Schurende dilemma’s in het aansprakelijkheidsrecht – De spanning tussen financiele en relationele compensatie

Een robuuste onderzoeksbevinding is dat letselschadeslachtoffers niet alleen financieel maar ook relationeel willen worden gecompenseerd. Aan de hand van acht interviews met letselschadeslachtoffers die hebben doorgeprocedeerd tot de Hoge Raad laten wij allereerst zien dat ook zij op zoek zijn naar beide vormen van compensatie. Ten tweede maken wij duidelijk dat dit niet betekent dat de inspanningen in verband met de behoefte aan financiële en relationele compensatie in de praktijk ook eenvoudig verenigbaar zijn; integendeel. Financiële compensatie vraagt om rationeel calculerend handelen door partijen die tegengestelde belangen najagen, terwijl relationele compensatie vraagt om een verzoenende houding waarbij beide partijen proberen de relatie te herstellen die is verstoord door het berokkende letsel. Voorts leiden wij uit ander onderzoek af dat niet alleen claimanten, maar ook aangesprokenen en hun advocaten en verzekeraars kampen met de dilemma’s die de omgang met beide behoeften met zich meebrengen. Bovendien formuleren wij de verwachting dat de spanning tussen beide handelingsprincipes verder zal toenemen als gevolg van maatschappelijke trends die gelijktijdig optreden. Of het mogelijk is om de spanning te reduceren tussen de handelingen die nodig zijn in verband met de behoefte aan financiële en relationele compensatie is twijfelachtig, aangezien beide partijen een sterke prikkel hebben om zich calculerend op te stellen en, mede hierdoor, de neiging hebben om te twijfelen aan de oprechtheid van de intenties van de andere partij om te willen verzoenen

Non pecuniary losses

Non pecuniary losses can be characterized as losses that are suffered by damaging goods or interests which have in themselves no economic price or value on a financial market. Examples are damage to goods with a primarily sentimental value, such as an album of wedding photos, pain and suffering as a result of physical injury, damage to personal reputation, or even the death of a person. Due to the fact that these goods or interests have no substantial or direct market value, non pecuniary losses are often characterized as losses that cannot be undone with money. Rogers (2001, p. 246) defines non pecuniary losses as “losses which are not damage to a person’s assets or wealth or income and which is are therefore incapable of being quantified in objective financial manner by reference to a market”. Tort law, however, generally recognizes non pecuniary losses to some extent as losses that should be compensated with money

Bruchstück eines Kultgesetzes von Olympia aus der 1. Hälfte des 6. Jh. v. Chr. (BrU 9)

Ein Bronze-Täfelchen, das ursprünglich als Teil des Hüftschutzes einer Hoplitenrüstung (pteryx 'Panzerschuppe') gedient hatte, wurde in der 1. Hälfte des 6. Jh. v. Chr. als Schriftträger wiederverwendet. Die sechszeilige Inschrift ist im Bustrophedon-Stil geschrieben: davon steht eine Zeile auf dem Kopf (sog. Schlangenschrift). Aus der Nennung von Zeus und φράτρα lässt sich vermuten, dass der Text ein Kultgesetz wiedergab; doch da zwischen den sechs kurzen Zeilen kein sachlicher oder grammatischer Zusammenhang erkennbar ist, lassen sich keine näheren Aussagen über den Inhalt der Urkunde entnehmen. Als bisher älteste Bronze-Urkunde Olympias gestattet sie neue Einblicke in die frühe Schriftlichkeit des Heiligtums, insbesondere in Formen des Delta und Rho und der Interpunktion. Schließlich dokumentiert die Inschrift den Schriftgebrauch in Olympia in der Anfangsphase der vier panhellenischen Agone.A small bronze tablet was a part of a hoplite cuirass (pteryx), but was reused for writing in the first half oft the VI cent B.C. Six short lines are written in boustrephedon-style, one line was turned upside down (so called 'false boustrephedon'). The text mentions Zeus and φράτρα; so it seems to be a lex sacra. Since the lines have no factual or grammatical connexion, context and content appear ununderstandable. It is up to now the most ancient bronze document from Olympia, which shows new details about the early use of writing in the sanctuary, particulary about the letters Delta and Rho und the punctuation. Preventie van arbeidsuitval: ontwikkelingen in arbeidsomstandighedenbeleid en civiele aansprakelijkheid

Deze afgelopen decennia is het publieke bestel ingrijpend gewijzigd met de bedoeling ervoor te zorgen dat werkgevers en werknemers meer gezamenlijke verantwoordelijkheid nemen bij de preventie van arbeidsongevallen. Dit zou er toe moeten leiden dat werkgevers hun veiligheidsbeleid intensiveren, daarbij hun werknemers in toenemende mate betrekken en daarin werknemers in toenemende mate aanspreken op hun eigen verantwoordelijkheden. Bovendien veronderstelt de stelselherziening dat beide partijen naar de civiele rechter stappen om handhaving af te dwingen en dat rechters de responsabilisering van individuele werknemers erkennen in hun uitspraken. Deze veronderstellingen hebben wij getoetst aan de hand van de manier waarop het veiligheidsbeleid van een energiebedrijf zich heeft ontwikkeld en een analyse van de wetgeving en jurisprudentie op het gebied van de aansprakelijkheid voor arbeidsongevallen en beroepsziekten. Onze bevindingen laten zien dat de werkgever zijn veiligheidsbeleid heeft geïntensiveerd en de verantwoordelijkheid van individuele werknemers heeft uitgebreid, maar dat deze veranderingen de gezamenlijkheid van het veiligheidsbeleid hebben verkleind in plaats van vergroot. The magneto-chemical interaction of spin-bearing molecules with substrates is interesting from a coordination chemistry point of view and relevant for spintronics. Unprecedented insight is provided by X-ray photo-emission electron microscopy combined with X-ray magnetic circular dichroism spectroscopy. Here the coupling of a Mn-porphyrin ad-layer to the ferromagnetic Co substrate through suitably modified interfaces is analyzed with this technique

Emergence of On-Surface Magnetochemistry

The control of exchange coupling across the molecule–substrate interface is a key feature in molecular spintronics. This Perspective reviews the emerging field of on-surface magnetochemistry, where coordination chemistry is applied to surface-supported metal porphyrins and metal phthalocyanines to control their magnetic properties. The particularities of the surface as a multiatomic ligand or “surface ligand” are introduced. The asymmetry involved in the action of a chemical ligand and a surface ligand on the same planar complexes modifies the well-established “trans effect” to the notion of the “surface-trans effect”. As ad-complexes on ferromagnetic substrates are usually exchange-coupled, the magnetochemical implications of the surface-trans effect are of particular interest. The combined action of the different ligands allows for the reproducible control of spin states in on-surface supramolecular architectures and opens up new ways toward building and operating spin systems at interfaces. Notably, spin-switching has been demonstrated to be controlled collectively via the interaction with a ligand (chemical selectivity) and individually via local addressing at the interface

Serum calcium and risk of migraine : a Mendelian randomization study

Migraine affects similar to 14% of the world's population, though not all predisposing causal risk factors are known. We used electronic health records, genetic co-heritability analysis, and a two-sampleMendelian Randomization (MR) design to determine if elevated serum calcium levels were associated with risk of migraine headache. Co-morbidity was evaluated using electronic health records obtained from the PennOmics database comprising>1 million patient entries. Genetic co-heritability and causality via MR was assessed using data from the International Headache Consortium (23,285 cases, 95,425 controls) and circulating serum calcium levels (39,400 subjects). We observed co-occurrence of migraine and hypercalcaemia ICD-9 diagnoses (OR = 1.58, P = 4 x 10-(13)), even after inclusion of additional risk factors for migraine (OR = 1.23, P = 2 x 10 -(3)). Second, we observed co-heritability (r(g) =0.191, P = 0.03) between serum calcium and migraine headache, indicating that these traits have a genetic basis in common. Finally, we found that elevation of serum calcium levels by 1 mg/dl resulting from our genetic score was associated with an increase in risk of migraine (OR = 1.80, 95% CI: 1.31-2.46, P = 2.5 x 10 -(4)), evidence supporting a causal hypothesis. We also present multiple MR sensitivity analyses in support of this central finding. Our results provide evidence that hypercalcaemia is comorbid with migraine headache diagnoses, and that genetically elevated serum calcium over lifetime appears to increase risk for migraine. Further studies will be required to understand the biologicalmechanism, pathways, and clinical implication for riskmanagement.Peer reviewe
