    The Sexual Regulation Dimension of Contemporary Welfare Law: A Fifty State Overview

    In this article, Smith will attempt to demonstrate that welfare policy has become a prominent site of sexual regulation; that the rights of poor single mothers are at stake in this respect; and that given the precise structure of contemporary American welfare reform, we must pay especially close attention to the laws and regulations adopted at the state level. First, Smith will place contemporary sexual regulation-oriented welfare law in an historical context by considering its precedents in English and American public policy traditions (Part I). Using original qualitative analyses of the states\u27 statutory codes and administrative regulations, Smith will then discuss the following measures: the mandatory child support cooperation requirement (Part II); the domestic violence exemption (Part III); the family cap, family planning, and adoption relinquishment dimensions of welfare programs (Part IV); and the abstinence education curricula in public schools (Part V). Finally, she will conclude with a brief discussion of the broader relevance of this research. The emphasis on the moralistic policing of poor women as a solution to poverty conceals the fact that poverty will only be adequately addressed insofar as the federal and state governments adopt much more egalitarian and democratic macroeconomic policies

    Management Strategies to Address the Substance-Impaired Healthcare Professional in the Workplace

    Healthcare professionals who practice while impaired by alcohol or drugs endanger the well-being of patients. In the workplace, the substance-impaired healthcare professional poses challenges for healthcare leaders who are responsible for the provision of safe patient care and safe work environments. The purpose of this multiple case study was to explore management strategies used by some healthcare organizational leaders to address the substance-impaired healthcare professional in the workplace. The conceptual framework for this study drew upon the legal and ethical concepts of due diligence. Data collection consisted of surveys of 40 managers and supervisors, and 3 senior leaders, semi structured interviews of executive leaders from one large hospital, and a review of company documents. A software program was used to organize the data for analysis. Five themes emerged that yielded 6 possible strategies that leaders could use to address the substance-impaired healthcare professional in the workplace: an affective healthcare business model, healthcare leader training, monitoring and surveillance systems, synergistic integration of work and life balance, and legal and ethical incident reporting. These research findings may contribute to positive organizational and social change by reducing the risk patients have from substance-impaired healthcare professionals

    Strategies to Address Substance-Abusing and Substance-Impaired Healthcare Professionals

    This research explored strategies used by some healthcare leaders to address substance abusing and impaired healthcare professionals. The conceptual framework for this qualitative case study was the concept of due diligence. Data were collected from 40 managers and supervisors, 3 executives, and company documents, and analyzed to reveal elements of a comprehensive strategy. A effective comprehensive strategy consists of policies that address the causes, the short term and long term aspects, and both the ethical and legal aspects. Policies and procedures are equally applied, are easily accessible, are well communicated, are supported by training, provides positive encouragement. provides a path for recovery, includes audits to ensure compliance and provides for organizational reviews to determine the need for updating. Leaders who implement a such a strategy to address substance abuse among healthcare professionals can create positive social change by ensuring a safer environment for patients, employees and their communities they serve

    El artículo propone un análisis del discurso jurídico y los debates del activismo LGBT respecto de la relación entre pobreza y discriminación en el caso de madres lesbianas pobres. Contextualiza y analiza dos fallos de la Corte Suprema de California en 2005, a través de los cuales se regula la maternidad lésbica en casos de disolución del vínculo íntimo y sus alcances respecto de las leyes de familia y de pobreza como problema de regulación en el Estado de postbienestar neoliberal. Se estudian las regulaciones en el caso de las madres lesbianas pobres respecto de la erosión de derechos como modalidades de persecución y discriminación, como así también las estrategias de activistas y colectivos LGBT respecto de nuevos desafíos del vínculo entre ley de familia y derechos redistributivos.This article proposes an analysis of juridical discourses and debates in LGBT activism regarding the relationship between poverty and discrimination in the case of lesbian mothers in situation of poverty. It contextualises and analyses two sentences of the Supreme Court of California during 2005 as instances of regulation of same-sex motherhood in the case of the dissolution of the relationship. It focuses on the analysis of sexual and economic regulations recognizing same sex-parenthood rights as cases of 'sexual regulation of poor mothers' in the neo-liberal Post-Welfare State, attending at the same time to debates on the framework of the poverty law that erode lesbian rights and to reviewing the strategies of LGBT activism

    Genital Chronic Graft-versus-Host Disease in Females: A Cross-Sectional Study

    AbstractUsing the National Institutes of Health (NIH) consensus criteria for chronic graft-versus-host disease (cGVHD), we assessed the prevalence, symptoms, and clinical signs of female genital cGVHD in a cross-sectional population-based study. Forty-two women were evaluated at a median of 80 months (range, 13 to 148 months) after undergoing hematopoietic stem cell transplantation (HSCT). Medical history, ongoing medications, and genital signs and symptoms were recorded. Gynecologic examination for the diagnosis and clinical scoring of genital cGVHD was combined with clinical scoring of extragenital cGVHD for the estimation of each patient's global cGVHD score. Biopsy specimens from the genital mucosa were obtained from 38 patients. Genital cGVHD was diagnosed in 22 of 42 patients (52%). Its presence was associated with systemic corticoid steroid treatment of extragenital cGVHD (P = .001), older age (P = .07), and HSCT from a sibling donor (P = .002). Five patients had isolated genital cGVHD. Dryness, pain, smarting pain (P < .05 for all), and dyspareunia (P = .001) were observed more frequently in the women with genital cGVHD. Twelve patients had advanced genital cGVHD (clinical score 3), which was the main factor explaining the high rate (15 of 42) of severe global cGVHD. The rate of genital cGVHD was similar (P = .37) in patients with a follow-up of ≥80 months (10 of 22) and those with a follow-up of <80 months (12 of 20). We found no convincing relationship between clinical diagnosis and histopathological assessment of mucosal biopsy specimens. In our group of women with a long follow-up after HSCT, genital cGVHD was common and in many cases incorrectly diagnosed. Genital cGVHD causes genital symptoms and affects sexual life, and may present without any other cGVHD, warranting early and continuous gynecologic surveillance in all women after HSCT
