rare developmental anomaly involving the mesonephric duct, in an asymptomatic 17-year-old boy who would probably remain undiagnosed until later age. The patient presented with no specific symptoms and was incidentally diagnosed on imaging exams
