    Intellectual Property Laws and Governance

    Commercial law plays a large part in China's transition to its status as a major trading nation. This book contains chapters that focus on areas of the law pertinent to China's continuing economic development. It provides an analysis of the Five Year Plans and their effect on the development of and changes in commercial law. China is focused on developing its internal market and Commercial Law of the People's Republic of China provides an examination of a number of highly relevant topics, such as Company Law, Labour Law, Property Law, Intellectual Property Law, Consumer Law, Energy Law and Renewable Energy Law. Chapters on Tax Law, Competition Law and Policy, and Commercial Arbitration Law written by experts in their field provide an up-to-date and in-depth coverage of other important commercial law subjects. This book acknowledges that China's rapid development is affected by policy changes on issues such as urbanisation, the structure of the industrial sector and the environment. These changes and their effect on the national economy and the legal system are discussed in the book

    Triage, decision-making and follow-up of patients referred to a UK forensic service: validation of the DUNDRUM toolkit

    BACKGROUND: Forensic medium secure services in the UK are a scarce but essential resource providing care for those in the criminal justice system with severe mental disorder. Appropriate allocation of beds to those most in need is essential to ensure efficient use of this resource. To improve decision-making processes in a UK forensic service, an admissions panel utilized the DUNDRUM 1&2 (D1 & D2) triage instruments. METHODS: Demographic, diagnostic and clinical information on a prospective sample of referrals to a UK adult forensic service was gathered (n = 195). D1 and D2 measures were scored by a panel of clinical managers considering referral information and clinician opinion in reaching their ratings; those not admitted were also followed up. RESULTS: Within the sample, D1 ratings were predictive of decisions to admit (AUC = .79) and also differentiated between levels of security (F(4) = 16.54, p < .001). Non-admission was not significantly associated with increased risk of offending at follow-up. Items relating to self-harm and institutional behaviour did not show a predictive relationship with the panel decision to admit. CONCLUSIONS: Use of a structured professional judgement tool showing good predictive validity has improved transparency of decisions and appears to be associated with more efficient use of resources, without increased risk to the public

    Dispelling the N^3 myth for the Kt jet-finder

    At high-energy colliders, jets of hadrons are the observable counterparts of the perturbative concepts of quarks and gluons. Good procedures for identifying jets are central to experimental analyses and comparisons with theory. The Kt family of successive recombination jet finders has been widely advocated because of its conceptual simplicity and flexibility and its unique ability to approximately reconstruct the partonic branching sequence in an event. Until now however, it had been believed that for an ensemble of N particles the algorithmic complexity of the Kt jet finder scaled as N^3, a severe issue in the high multiplicity environments of LHC and heavy-ion colliders. We here show that the computationally complex part of Kt jet-clustering can be reduced to two-dimensional nearest neighbour location for a dynamic set of points. Borrowing techniques developed for this extensively studied problem in computational geometry, Kt jet-finding can then be performed in N ln N time.     A Delphi study to strengthen research methods training in undergraduate psychology programmes

    Psychology programmes often emphasise inferential statistical tests over a solid understanding of data and research design. This imbalance may leave graduates under-equipped to effectively interpret research and employ data to answer questions. We conducted a two-round modified-Delphi to identify the research methods skills that the UK psychology community deems essential for undergraduates to learn. Participants included 103 research methods instructors, academics, students, and non-academic psychologists. Of 78 items included in the consensus process, 34 reached consensus. We coupled these results with a qualitative analysis of 707 open-ended text responses to develop nine recommendations for organisations that accredit undergraduate psychology programmes—such as the British Psychological Society (BPS). We recommend that accreditation standards emphasise (1) dataskills, (2) research design, (3) descriptive statistics, (4) critical analysis, (5) qualitative methods, and (6) both parameter estimation and significance testing; as well as (7) give precedence to foundational skills, (8) promote transferable skills, and (9) create space in curricula to enable these recommendations. Our data and findings can inform modernised accreditation standards to include clearly-defined, assessable, and widely-encouraged skills that foster a competent graduate body for the contemporary world

    Prion disease induced alterations in gene expression in spleen and brain prior to clinical symptoms

    Prion diseases are fatal neurodegenerative disorders that affect animals and humans. There is a need to gain understanding of prion disease pathogenesis and to develop diagnostic assays to detect prion diseases prior to the onset of clinical symptoms. The goal of this study was to identify genes that show altered expression early in the disease process in the spleen and brain of prion disease-infected mice. Using Affymetrix microarrays, we identified 67 genes that showed increased expression in the brains of prion disease-infected mice prior to the onset of clinical symptoms. These genes function in many cellular processes including immunity, the endosome/lysosome system, hormone activity, and the cytoskeleton. We confirmed a subset of these gene expression alterations using other methods and determined the time course in which these changes occur. We also identified 14 genes showing altered expression prior to the onset of clinical symptoms in spleens of prion disease infected mice. Interestingly, four genes, Atp1b1, Gh, Anp32a, and Grn, were altered at the very early time of 46 days post-infection. These gene expression alterations provide insights into the molecular mechanisms underlying prion disease pathogenesis and may serve as surrogate markers for the early detection and diagnosis of prion disease

    Inclusive Jet Production, Parton Distributions, and the Search for New Physics

    Jet production at the Tevatron probes some of the smallest distance scales currently accessible. A gluon distribution that is enhanced at large x compared to previous determinations provides a better description of the Run 1b jet data from both CDF and D0. However, considerable uncertainty still remains regarding the gluon distribution at high x. In this paper, we examine the effects of this uncertainty, and of the remaining uncertainties in the NLO QCD theory, on jet cross section comparisons to Run 1b data. We also calculate the range of contributions still possible from any new physics. Predictions are also made for the expanded kinematic range expected for the ongoing Run 2 at the Tevatron and for the LHC.Comment: 50 pages, 31 figures, RevTe

    Structural and chemical embrittlement of grain boundaries by impurities: a general theory and first principles calculations for copper

    First principles calculations of the Sigma 5 (310)[001] symmetric tilt grain boundary in Cu with Bi, Na, and Ag substitutional impurities provide evidence that in the phenomenon of Bi embrittlement of Cu grain boundaries electronic effects do not play a major role; on the contrary, the embrittlement is mostly a structural or "size" effect. Na is predicted to be nearly as good an embrittler as Bi, whereas Ag does not embrittle the boundary in agreement with experiment. While we reject the prevailing view that "electronic" effects (i.e., charge transfer) are responsible for embrittlement, we do not exclude the role of chemistry. However numerical results show a striking equivalence between the alkali metal Na and the semi metal Bi, small differences being accounted for by their contrasting "size" and "softness" (defined here). In order to separate structural and chemical effects unambiguously if not uniquely, we model the embrittlement process by taking the system of grain boundary and free surfaces through a sequence of precisely defined gedanken processes; each of these representing a putative mechanism. We thereby identify three mechanisms of embrittlement by substitutional impurities, two of which survive in the case of embrittlement or cohesion enhancement by interstitials. Two of the three are purely structural and the third contains both structural and chemical elements that by their very nature cannot be further unravelled. We are able to take the systems we study through each of these stages by explicit computer simulations and assess the contribution of each to the nett reduction in intergranular cohesion. The conclusion we reach is that embrittlement by both Bi and Na is almost exclusively structural in origin; that is, the embrittlement is a size effect.Comment: 13 pages, 5 figures; Accepted in Phys.
