Entre Oriente y Occidente: Kazajstán y la nueva Ruta de la Seda de China

Este artículo analiza la visión del desarrollo a largo plazo de Kazajstán y sus ambiciosos objetivos. Tras revisar la historia de los proyectos de infraestructuras del país durante el período zarista y la era soviética, expone los planes del presidente kazajo Nursultán Nazarbáyev hasta el año 2050 para convertir al país en un hub logístico entre Oriente y Occidente. A continuación, contextualiza la visión de Nazarbáyev con la realidad política y económica de Kazajstán, en concreto, en cómo la política exterior multivectorial del Gobierno se mueve entre los proyectos de integración regional de Rusia y el empuje chino hacia el oeste para desarrollar la provincia de Xinjiang a lo largo de la nueva Ruta de la Seda. Como conclusión, dentifica los múltiples retos que pueden poner en cuestión el futuro de este plan

Závěr Smlouva o úvěru je komplexním obchodněprávním vztahem, který zajišťuje základní potřeby moderní ekonomiky. Při jejím zkoumání je nutno pracovat s několika předpisy, které upravují buď přímo úvěrovou smlouvu, nebo smlouvy, které s ní v praxi ve většině případů bezprostředně souvisí (zajištění). Právní úprava je až na výjimky dispozitivní, a proto zákonná ustanovení spíše udávají směr smluvní úpravě, než aby přímo určovala práva a povinnosti stran. V praxi se totiž právě smluvní volnost při sjednávání smlouvy o úvěru značně využívá. Je však třeba mít na paměti, že právní řád demokratického právního státu si klade za cíl vedle zajištění smluvní volnosti také ochranu slabší strany, která by jinak byla nucena podřídit se straně ve vztahu dominantní. Nelze než souhlasit s již vysloveným názorem, že "v oblasti poskytování úvěrů je dobrým zákonem ten, který je dostatečně pružný, aby nebránil dynamice obchodních vztahů a umožňoval stranám upravit si práva a povinnosti podle jejich konkrétních potřeb, a zároveň dostatečně určitý a přesný na to, aby byl efektivně schopný zabraňovat zneužívání práva silnější strany."1 Nynější právní úprava tomuto požadavku dle mého názoru vyhovuje, což dokládá fakt, že v připravovaném novém občanském zákoníku úprava úvěrové smlouvy vychází z úpravy stávající. First chapters deal with a distinction between the meaning of credit in an economic and in a legal sense, loan agreement's historical evolution and basic principles of credit granting. Then I outline the changes to the regulation of the loan agreement in the past 19 years and briefly deal with the proposal of the new complex civil code, which is being drafted at the moment. The main part of this thesis lies within the Chapter 9. There, I deal with the main issues concerning the loan agreement. Subchapter 9.1 discusses the parties to the loan agreement. It is generally accepted that there are no limitations as to who may be a creditor or who may be a debtor. Subchapters 9.2 and 9.3 deal with the obligation of the creditor to provide the financial resources stated in the agreement, with the possibility to terminate such obligation and with the payment for the conclusion of the loan agreement. The payment is deemed to a fee for the reservation of funds. Description of ways of disbursement of the loan is included in subchapter 9.4. One of the basic obligations of the debtor, the obligation to repay the loan together with the accrued interest is discussed in chapters 9.5 and 9.6. Entwicklung und Analyse von Modellen für energetische Gebäude- und Anlagensimulationen mit Geothermie auf Quartiersebene

Das Ziel der Klimaneutralität Deutschlands bis zum Jahr 2045 stellt unter anderem den Gebäudesektor vor große Herausforderungen. In den letzten Jahren wurde zunehmend erkennbar, dass die Wärmewende einen wichtigen Beitrag zur Klimaneutralität leisten muss. Diese Masterarbeit leistet einen Beitrag zur Wärmewende, indem ein Modell zur thermischen Simulation von Quartieren, die geothermisch versorgt werden sollen, entwickelt und analysiert wird. Neben der dynamischen Simulation von Quartieren wird besonderer Wert auf die Integration der Anlagentechnik in Form von Wärmepumpen, Förderpumen, Speichern und Heizsystemen gelegt, um die definierte Forschungslücke von einerseits sehr performanten und stark vereinfachten Modellen und andererseits sehr detaillierten Simulationen, die einzelne Gebäude betrachten, zu schließen. Des Weiteren sind innerhalb dieser Arbeit unterschiedliche Nutzungszusammensetzung und Standorte des Quartiers zu realisieren. Das Quartiersmodell wird mithilfe der Modelica-Bibliothek GreenCity in der Simulationsumgebung SimulationX erstellt, da diese eine große Auswahl an Elementen bereitstellt, um die genannte Zielstellung zu erreichen. Umgesetzt werden diese Ziele, indem ein Quartiersmodell entwickelt wurde, dessen Gebäude durch ein kaltes Nahwärmenetz verbunden sind. Jedem Gebäude kann eine von vier Nutzungsarten (Wohnen, Bildung, Büro, Einzelhandel) zugewiesen werden. Jedes Gebäude wird außerdem durch drei zusammenfassende Modelica-Elemente, in denen sich Untermodelle befinden, modelliert. Diese beschreiben den Netzanschluss, die Anlagentechnik und das Gebäude. Die Anlagentechnik beinhaltet eine Wärmepumpe, einen Heizpufferspeicher sowie die Möglichkeit der Kühlung des Gebäudes mittels Plattenwärmeübertrager. Between East and West:Kazakhstan and China’s new Silk Road

This article analyses Kazakhstan’s vision of long-term development and its ambitious goals. After revising the history of the infrastructure projects in the country during the tsarist period and the Soviet era, it sets out the plans of the Kazakh president, Nursultan Nazarbayev, to turn the country into a logistical hub between East and West by 2050. Later, the paper puts Nazarbayev’s vision in the context of the political and economic reality of Kazakhstan, focussing, specifically, on how the government’s multivector foreign policy fluctuates between Russia’s regional integration projects and the Chinese push westwards to develop Xinjiang province along the new Silk Road. As a conclusion, it identifies the multiple goals that may put the future of this plan in doubt
