Deconstructing Transnationalism: Conceptualizing Metanationalism as a Putative Model of Evolving Jurisprudence

This Article builds upon Philip C. Jessup\u27s revolutionary scholarship to pave new pathways for interdisciplinary research and expand the normative constitutional framework of universal human problems. To that end, this Article ties American constitutional theory to the new era of international globalization and provides context that facilitates the discussion of racial and ethnic diversity in education from a domestic and international perspective. By arguing for compelling treatment of diversity in elementary and secondary learning institutions, this Article introduces a new theory of constitutional interpretation vis-&-vis international law. This theory, called metanationalism, rejects Harold Koh\u27s theory of transnationalism and demonstrates that nationalism and transnationalism are not two mutually exclusive concepts at opposite ends of a linear spectrum of constitutional theory. Contrary to Koh\u27s postulate, metanationalism conceptualizes these two theories as components in a multidimensional paradigm where such theories exist to broaden and enrich legal analysis. Applying metanationalism, this Article argues that existing literature overlooks diversity\u27s role in the global education-rights movement and focuses on India as a case study. Lastly, this Article analyzes a recent trend in U.S. constitutional law to advocate revisiting the current equal protection landscape

Genome Editing and the Jurisprudence of Scientific Empiricism

Humankind has reached, in tow by the hand of a scientific breakthrough called CRISPR, the Rubicon of precise genetic manipulation first envisioned over fifty years ago. Despite CRISPR\u27s renown in science and its power to transform the world, it remains virtually unaddressed in legal scholarship. In the absence of on-point law, the scientific community has attempted to reach some consensus to preempt antagonistic regulation and prescribe subjective standards of use under the guise of a priori scientific empiricism. Significant and complex legal issues concerning this technology are emerging, and the void in legal scholarship is no longer tolerable. This Article shrinks the scholarly gap, and it is the first to introduce CRISPR to legal literature. By providing a resource for jurists, scholars, and practitioners, it challenges conventional notions concerning the false dichotomy frequently associated with mutually exclusive normative roles for science and law. The Article makes two independent contributions. First, it lays a robust and comprehensive epistemic foundation of genome editing suitable for legal audiences. This element is descriptive, but essential because a detailed and coherent understanding of the nuts and bolts of the science is requisite for a discussion of law and policy. Second, it advocates for a jurisprudence of scientific empiricism, namely, a normative legal framework that consolidates empiricism and technological--e.g., genome editing--applications into a uniform doctrinal structure unencumbered by common substantive impediments to constructive debate. These impediments consist of impractical and often sensationalist claims about issues raised by technological advances and are collectively characterized as deceptive simplicity. The proposed paradigm, which lays a blueprint for the legal community to combat the deleterious effects of scientific illiteracy, flows from the Supreme Court\u27s recent decision in Association for Molecular Pathology v. Myriad Genetics and is broadly adaptable to addressing questions of science in law. Applying this framework, the Article reconsiders Buck v. Belland argues that, contrary to long-held views, Buck is not a direct product of false science, but of unbridled deceptive simplicity. Lastly, the Article sets the stage for a series of forthcoming works that will analyze genome editing from regulatory, constitutional, international, egalitarian, ethical, and policy standpoints, which highlight pivotal synergistic roles for law, science, and public policy in the development of this remarkable nascent biotechnology

A geometric study of the dispersionless Boussinesq type equation

We discuss the dispersionless Boussinesq type equation, which is equivalent to the Benney-Lax equation, being a system of equations of hydrodynamical type. This equation was discussed in . The results include: a description of local and nonlocal Hamiltonian and symplectic structures, hierarchies of symmetries, hierarchies of conservation laws, recursion operators for symmetries and generating functions of conservation laws (cosymmetries). Highly interesting are the appearances of operators that send conservation laws and symmetries to each other but are neither Hamiltonian, nor symplectic. These operators give rise to a noncommutative infinite-dimensional algebra of recursion operators

Competencias gerenciales y la gestión institucional en un Gobierno Regional, 2022

El presente trabajo de investigación tuvo como objetivo general, determinar la influencia de las Competencias Gerenciales en la Gestión Institucional en el gobierno regional de Ancash 2022. El presente estudio de investigación fue de tipo aplicada, con diseño de investigación no experimental, correlacional de corte transversal, se utilizó una muestra no probabilística que incluyó a los 201 trabajadores que se encuentran distribuidos en las diferentes oficinas de un gobierno regional, se utilizó para el recojo de información la técnica de la encuesta y dos cuestionarios que contienen indicadores de las variables y las alternativas de respuesta tipo Likert, se utilizó procedimientos estadísticos descriptivos y para el contraste de hipótesis de investigación se utilizó la prueba de correlación Rho de Spearman para la presentación de los resultados. Los resultados del presente trabajo de investigación evidenció que el 27,9% de los encuestados obtuvieron un nivel regular en sus competencias gerenciales con un resultado regular en gestión institucional, la prueba no paramétrica Rho de Spearman demostró la existencia de relación directa significativa entre las competencias gerenciales y la gestión institucional en un gobierno regional 2022, con un coeficiente de correlación 0,570 un p=0,000<0,05, con el cual se demuestra que, a mayores competencias gerenciales, mayor será los niveles de la gestión institucional

Newly detected data from Haestasaurus and review of sauropod skin morphology suggests Early Jurassic origin of skin papillae

Discovered in 1852, the scaly skin belonging to Haestasaurus becklesii was the first to be described in any non-avian dinosaur. Accordingly, it has played a crucial role in the reconstruction of sauropod integument and dinosaurs more broadly. Here, we reassess this historic specimen using Laser-Stimulated Fluorescence (LSF), revealing extensive, previously unknown regions of skin that augment prior interpretations of its integumentary morphology and taphonomy. Under white light, polygonal–subrounded, convex scales are visible on one side of the block (‘side A’), but LSF reveals extensive smaller and more flattened scales, which are diagenetically fragmented, on the reverse block surface (‘side B’). Contrary to the prior interpretation that the visible scales are the epidermal undersides, the presence of convex, intrascale papilliform textures on side A suggests that the external skin surface is exposed. We define intrascale papillae and provide a review of sauropod skin morphology, which clarifies that intrascale papillae are unique to and widespread across stem Neosauropoda, and likely have an evolutionary origin in the Early Jurassic. Intrascale papillae may ultimately have been integral to the evolution of gigantism in this charismatic clade

Vulnerabilidad sísmica en viviendas de albañilería confinada en la Urbanización López Albújar - Sullana, Piura - 2021

La presente tesis titulada “Vulnerabilidad sísmica en viviendas de albañilería confinada en la Urbanización López Albújar - Sullana, Piura - 2021” tiene como objetivo determinar el grado de vulnerabilidad sísmica en las viviendas de estudio con sistema estructural de albañilería confinada. En este proyecto se recolectó información de una muestra de 04 viviendas, donde se evaluaron los parámetros de densidad de muros, estabilidad de tabiques y parapetos, calidad de mano de obra y materiales, se desarrolló adicionalmente un modelamiento sísmico estructural de las viviendas en su estado actual para así controlar los máximos desplazamiento con propuestas de reforzamiento estructural. Como resultado obtenido se muestra que las viviendas presentan un grado de vulnerabilidad sísmica alto en un total del 100%, media en un total de 0% y baja en un total de 0%. Finalmente, se concluyó que el valor del porcentaje es el total de las viviendas, se debe al factor de la ausencia de muros portantes en la dirección X, así como la inestabilidad de muros no estructurales al volteo, la mala calidad de mano de obra y materiales deficientes, la baja capacidad portante del suelo y desplazamientos de las viviendas por encima de lo establecido en la norma E.03

La presente investigación es necesaria para los operadores del derecho, porque deben considerar la incorporación de la figura del Delito de Terrorismo en la Ley N° 30077, Ley Contra el Crimen Organizado. Así también es conveniente, ya que al incluir este delito se podrá calificar al mismo como un delito de criminalidad organizada. The Breakthrough Listen Search for Intelligent Life: A 3.95-8.00 GHz Search for Radio Technosignatures in the Restricted Earth Transit Zone

We report on a search for artificial narrowband signals of 20 stars within the restricted Earth Transit Zone as a part of the ten-year Breakthrough Listen (BL) search for extraterrestrial intelligence. The restricted Earth Transit Zone is the region of the sky from which an observer would see the Earth transit the Sun with an impact parameter of less than 0.5. This region of the sky is geometrically unique, providing a potential way for an extraterrestrial intelligence to discover the Solar System. The targets were nearby (7-143 pc) and the search covered an electromagnetic frequency range of 3.95-8.00 GHz. We used the Robert C. Byrd Green Bank Telescope to perform these observations with the standard BL data recorder. We searched these data for artificial narrowband ($\sim$Hz) signals with Doppler drift rates of $\pm 20$ Hz s$^{-1}$. We found one set of potential candidate signals on the target HIP 109656 which was then found to be consistent with known properties of anthropogenic radio frequency interference. We find no evidence for radio technosignatures from extraterrestrial intelligence in our observations. The observing campaign achieved a minimum detectable flux which would have allowed detections of emissions that were $10^{-3}$ to $0.88$ times as powerful as the signaling capability of the Arecibo radar transmitter, for the nearest and furthest stars respectively. We conclude that at least $8\%$ of the systems in the restricted Earth Transit Zone within 150 pc do not possess the type of transmitters searched in this survey. To our knowledge, this is the first targeted search for extraterrestrial intelligence of the restricted Earth Transit Zone. Es as? que la certificaci?n voluntaria en sostenibilidad viene cobrando relevancia, entre ellas, la B Corp, y en especial en las mypes creadas en los ?ltimos a?os, siendo el sector de hidrocarburos, una industria con el potencial de aplicar a esta certificaci?n. TEC, Trigger and Check, preparing LOFAR for Lunar observations

One of the main ways to use radio to detect Ultra High Energy Neutrinos and Cosmic Rays is the Lunar Askaryan technique, that uses the Moon as a target and searches for nanosecond pulses with large radio telescopes. To use low frequency aperture arrays, such as LOFAR and the SKA, pose new challenges and possibilities in detection techniques of short radio pulses and to measure the Total Electron Content (TEC). As a prepatory work, we have used other measurements that use similar techniques, or that can answer a specific question, with the LOFAR radio telescope. This contribution reports on our work on triggering on short radio signals, post-event imaging of radio signals from buffered data and methods to determine the TEC-value
