ETIKA BERKOMUNIKASI DI MEDIA SOSIAL DALAM PERSPEKTIF PANCASILA

Abstrak: Penelitian ini dilatarbelakangi oleh masih adanya pelanggaran-pelanggaran hukum khususnya etika berkomunikasi di media sosial yang diatur di dalam Undang-Undang ITE dan KUHP. Media sosial seharusnya dimanfaatkan dengan baik di era Revolusi 5.0. Penelitian ini memiliki tujuan untuk menganalisis etika berkomunikasi di media sosial dalam perspektif Pancasila. Metode dalam penelitian ini menggunakan metode yuridis normatif dengan pendekatan studi kepustakaan dengan cara melakukan penelitian bahan-bahan pustaka atau data sekunder. Teknik analisis data menggunakan teknik pengolahan secara kualitatif dan penyajian data dilakukan secara diskriptif. Hasil penelitian menunjukkan bahwa etika berkomunikasi di media sosial belum optimal menerapkan nilai-nilai luhur Pancasila. Penegakan hukum sudah dilakukan dan beberapa kasus pelanggaran sudah diberikan hukuman. Konsep internalisasi nilai luhur Pancasila sebagai ideologi bangsa dan negara harus diterapkan di setiap kehidupan berbangsa dan bernegara. Upaya preventif dan edukasi bijak bermedia sosial tidak kalah penting daripada hanya sekedar focus kepada upaya represif. Seluruh stakeholder harus tetap konsisten membumikan Pancasila sebagai pijakan etika berkomunikasi di media sosial supaya lebih memberikan manfaat daripada maksiat

Legal Politics DKI Jakarta Government Policies In The Implementation Of Formula-E During The Covid-19 Pandemic

Formula-E organizers are included in the Governor's Instruction Number 49 of 2021 and are made on a regional priority scale. This caused controversy considering that at that time, Indonesia was still hit by COVID-19, and the government was trying to handle the community and carry out economic recovery. The research problem formulation is the legal politics of the DKI Jakarta government's policy in implementing Formula-E during the covid-19 pandemic. The purpose of this research is to determine the interests of the people affected by the implementation of Formula-E, which is used as a regional priority scale in the implementation of Formula-E Instruction Governor (INGUB) Number 49 of 2021. This type of research is descriptive qualitative; namely, it describes research based on theories and legal materials about legal politics and policies made by the government. This study uses a qualitative descriptive method using literacy studies and legislation—techniques in analyzing data using narrative analysis techniques. This study concludes that the administration of government affairs must prioritize the safety of the people first above other interests. The regulations that apply must be under the hierarchy so that the existing regulations do not conflict with higher regulations because the regulations at the lower level must adapt to the regulations at the upper level, namely the 1945 Constitution (UUD 1945) and the Pancasila State Constitution

Legal Politics of Increasing Welfare Based on Strengthening the Manufacturing Industry in Central Java

The background of this research is that people's welfare and regional development in Central Java have not increased. This is a very serious problem that needs to be properly addressed. The Indonesian constitution mandates in the preamble of paragraph 4 that the state aims to advance public welfare. This study aims to contribute ideas, namely legal politics, to increase welfare based on strengthening the manufacturing industry in Central Java. This study uses a normative juridical method with a statutory and conceptual approach. The results of this study are that to increase welfare based on strengthening the manufacturing industry in Central Java, at least ten choices of legal politics (policies) are needed, namely; legal harmonization, reforming the bureaucracy, optimizing the risk management team, optimizing cooperation with the private sector, maintaining economic commodities, sustainable infrastructure development, optimizing technology and industrial digitization, maintaining energy availability, holding national and international scale exhibitions, establishing special areas for development research. Recommendations in this study; researchers must conduct research related to increasing welfare through the manufacturing industry because there is still very little literature that can provide additional insight for society in general and for stakeholders and industrial digitization, maintaining energy availability, organizing national and international scale exhibitions, establishing special areas for development research. SINERGITAS AKADEMISI DAN BAWASLU DALAM PENCEGAHAN BERITA HOAX DAN BLACK CAMPAIGN

Hoax dan black campaign selama tiga tahun terakhir mengalami peningkatan signifikan khususnya pada pemilu serentak 2019 lalu. Hal ini sangat berbahaya dan mengancam demokrasi di Indonesia. Pasalnya apabila tidak dilakukan pencegahan secara baik akan semakin berbahaya lagi untuk pemilu serentak 2024 mendatang. Terbaru pada Pemilihan Walikota Magelang (Pilwalkot) 2020 juga terjadi beberapa pelanggaran hoax dan black campaign yang pada akhirnya masuk dalam sengketa pemilu. Sehingga Penyelenggara pemilu perlu bersinergi dan bekerjasama dalam mencegah hoax dan black campaign. Komisi Pemilihan Umum (KPU) dan Badan Pengawas Pemilu (Bawaslu) sudah bekerja maksimal tetapi perlu diperkuat oleh stake holder salah satunya bersinergi dengan akademisi. Kegiatan pengabdian kepada masyarakat ini dilakukan dengan metode sosialisasi dan FGD. Metode ini digunakan untuk memberikan pembekalan materi terkait sinergitas akademisi dan Bawaslu dalam mencegah hoax dan black campaign yang dapat meminimalisir penyimpangan-penyimpangan pemilu khususnya supaya demokrasi di Indonesia lebih baik. Kegiatan ini bertujuan untuk memberikan pemahaman pentingnya sinergitas akademisi dan Bawaslu khususnya dalam mencegah hoax dan black campaign. Serta memotivasi dan mendorong keterlibatan masyarakat untuk membantu mencegah hoax dan black campaign di tengah masyarakat. Hasil pengabdian; telah terlaksana kegiatan pengabdian dan dihasilkan sebuah kesepahaman bahwa akademisi fokus dalam kajian literasi serta melahirkan pemilih cerdas milenial melalui edukasi politik dan bijak dalam bersosial media serta mendorong keterlibatan mahasiswa dalam pemilu

THE DEVELOPMENT OF LEGAL AND MORAL RELATION THOUGHTS AND ITS IMPLEMENTATION TO INDONESIAN LEGISLATION SYSTEM

This research discusses the development of legal and moral relation that is inseparable from two very influential thoughts (mahzab): natural law and legal positivism. The views of both thoughts are in contradiction with each other on legal and moral relations. Natural legal thought explains that law and moral are interrelated and even interdependent, while legal positivism thought views that law and moral are two different and non-interconnected things. The objective of research is to study the development of relation between law and moral in Indonesian legislation system. The research method used was juridical normative method using primary and secondary law material inventoried to get prescriptive legal analysis. The result of research shows that legal and moral relation in Indonesian legislation system, by seeing the relation at substance level indicating integrative relation and at structural level indicating independent relation. In the relation, it can be understood that legal and moral relation is interconnected on the one hand and not interconnected in its law enforcement aspect on the other hand. Thus, the recommendation in this research is that legal substance and legal structure elements should complement each other as an intact legal system, to actually give law certainty, justice, and benefit to the people

PENGGUNAAN HAK INTERPELASI DPRD TERHADAP KEBIJAKAN PENYELENGGARAAN FORMULA-E

ABSTRACT The implementation of Formula E through Governor's instruction Number 49 of 2021 concerning the priority issue of DKI Jakarta in 2022 when the social and economic condition of the community was being affected by the coronavirus disease outbreak (Covid-19), causing controversy. DPRD as an institution that is given constitutional authority, namely legislating, budgeting and supervising, is able to provide balance and views from the people so that there is no arbitrariness from the government. The main problem formulation in this study is how does the use of interpellation rights affect the Formula-E Implementation Policy? The analytical method used is normative juridical. The conclusion of this study is that the use of interpellation rights can affect the policies issued by the DKI Jakarta Provincial government so that the implementation of Formula E experiences a delay in implementation in early 2022. The public policy theory that was used in this research is that policies issued must be based on the interests of the community. Rumusan masalah utama pada penelitian ini yaitu bagaimana pengaruh penggunaan hak interpelasi terhadap Kebijakan Penyelenggaraan Formula-E? Metode analisis yang digunakan adalah yuridis normatif. Kesimpulan penelitian ini yaitu bahwa penggunaan hak interpelasi dapat mempengaruhi kebijakan yang dikeluarkan oleh pemerintah Provinsi DKI Jakarta sehingga pelaksanaan Formula E mengalami penundaan pelaksanaan pada awal tahun 2022. Politik Hukum Dalam Inovasi dan Pembinaan Kearifan Lokal Desa Wisata Untuk Meningkatkan Kesejahteraan Sosial di Kecamatan Bandongan Kabupaten Magelang

Abstrak: Penelitian ini dilatarbelakangi oleh semangat untuk meningkatkan kesejaheteraan sosial. Setiap desa memiliki potensi dan ciri khas masing-masing. Kecamatan Bandongan Kabupaten Magelang termasuk kecamatan yang sedang gencar untuk meningkatkan nilai kearifan lokalnya dengan tujuan untuk meningkatkan perekonomian yang orientasinya kepada kesejahteraan sosial. Penelitian ini memiliki tujuan untuk menganalisa; 1) kerangka politik hukum otonomi desa tentang kearifan local; 2) upaya pemerintah desa dalam inovasi dan pembinaan kearifan lokal untuk meningkatkan kesejahteraan masyarakat. Metode yang digunakan dalam penelitian yakni yuridis normatif dengan pendekatan empiris dengan melakukan studi Pustaka, peraturan perundang-undangan. Pengumpulan data pada penelitian ini dilakukan melalui proses wawancara mendalam terhadap perangkat kecamatan dan kepala desa. Data yang terkumpul kemudian diolah dan dianalisis secara kualitatif kemudian disajikan secara diskriptif untuk menjawab persoalan yang diajukan dalam penelitian. Hasil penelitian ini menunjukkan bahwa 1) kerangka politik hukum otonomi desa terkait karifan lokal sudah sesuai dengan konstitusi negara serta tidak bertentangan dengan peraturan-peraturan hukum yang lebih tinggi. Sehingga dalam memberikan arah kebijakan diharapkan tetap sesuai dengan nilai filosofis, sosiologis dan yuridis. 2) Upaya pemerintah dalam inovasi dan pembinaan sudah dilakukan sesuai dengan kemampuan desa yakni meningkatkan infrastruktur desa wisata, peningkatan sumber daya manusia, serta peningkatan promosi wisata. 

TINJAUAN TERHADAP KEBIJAKAN PEMERINTAH KABUPATEN MAGELANG DALAM MENINGKATKAN POTENSI PARIWISATA PADA MASA PANDEMI

The spread of the Covid-19 virus in Indonesia has an impact on various sectors of life, especially the tourism sector. The Magelang Regency Government in this case has issued various policies based on the central government's policies in the context of handling Covid-19 in Magelang Regency and at the same time as policies that support the rise of the tourism sector. The purpose of this study was to determine the policies of the Magelang district government in increasing tourism potential during the pandemic. The research method uses the library method through a qualitative approach with reading materials in the form of scientific journals, papers and official websites related to the titles and variables that are the subject of writing. The Magelang Regency Government has prepared the feasibility of tourist destinations so that they do not become clusters of the spread of Covid-19. Tourist destinations that are allowed to open are only tourism that has received a CHSE certificate from the Ministry of Tourism and Creative Economy. The Magelang Regency Government also held mass Covid- 19 vaccinations at tourist destinations. In addition, the Head of the Magelang Regency Youth and Sports Tourism Office  Penyebaran Virus Covid-19 di Indonesia telah menimbulkan dampak berbagai sektor kehidupan, khususnya sector pariwisata. Pemerintah Kabupaten Magelang dalam hal ini telah mengeluarkan berbagai kebijakan yang berlandaskan atas kebijakan pemerintah pusat dalam rangka penanganan Covid-19 di Kabupaten Magelang sekaligus kebijakan yang mendukung bangkitnya sector pariwisata. Tujuan penelitian ini untuk mengetahui kebijakan pemerintah kabupaten Magelang dalam meningkatkan potensi pariwisata pada masa pandemi. Metode Penelitian menggunakan metode kepustakaan melalui pendekatan kualitatif dengan bahan bacaan berupa jurnal ilmiah, makalah maupun website resmi yang berkaitan dengan judul dan variabel yang menjadi pokok penulisan. Pemerintah Kabupaten Magelang telah mempersiapkan kelayakan destinasi wisata agar tidak menjadi klaster penyebaran Covid-19. Destinasi wisata yang diperbolehkan untuk dibuka hanya pariwisata yang telah menerima sertifikat CHSE dari Kementerian Pariwisata dan Ekonomi Kreatif. Pemerintah Kabupaten Magelang juga menyelenggarakan Vaksinasi Covid-19 massal di tempat wisata. Selain itu, Kepala Dinas Pariwisata Kepemudaan dan Olahraga Kabupaten Magelang bekerja sama dengan Dinas Komunikasi dan Informatika Provinsi Jawa Tengah dalam rangka melakukan penguatan sinyal internet di lokasi wisata alam
