    Legislating Morality Progressively - The Contraceptive Coverage Mandate, Religious Freedom, and Public Health Policy and Ethics

    This Article studies the contraceptive coverage mandate from three different perspectives. First, it provides a historical treatment of the regulatory rules adopted by agencies in the Obama Administration – specifically, the Departments of the Treasury, Labor, and Health and Human Services, which this Article collectively refers to as “the Administration” or “the Departments” – that imposed the mandate, focusing specifically on the rulemaking processes used to develop and promulgate the rules. In performing this historical study, the Article traces the development of the mandate from its root in the ACA to full implementation in legislative (substantive) rules finalized by the Administration in the summer of 2013. Second, this Article evaluates the mandate under the legal framework established by Congress in the Religious Freedom Restoration Act (RFRA), focusing especially on the Administration’s RFRA analysis in its rulemaking materials and the Supreme Court’s recent ruling regarding the mandate. Third, it analyzes the mandate under a moral and policy-based framework proposed by a team of leading bioethicists, public health policy analysts, and scholars. It applies the team’s proposed framework to determine whether the Departments that developed and adopted the mandate satisfied the various moral and policy considerations that these experts have highlighted

    Rotating-plate sprinkler spacing on continuous-move irrigation laterals

    Understanding the operational characteristics of irrigation sprinklers is necessary before irrigation professionals can make sound recommendations regarding the use of sprinkler technologies for field conditions. Results of laboratory studies regarding rotating plate sprinklers are reported. Uniformity of radial water application from individual sprinklers has a major influence on uniformity of water application under a continuous-move irrigation machine. Nozzle pressure can have a significant effect on radial water application patterns, especially when less than recommended pressures are used. Water application patterns are not as sensitive to changes in nozzle diameters as to nozzle pressures. Uniformity of water application can also be very sensitive to sprinkler spacing. The greater the variation in radial water application intensities for individual sprinklers, the more critical proper sprinkler spacing become

    Irrigation of Sand-based Creeping Bentgrass Putting Greens with Nanobubble-oxygenated Water

    Cultural and environmental factors can place creeping bentgrass (Agrostis stolonifera) under extreme stress during the summer months. This stress, coupled with the growth adaptation of creeping bentgrass, can result in shallow, poorly rooted stands of turf. To enhance root zone oxygen and rooting of creeping bentgrass, golf courses use methods such as core and solid-tine aerification, and sand topdressing. An additional method of delivering oxygen to the soil could be irrigation with nanobubble-oxygenated water. The properties of nanobubbles (NBs) allow for high gas dissolution rates in water. Irrigating with NB-oxygenated water sources may promote increased rooting of creeping bentgrass putting greens during high-temperature periods and lead to a more resilient playing surface. The objectives of this study include comparing the effects of irrigation with NB-oxygenated water sources with untreated water sources on creeping bentgrass putting green root zone and plant health characteristics using field and controlled environment experiments. Treatments included NB-oxygenated potable water and irrigation pond water, and untreated potable and irrigation pond water. In the field, NB-oxygenated water did not enhance plant health characteristics of creeping bentgrass. In 1 year, NB-oxygenated water increased the daily mean partial pressure of soil oxygen from 17.48 kPa to 18.21 kPa but soil oxygen was unaffected in the other 2 years of the trial. Subsurface irrigation with NB-oxygenated water did not affect measured plant health characteristics in the greenhouse. NB-oxygenation of irrigation water remains an excellent means of efficiently oxygenating large volumes of water. However, plant health benefits from NB-oxygenated irrigation water were not observed in this research

    Cross section measurement of N 14 ( p , Îł ) O 15 in the CNO cycle

    Background: The CNO cycle is the main energy source in stars more massive than our sun; it defines the energy production and the cycle time that lead to the lifetime of massive stars, and it is an important tool for the determination of the age of globular clusters. In our sun about 1.6% of the total solar neutrino flux comes from the CNO cycle. The largest uncertainty in the prediction of this CNO flux from the standard solar model comes from the uncertainty in the ^{14}\mathrm{N}(p,\ensuremath{\gamma})^{15}\mathrm{O} reaction rate; thus, the determination of the cross section at astrophysical temperatures is of great interest.Purpose: The total cross section of the ^{14}\mathrm{N}(p,\ensuremath{\gamma})^{15}\mathrm{O} reaction has large contributions from the transitions to the Ex=6.79MeV{E}_{x}=6.79\phantom{\rule{4pt}{0ex}}\mathrm{MeV} excited state and the ground state of 15O^{15}\mathrm{O}. The Ex=6.79MeV{E}_{x}=6.79\phantom{\rule{4pt}{0ex}}\mathrm{MeV} transition is dominated by radiative direct capture, while the ground state is a complex mixture of direct and resonance capture components and the interferences between them. Recent studies have concentrated on cross-section measurements at very low energies, but broad resonances at higher energy may also play a role. A single measurement has been made that covers a broad higher-energy range but it has large uncertainties stemming from uncorrected summing effects. Furthermore, the extrapolations of the cross section vary significantly depending on the data sets considered. Thus, new direct measurements have been made to improve the previous high-energy studies and to better constrain the extrapolation.Methods: Measurements were performed at the low-energy accelerator facilities of the nuclear science laboratory at the University of Notre Dame. The cross section was measured over the proton energy range from Ep=0.7{E}_{p}=0.7 to 3.6 MeV for both the ground state and the Ex=6.79MeV{E}_{x}=6.79\phantom{\rule{4.pt}{0ex}}\mathrm{MeV} transitions at {\ensuremath{\theta}}_{\text{lab}}={0}^{\ensuremath{\circ}}, {45}^{\ensuremath{\circ}}, {90}^{\ensuremath{\circ}}, {135}^{\ensuremath{\circ}}, and {150}^{\ensuremath{\circ}}. Both TiN and implanted-14N^{14}\mathrm{N} targets were utilized. \ensuremath{\gamma} rays were detected by using an array of high-purity germanium detectors.Results: The excitation function as well as angular distributions of the two transitions were measured. A multichannel RR-matrix analysis was performed with the present data and is compared with previous measurements. The analysis covers a wide energy range so that the contributions from broad resonances and direct capture can be better constrained.Conclusion: The astrophysical SS factors of the Ex=6.79MeV{E}_{x}=6.79\phantom{\rule{4.pt}{0ex}}\mathrm{MeV} and the ground-state transitions were extrapolated to low energies with the newly measured differential-cross-section data. Based on the present work, the extrapolations yield {S}_{6.79}(0)=1.29\ifmmode\pm\else\textpm\fi{}0.04(\mathrm{stat})\ifmmode\pm\else\textpm\fi{}0.09(\mathrm{syst})\phantom{\rule{4pt}{0ex}}\mathrm{keV}\phantom{\rule{0.16em}{0ex}}\mathrm{b} and {S}_{\text{g.s.}}(0)=0.42\ifmmode\pm\else\textpm\fi{}0.04(\mathrm{stat})\phantom{\rule{4pt}{0ex}}\mathrm{keV}\phantom{\rule{0.16em}{0ex}}\mathrm{b}. While significant improvement and consistency is found in modeling the Ex=6.79MeV{E}_{x}=6.79\phantom{\rule{4.pt}{0ex}}\mathrm{MeV} transition, large inconsistencies in both the RR-matrix fitting and the low-energy data are reaffirmed for the ground-state transition. Reflecting this, a systematic uncertainty of {}_{\ensuremath{-}0.19}^{+0.09}\phantom{\rule{4pt}{0ex}}\mathrm{keV}\phantom{\rule{0.16em}{0ex}}\mathrm{b} is recommended for the ground-state transition

    The efficacy of vigorous-intensity exercise as an aid to smoking cessation in adults with elevated anxiety sensitivity: study protocol for a randomized controlled trial

    Background: Although cigarette smoking is a leading cause of death and disability in the United States (US), over 40 million adults in the US currently smoke. Quitting smoking is particularly difficult for smokers with certain types of psychological vulnerability. Researchers have frequently called attention to the relation between smoking and anxiety-related states and disorders, and evidence suggests that panic and related anxiety vulnerability factors, specifically anxiety sensitivity (AS or fear of somatic arousal), negatively impact cessation. Accordingly, there is merit to targeting AS among smokers to improve cessation outcome. Aerobic exercise has emerged as a promising aid for smoking cessation for this high-risk (for relapse) group because exercise can effectively reduce AS and other factors predicting smoking relapse (for example, withdrawal, depressed mood, anxiety), and it has shown initial efficacy for smoking cessation. The current manuscript presents the rationale, study design and procedures, and design considerations of the Smoking Termination Enhancement Project (STEP). Methods: STEP is a randomized clinical trial that compares a vigorous-intensity exercise intervention to a health and wellness education intervention as an aid for smoking cessation in adults with elevated AS. One hundred and fifty eligible participants will receive standard treatment (ST) for smoking cessation that includes cognitive behavioral therapy (CBT) and nicotine replacement therapy (NRT). In addition, participants will be randomly assigned to either an exercise intervention (ST+EX) or a health and wellness education intervention (ST+CTRL). Participants in both arms will meet 3 times a week for 15 weeks, receiving CBT once a week for the first 7 weeks, and 3 supervised exercise or health and wellness education sessions (depending on randomization) per week for the full 15-week intervention. Participants will be asked to set a quit date for 6 weeks after the baseline visit, and smoking cessation outcomes as well as putative mediator variables will be measured up to 6 months following the quit date. Discussion: The primary objective of STEP is to evaluate whether vigorous-intensity exercise can aid smoking cessation in anxiety vulnerable adults. If effective, the use of vigorous-intensity exercise as a component of smoking cessation interventions would have a significant public health impact. Specifically, in addition to improving smoking cessation treatment outcome, exercise is expected to offer benefits to overall health, which may be particularly important for smokers. The study is also designed to test putative mediators of the intervention effects and therefore has the potential to advance the understanding of exercise-anxiety-smoking relations and guide future research on this topic

    We study global aspects of complete, non-singular asymptotically locally AdS spacetimes solving the vacuum Einstein equations whose conformal infinity is an arbitrary globally stationary spacetime. It is proved that any such solution which is asymptotically stationary to the past and future is itself globally stationary.
