    A Defender\u27s Take on Good Prosecutors

    When Professor Abbe Smith asked “Can You Be a Good Person and a Good Prosecutor” in 2001 (and answered it mostly in the negative), she began a conversation that would result in me, a public defender, having to repeatedly answer the question from earnest law students and young lawyers. I haven’t yet forgiven Professor Smith. My first impulse when I’m asked the question is to hand out her home phone number. My second impulse is to answer: “Why are you asking me?” I’m a defense lawyer. Worse still, I am a public defender. I’m not, shall we say, naturally drawn to answering questions about who should become a prosecutor. Nor am I naturally drawn to “good people.” But here we are seventeen years later and the question is still on the table—perhaps more so than ever with the election of several “progressive prosecutors” in notable jurisdictions. I will start by saying that I would like to practice in a criminal justice system where the question of whether a “good person” can be a “good prosecutor” is a silly, even offensive, question. The fact that in this day and age it is instead a legitimate question fraught with moral significance speaks volumes about the system itself

    Jeffrey Epstein’s death in the federal jail in downtown Manhattan was the result of a conspiracy. But the conspirators were not the Clintons, President Trump, or Prince Andrew. Instead, his death, like too many others, was the result of a longtime conspiracy of lawmakers and actors within the criminal legal system itself. Several features of our legal system seem almost designed to promote suicide in jail. This Article examines and proposes solutions to two of those features: (1) jail conditions are inhumane in part because inmates face often insurmountable obstacles to hold jailers accountable; and (2) high rates of pretrial detention put far too many people at risk

    A Laboratory Test of Alcohol-Related Intimate Partner Aggression: Expectancies Are Not to Blame

    Background: The role of alcohol expectancies and evaluations (i.e., perceived outcomes of drinking and whether these outcomes are desirable) in alcohol-related intimate partner aggression (IPA) has been debated, with some researchers arguing that expectancies fully account for the alcohol-IPA relationship and others suggesting they play a minimal if any role in alcohol-related IPA. In the current study, we examine the impact of expectancies and evaluations on alcohol-related IPA observed in the lab, in order to clarify what impact, if any, alcohol expectancies have on alcohol-related IPA. Consistent with findings from laboratory studies examining general aggression, we expected that individuals who were intoxicated would display greater IPA than individuals who were sober, but that alcohol expectancies and evaluations would be unrelated to in vivo IPA. Method: Participants were 69 dating couples (total N = 138), randomly assigned to consume either an alcohol or placebo beverage. IPA was measured with an in vivo aggression task based on the Taylor Aggression Paradigm. Results: As expected, alcohol intoxication predicted in vivo IPA following provocation (p \u3c .03), whereas alcohol expectancies and evaluations were not related to IPA. Conclusions: These findings provide further support that alcohol expectancies and evaluations play little if any role in alcohol-related IPA. Rather, intoxication likely increases risk for IPA through its physiological effects on perception and thought. Further, treatments targeting alcohol use, rather than beliefs about outcomes of drinking, may have a greater impact on alcohol-related IPA

    Genetic and environmental melanoma models in fish

    Experimental animal models are extremely valuable for the study of human diseases, especially those with underlying genetic components. The exploitation of various animal models, from fruitflies to mice, has led to major advances in our understanding of the etiologies of many diseases, including cancer. Cutaneous malignant melanoma is a form of cancer for which both environmental insult (i.e., UV) and hereditary predisposition are major causative factors. Fish melanoma models have been used in studies of both spontaneous and induced melanoma formation. Genetic hybrids between platyfish and swordtails, different species of the genus Xiphophorus, have been studied since the 1920s to identify genetic determinants of pigmentation and melanoma formation. Recently, transgenesis has been used to develop zebrafish and medaka models for melanoma research. This review will provide a historical perspective on the use of fish models in melanoma research, and an updated summary of current and prospective studies using these unique experimental systems

    Ultraviolet (UV) light is a primary environmental risk factor for melanoma, a deadly form of skin cancer derived from the pigmented cells called melanocytes. UVB irradiation causes DNA damage, mainly in the form of pyrimidine dimers (cis-syn cyclobutane pyrimidine dimers and pyrimidine (6-4) pyrimidone photoproducts), and organisms have developed complex multiprotein repair processes to cope with the DNA damage. Zebrafish is becoming an important model system to study the effects of UV light in animals, in part because the embryos are easily treated with UV irradiation, and the DNA damage repair pathways appear to be conserved in zebrafish and mammals. We are interested in exploring the effects of UV irradiation in young adult zebrafish, so that we can apply them to the study of gene–environment interactions in models of skin cancer. Using the Xiphophorus UV melanoma model as a starting point, we have developed a UV irradiation treatment chamber, and established UV treatment conditions at different ages of development. By translating the Xiphophorus UV treatment methodology to the zebrafish system, we show that the adult zebrafish skin is competent for nucleotide excision DNA damage repair, and that like in mammalian cells, UV treatment promotes phosphorylation of H2AX and a p53-dependent response. These studies provide the groundwork for exploring the role of UV light in melanoma development in zebrafish

    Single-Particle Density of States of a Superconductor with a Spatially Varying Gap and Phase Fluctuations

    Recent experiments have shown that the superconducting energy gap in some cuprates is spatially inhomogeneous. Motivated by these experiments, and using exact diagonalization of a model d-wave Hamiltonian, combined with Monte Carlo simulations of a Ginzburg-Landau free energy functional, we have calculated the single-particle density of states LDOS(ω,r)(\omega,r) of a model high-Tc_c superconductor as a function of temperature. Our calculations include both quenched disorder in the pairing potential and thermal fluctuations in both phase and amplitude of the superconducting gap. Most of our calculations assume two types of superconducting regions: α\alpha, with a small gap and large superfluid density, and β\beta, with the opposite. If the β\beta regions are randomly embedded in an α\alpha host, the LDOS on the α\alpha sites still has a sharp coherence peak at T=0T = 0, but the β\beta component does not, in agreement with experiment. An ordered arrangement of β\beta regions leads to oscillations in the LDOS as a function of energy. The model leads to a superconducting transition temperature TcT_c well below the pseudogap temperature Tc0T_{c0}, and has a spatially varying gap at very low TT, both consistent with experiments in underdoped Bi2212. Our calculated LDOS(ω,r)(\omega,r) shows coherence peaks for TTcT T_c, in agreement with previous work considering phase but not amplitude fluctuations in a homogeneous superconductor.     The Alternative for Germany’s radicalization in historical-comparative perspective

    This article chronicles the AfD’s rightward repositioning and compares it with the programmatic development of three postwar German parties on the ideological wings. By highlighting factors that tilt the balance of power away from moderate reformers towards hardliners, this comparative analysis sheds light on the conditions that lead a relatively successful party on the ideological wings, such as the AfD, to radicalize its programme. Four variables stand out: whether party hardliners take the blame for the recent election loss; whether they offer a convincing programmatic and strategic alternative to the reformers; whether changes in party composition strengthen hardliners; and whether external factors enhance their weight within the party. The essay concludes that the AfD’s radicalization was unusual, but not exceptional. It is however too early to conclude that the Federal Republic’s distinctive institutions and political culture no longer impose significant costs on parties that shift their programmes away from the centre
