Rule 9011 of the Federal Rule of Bankruptcy Procedure

(Excerpt) Rule 9011(b) of the Federal Rules of Bankruptcy Procedure, the bankruptcy counterpart to Rule 11 of the Federal Rules of Civil Procedure (“Rule 11”), provides, that in presenting a pleading to the court, an attorney or unrepresented party is certifying that to the best of the person’s knowledge, information, and belief, formed after an inquiry reasonable under the circumstances, that: (1) it is not being presented for any improper purpose, such as to harass or to cause unnecessary delay or needless increase in the cost of litigation; (2) the claims, defenses, and other legal contentions therein are warranted by existing law or by a nonfrivolous argument for the extension, modification, or reversal of existing law or the establishment of new law; (3) the allegations and other factual contentions have evidentiary support or, if specifically so identified, are likely to have evidentiary support after a reasonable opportunity for further investigation or discovery; and (4) the denials of factual contentions are warranted on the evidence or, if specifically so identified, are reasonably based on a lack of information or belief. Rule 9011(c) further provides that, if after notice and a reasonable opportunity to respond, the court determines that Rule 9011(b) has been violated, the court may, subject to certain stated conditions, impose an appropriate sanction upon the attorney, law firm, or party that has violated Rule 9011(b) or is responsible for the violation. This Article discusses the requirements of Rule 9011 and the sanctions that may be imposed against a party that fails to satisfy those requirements. Section I of this Article discusses the first prong of Rule 9011, which prohibits the filing of a bankruptcy documents for an improper purpose. Section II discusses the second prong of Rule 9011, which forbids the filing of a bankruptcy petition that is not warranted in law. Section III explains the third prong of Rule 9011, which requires an attorney to conduct a reasonable inquiry before submitting a bankruptcy petition. Section IV explains the fourth prong, which requires an attorney to conduct a reasonable inquiry before submitting his defenses and denials. Section V discusses the sanctions a court may impose if an attorney fails to comply with Rule 9011. Section VI illustrates the procedural requirements of Rule 9011, particularly, the safe harbor provision. Lastly, Section VII considers the implications of Rule 9011

Método de evaluación del costo de faltantes

An environmental assessment of the John Pennekamp Coral Reef State Park and the Key Largo Coral Reef Marine Sanctuary (Unpublished 1983 Report)

The Pennekamp Coral Reef State Park was established in 1960 and the Key Largo National Marine Sanctuary in 1975. Field studies, funded by NOAA, were conducted in 1980 - 1981 to determine the state of the coral reefs and surrounding areas in relation to changing environmental conditions and resource management that had occurred over the intervening years. Ten reef sites within the Sanctuary and seven shallow grass and hardbottom sites within the Park were chosen for qualitative and quantitative studies. At each site, three parallel transects not less than 400 m long were run perpendicular to the reef or shore, each 300 m apart. Observations, data collecting and sampling were done by two teams of divers. Approximately 75 percent of the bottom within the 18-m isobath was covered by marine grasses, predominantly turtle grass. The general health of the seagrasses appeared good but a few areas showed signs of stress. The inner hardbottom of the Park was studied at the two entrances to Largo Sound. Though at the time of the study the North Channel hardbottom was subjected to only moderate boat traffic, marked changes had taken place over the past years, the most obvious of which was the loss of the extensive beds of Sargassum weed, one of the most extensive beds of this alga in the Keys. Only at this site was the green alga Enteromorpha encountered. This alga, often considered a pollution indicator, may denote the effects of shore run off. The hardbottom at South Channel and the surrounding grass beds showed signs of stress. This area bears the heaviest boat traffic within the Park waters causing continuous turbidity from boat wakes with resulting siltation. The offshore hardbottom and rubble areas in the Sanctuary appeared to be in good health and showed no visible indications of deterioration. Damage by boat groundings and anchors was negligible in the areas surveyed. The outer reefs in general appear to be healthy. Corals have a surprising resiliency to detrimental factors and, when conditions again become favorable, recover quickly from even severe damage. It is, therefore, a cause for concern that Grecian Rocks, which sits somewhat inshore of the outer reef line, has yet to recover from die-off in 1978. The slow recovery, if occurring, may be due to the lower quality of the inshore waters. The patch reefs, more adapted to inshore waters, do not show obvious stress signs, at least those surveyed in this study. It is apparent that water quality was changing in the keys. Water clarity over much of the reef tract was observed to be much reduced from former years and undoubtedly plays an important part in the stresses seen today over the Sanctuary and Park. Dentro de los estándares curriculares de ciencias naturales, orientados desde el Ministerio de Educación Nacional, la educación ambiental se plantea como el desarrollo de proyectos ambientales –PRAE–, que contribuyen con la comunidad estudiantil a mejorar sus condiciones medioambientales. Los docentes somos conscientes de la responsabilidad que tenemos frente a la protección del ambiente a nivel global, debido al agotamiento de los recursos no renovables y la problemática del cambio climático, debido a que en el colegio no se desarrollaban prácticas que pudieran incentivar a los estudiantes en el cuidado de su entorno. Fue necesario establecer una práctica de educación ambiental para fortalecer el conocimiento interdisciplinar y para sensibilizar a la comunidad estudiantil, sobre la forma de aprovechar eficazmente el recurso hídrico y la reutilización de residuos sólidos, fortaleciendo sus competencias comunicativas a partir de su socialización.Primera edició

In vitro regeneration of Pinus brutia Ten. var. eldarica (Medw.) through organogenesis

This paper describes two in vitro regeneration systems through direct and indirect organogenesis in Pinus brutia using fascicles aseptic cultures as explants. Mechanical scarification and gibberellic acid (GA3) were evaluated on in vitro seed germination. Scarification was the treatment that allowed for in vitro seed germination. The highest direct organogenic response was obtained in Murashige and Skoog (MS) medium containing 4.5 µM thidiazuron, whereas the highest indirect organogenesis was obtained with 9.8 µM thidiazuron and 3.4 µM paclobutrazol. The isolated shoots were rooted on MS medium supplemented with 1.70 µM indoleacetic acid. A large variation in root ability was observed among plantlets. These results suggest that both regeneration systems can be applied to the micropropagation or genetic transformation of P. brutia.Key words: Pinus brutia, organogenesis, fascicles, paclobutrazol, thidiazuron

Las transiciones académicas y socio-emocionales de los estudiantes no promocionados del grado sexto del Colegio Luis López de Mesa I.E.D. en el año 2014.

La investigación se centró en analizar las transiciones académicas y socio- emocionales de los estudiantes no promocionados del grado sexto del Colegio Luis López de Mesa IED en el año 2014. A partir de las voces de los estudiantes y maestros. Luego se hace un barrido de los antecedentes investigativos y los referentes conceptuales, relacionando lo arrojado en la aplicación de los instrumentos aplicados. La metodología utilizada es la biográfica y para el análisis de los datos se seleccionan cuatro categorías la primera Transitar por situaciones problémicas con los aprendizajes escolares, la segunda Transitar por situaciones problémicas en la relación con los maestros, la tercera Transitar por las relaciones convivenciales y la valoración de las amistades y la cuarta transitar entre las relaciones familiares escolarizadas. Dentro de las conclusiones podemos resaltar que todo estudiante, durante gran parte de la escolaridad, debe asumir e incorporarse rápidamente a la cultura escolar y a los cambios que los escenarios, tiempos y sujetos se construyen y viven. Para esto, no hay preparación, es en la vivencia misma y en las exigencias escolares en las que se aprende a sobrellevar la escuela

Adenocarcinoma vesical: Presentación de un caso y revisión de la literatura

Paciente masculino mestizo de 39 años de edad, fumador con antecedentes de buena salud  que acude a consulta externa refiriendo hematuria y dificultad para orinar. Se le realiza tacto rectal y se le detecta tumoración que hacía protusión en el saco de Douglas y de la cual se tomó biopsia para estudio histológico. Se llega al siguiente diagnóstico:  Carcinoma papilar sin poder precisar origen exacto y que el diagnóstico concluyente quedaba sujeto a pruebas de inmunohistoquímica.   Estas pruebas fueron realizadas y el diagnóstico diferencial quedó concluido como Adenocarcinoma papilar de vejiga urinaria .  Nos entusiamó la controversia diagnóstica desde el punto de vista morfológico que  se establece en  esta entidad, la utilidad de las pruebas inumohistoquìmicas  en su corroboración, así como la precisión del origen vesical o uracal.   Palabras clave: Adenocarcinoma papilar vesical o uracal. Un Método para Evaluar Medidas de Control de Peligros en el Proceso de Frutillas Congeladas

Para garantizar la inocuidad alimentaria en el procesamiento de alimentos se puede utilizar la Norma ISO 22000. En este trabajo se presenta la aplicación de la metodología del Análisis de Peligros y Puntos Críticos de Control en el procesode frutillas congeladas. Para determinar si un peligro es significativo se usó el riesgo como la probabilidad de ocurrencia por la severidad. Se diseñó un método para evaluar las medidas de control para los peligros significativos en base a las 7 preguntas del requisito 7.4.4 de la Norma. Se identificaron 2 Puntos Críticos de Control y 3 Programas de Prerrequisitos Operativos con sus correspondientes monitoreos. Como conclusión se ha logrado definir los Programas de Puntos Críticos de Control y Prerrequisitos Operativos que le permitirá prevenir los peligros en el proceso de congelado de frutillas

Educación Musical y su relación con la atención sostenida en niños y niñas de 5 años de la I.E.I 102 Piloto del distrito de Lurigancho-Chosica

El objetivo es para dar conocimiento de la presente tesis indaga y busca señalar la estrecha relación que existe entre la educación musical y la atención sostenida en los alumnos de 5 años de la I.E.I 102 Piloto del distrito de Lurigancho-Chosica. Este estudio propone hacer el trabajo de investigación haciendo uso del enfoque cuantitativo, siguiendo una línea de investigación fundamental, sustantiva o básica, usando los mecanismos del método descriptivo correlacional, encontrando la muestra a estudiar de manera no probabilística, tomando en cuenta a los 111 niños de 5 años. Primero se profundiza en todos los elementos a tomar en cuenta en el estudio, así como las distintas teorías que demuestra lo importante que es la educación musical en los niños y la influencia en el desarrollo de la atención. Así como los métodos que usaron renombrados investigadores para potenciar dicha relación.The objective is to give knowledge of this thesis investigates and seeks to point out the close relationship that exists between education music and sustained attention in 5-year-old students of the I.E.I 102 District pilot from Lurigancho-Chosica. This study proposes to do the research work by use of the quantitative approach, following a line of fundamental, substantive research or basic, using the mechanisms of the correlational descriptive method, finding the sample to study in a non-probabilistic way, taking into account the 111 children of 5 years. First, all the elements to be taken into account in the study are studied in depth, as well as the different theories that show how important musical education is in the children and the influence on the development of attention. Sarcoma vesical. Presentación de un caso.

Paciente femenina de 50 años de edad, quien presenta hematuria y pérdida de peso. Se le realizaron varios exámenes, incluyendo ultrasonido abdominal, donde se observa masa tumoral en región vesical. No se pudo intervenir, posteriormente, por la evolución tórpida con deceso, que presentara la misma.  Se toma muestra para biopsia y se envía el especimen quirúrgico a Anatomía Patológica; resultó un tumor vesical infrecuente con poca incidencia en la literatura.  Lo fundamental es señalar la importancia de poner en práctica y descubrir, a tiempo, las herramientas necesarias para evidenciar y diagnosticar estos tipos de tumores.  Palabras clave: Sarcoma vesical, ultrasonido abdominal, hematuria, Especimen quirúrgico
