    The practice of the ECtHR in economic and civil law and process: international legal experience

    The article examines the practice of the European Court of Human Rights (hereinafter referred to as the ECtHR) in commercial and civil law and process, in particular, in the context of implementing compliance in the company. In particular, it is determined which complaints regarding which provisions of the Convention affect business compliance practices and which conclusions from relevant cases the business community implements when building a compliance system. The article examines the question of classifying compliance as an asset that constitutes the company's added value, namely, the category of "goodwill" in accordance with the practice of the European Court of Justice in this area. The purpose of the work is to analyze the international legal experience of using the practice of the ECtHR in economic and civil law and process. The methodological basis of this study is the following methods: methods of analysis and synthesis, methods of induction and deduction, the system method, structural method, functional method, technical-dogmatic method, special-legal method, comparative method, method of legal modeling, method of analysis and synthesis, a method of theoretical generalization and systematization. As a result of the study, the foreign experience of implementing the judicial practice of the ECtHR in economic and civil law and process was analyzed

Offshore deep water drilling is carried out with the help of equipped drilling vessels with the property of dynamic stability. Greater depth is marked by the probability of a slight deviation of the drill from the initial position.     ECONOMIC EFFICIENCY OF THE GHG EMISSIONS FROM ENERGY USE IN AGRICULTURE: COMPARATIVE ANALYSIS OF UKRAINE AND THE EU MEMBER STATES

    The article is devoted to the study of the economic efficiency of GHG emissions from the use of energy in agriculture in the EU and the candidate country for accession - Ukraine. Using the abstract-logical method, the essence of the category "economic efficiency of greenhouse gas emissions" was clarified and an indicator for its assessment was proposed. By actual statistical data and the method of economic analysis, calculations of the economic efficiency of carbon dioxide emissions from the use of energy in agriculture of the EU member states and Ukraine were made. The key factor influencing the economic efficiency of GHG emissions from energy consumption in the agricultural sector was identified. Due to econometric method of approximation estimation and the Excel software package, the presence of a direct, high-density linear relationship between energy consumption and carbon dioxide emissions in agricultural production was established. By ranking method and comparative economic analysis, a threshold value of energy consumption per hectare of agricultural land was found, which corresponds to a relatively high value gross production per ton of carbon dioxide emissions among the studied countries. It was established that for the candidate country for joining the EU - Ukraine and for the two Baltic countries - Latvia and Estonia, in order to increase the level of economic efficiency of GHG emissions in terms of implementation the European Green Deal, it is worth paying primary attention to the growth of economic productivity. Also, due to graphical and tabular methods of processing statistical data, it was established that the use of environmentally friendly energy (in particular, electric energy) in the process of agricultural production is not a key factor affecting the economic efficiency of GHG emissions

    The article deals with the peculiarities of formation of competitive strategy of the enterprises of flour-milling branch of Ukraine. The paper substantiates the necessity to determine the stage of the life cycle of the industry in the process of formation of the competitive strategy. The market analysis of flour-milling industry of Ukraine is carried out on indicators: size of the market, commodity nomenclature, buyers and their behavior, raw material base and intensity of competition.  The paper determines that the flour-milling industry of Ukraine is at the stage of growth and has a number of tendencies, such as: decrease   in sales volumes, increase in export volumes, standardization of products and average level of competition intensity. The following stages of the life cycle of the industry are studied: introduction, growth, maturity and decline. The paper proves the necessity of distinguishing the stage of renewal in the life cycle of the industry, which is implemented on the basis of modern technologies. The practical significance of the research consists in developing recommendations for choosing a competitive strategy of the flour mill enterprise in accordance with the stage of the life cycle of the industry. The enterprises of the flour-milling industry of Ukraine, in accordance with the stage of the life cycle of the industry are recommended to form competitive advantages on the basis of the concept of "lean production"

    The method of creating an objective (natural) typification of sections of the coal seam of the Dniprovska mine of different capacities according to germanium concentrations has been established and substantiated. The constructed dendrograms of clustering of coal seam areas by Ge content can be used as a basis for developing a natural typification of coal seams for geological and economic evaluation. This will make it possible to make maximum use of already available information and interpret the obtained results in geological and genetic concepts, which provides the possibility of its use for the complex use of mineral raw materials, solving strategic issues of sustainable development of Ukraine

    Психометричні властивості методики «Оцінка негативних психічних реакцій і станів учасників бойових дій» та досвід її застосування в короткочасному психологічному відновленні

    The article shows the development of the method of psychological evaluation called “Evaluation of Negative Mental Reactions and States of Combatants”. In the study participated 1300 male servicemen (29.84% from junior lieutenant to colonel and servicemen under contract and demobilized, and 70.16% from private to senior warrant officer). The age of participants varied from 20 to 55 years. The system of evaluation developed consisted of 16 instruments that could help to determine the presence of negative psychological symptoms of servicemen related to their participation in hostilities. The results indicated that the evaluation method developed is a tool that allows determining the presence of negative psychological symptoms related to participation in combat. Likewise, it is a useful and fast method to assess the effectiveness of short-term psychological recovery programs. Unlike existing methods of diagnosing negative mental reactions and states of an individual, which arose after their participation in hostilities, the developed psychodiagnostic toolkit could consider the physical and mental fatigue of the respondents, their deterioration, and other cognitive dysfunctions.У статті показано розвиток методики психологічної оцінки «Оцінка негативних психічних реакцій і станів учасників бойових дій». У дослідженні взяли участь 1300 військовослужбовців чоловічої статі (29,84% від молодшого лейтенанта до полковника та військовослужбовців за контрактом і демобілізованих та 70,16% від рядового до старшого прапорщика). Вік учасників коливався від 20 до 55 років. Розроблена система оцінювання складалася з 16 інструментів, за допомогою яких можна було визначити наявність у військовослужбовців негативних психологічних симптомів, пов’язаних з участю у бойових діях. Результати показали, що розроблена методика оцінки є інструментом, який дозволяє визначити наявність негативних психологічних симптомів, пов’язаних з участю в бойових діях. Крім того, це корисний і швидкий метод оцінки ефективності короткострокових програм психологічного відновлення. На відміну від існуючих методик діагностики негативних психічних реакцій і станів особистості, що виникли після участі в бойових діях, розроблений психодіагностичний інструментарій міг враховувати фізичну та психічну втому респондентів, їх погіршення та інші когнітивні дисфункції
